  • Failure to Disclose Health and Safety Hazard Information: While the travel agent normally has no duty to investigate ultimate service providers for compliance with safety and health laws, the agent may be jointly liable in circumstances where the agent knew or should have reasonably known of specific risks and did not communicate them to the traveler. RO77BTRLEURCRT0327720601 (SWIFT Code: BTRLRO22) opened at Transilvania Bank, holder of the tourism license no. 7531, for the agency: Soca Tour represented by Soca Iulian as a manager, hereinafter referred to as the Agency;

And the tourist/representative of the tourist, Mr./Mrs. ………………….with domicile in ……………., telephone no......................., holder of ID card series………………no……………., issued by…………………….on………………….,

Have agreed upon the conclusion of this agreement.

I. Scope of the agreement

1.1. The scope of the agreement is the sale by the Agency of the package of tourist services included in the voucher, holiday voucher, treatment, travel ticket, other document attached to this agreement and issuance of payment and travel documents.

II. Conclusion of the agreement

2.1. The agreement is concluded when the tourist and the representative of the Agency sign it. It is the responsibility of the travel agency to inform the tourist by any means agreed with him in writing (telephone, mail, fax, etc.) if the reservation he has requested has been confirmed. In order to process a service booking, the Agency may require cash in advance of at least 25% of the package price or full payment of the package, depending on when the tourist requests the services.

2.2. If the present agreement is fully available to the tourist in the form of a catalogue, leaflet, other documents, the Agency’s website or other electronic means of communication (e-mail, fax, etc.), the obligation to inform the tourist is considered fulfilled by entering this information into any travel documents or tax documents provided by the Agency, without the need to conclude in writing the agreement for the marketing of tourist packages.

2.3. The agreement shall cease as soon as the actual provision of the package of travel services entered on the travel documents has been completed.

III. Price of agreement and payment methods

3.1. The price of the agreement is stated in the agreement annex, voucher or invoice, and it is made up of the total amount of actual travel services, including VAT.

3.2. Payment methods: Upon the conclusion of the agreement, a cash advance of at least 25% of the fixed price will be charged, and the final payment will be made in cash (in RON or EURO) upon arrival or by bank transfer, approximately one week before the start of the service.

IV.  Rights and obligations of the Agency

4.1. In case of alteration of one of the essential provisions of this agreement, such as: the services included in the package, the travel dates, the alteration of the category of the accommodation unit, the Agency has the obligation to inform the tourist in due time, having the right to opt for termination or continuation of the agreement. These changes must be substantiated, showing they have been made, namely: variations of transport costs, tourist taxes, accommodation costs or exchange rates.

4.2. If, after the start of the tourist trip, a significant part of the tourist services provided in the agreement is not carried out or the Agency finds that it will not be able to accomplish it, the Agency is obliged to offer the tourist suitable alternatives for the continuation of the tourist trip without increasing the price, respectively the tourist services offered to be of the same quality and quantity.

4.3. The Agency is responsible for the proper performance of contractual obligations, except the following cases:

a) when the failure or defective performance of the obligations assumed by the agreement is due to the tourist;

b) when the failure of the obligations is due to causes of force majeure or circumstances which neither the Agency nor the service providers could foresee or avoid, including a third party, whether or not related to the provision of the services;

c) the Agency has the obligation to provide the tourist within 7 days but no less than 3 days before the departure date, the departure hours, the guide’s / driver’s contact no., local organizer’s contact no., and a number to call in emergency situations.

V.  Rights and obligations of the tourist

5.1. If the tourist cannot participate in the tourist trip, he may assign the agreement to a third person who fulfils all the conditions applicable to the package of contracted tourist services with the obligation to notify the Agency in writing before the departure date;

5.2. In the case of holiday and / or treatment stays in Romania, the tourist has the obligation to communicate the check in and check out program to / from the accommodation and any additional costs generated by not checking out of the accommodation by noon specified by the hotelkeeperfall under the exclusive duty of the tourist.

5.3. The tourist has the right to terminate the agreement at any time, in whole or in part, and if the termination is imputable to him, he is obliged to indemnify the Agency for the damage created according to the provisions of chapter VI, except the cases of force majeure defined by law.

5.4. The tourist will have to present the identity card when arriving at the accommodation. The tourist is aware that the services they purchase without being part of the agreement with the travel agency are strictly responsible to the local provider, the law of the country of destination governs them and the travel agency has no responsibility for the services in question.

5.5. For optimum information, the Agency also recommends consulting the Border Police’s website in order to clarify possible minor issues or travel documents; The Agency is not responsible for any problems encountered.

5.6. The travel agency recommends that tourists contact the agency 24 hours before departure to reconfirm the travel details.

5.7. If one person hires services for a larger number of tourists, the agreement conditions automatically extend to the entire group for which the services have been paid.

5.8. The tourist is obliged to use the means of transportation, the hotel room and the property as a good owner and according to their destination. The Agency is not responsible of any damage caused or injuries suffered by tourists as a result of non-compliance with this paragraph.

5.9. The tourist will collaborate with the guide during the contracted tourism program, being required to meet the arrival times at the meeting points or other organizational aspects. The Agency is not responsible for any costs / problems arising from non-compliance with these organizational aspects.

VI.  Renouncement, penalties, damages, complaints and insurance

6.1. If the tourist renounces the package of tourist services, he owes the Agency penalties as follows. Alternatively, the sum will be blocked to be used for future tours. The decision will be made by the agency; 0% of the cash paid in advance (only the reimbursement fee is retained), if renouncement is made more than 30 calendar days before the departure date; 50% of the cash paid in advance, if the renouncement is made within 7 to 30 calendar days before the departure date; 100% of the cash paid in advance, if the renouncement is made less than 7 calendar days prior to departure or by not showing up to the program; in case of parents with children younger than 2 years of age, in the event of child health problems, the cash advance will be refunded, except for the bank transfer fee, regardless of the moment when the package is cancelled.

6.2. The Agency is not liable in case of strikes, political and war conflicts, catastrophes, public dangers, terrorist attacks, international embargo, and airlines setting limitations. All situations that are not imputable to either party are considered to be force majeure and exonerate the Agency from liability.

6.3. If the tourist not satisfied with the tourist services received, he is obliged to make a clear and explicit written notice to the deficiencies found, which will be promptly sent to both the representative of the Agency and the travel service provider. Both the Agency and the travel service provider will act immediately to resolve the complaint.

6.4. The tourist is insured for the amounts paid by him in the event of insolvency or bankruptcy of the Agency, at the Insurance Company which issued the insurance policy which is displayed on the travel agency website www.socatour.ro , in the Contact section.

VII . 7.1. The documents of the agreement are annexed to the agreement and are as follows: tourist program, voucher, order bill, as the case may be.

VIII. Final provisions

8.1. This agreement was concluded in two copies, one for each party. This agreement is carried out in accordance with the provisions of the Government Ordinance no. 107/1999, republished.

8.2. All accommodation units as well as means of transport are classified by the competent authorities of the countries of destination according to local procedures and local norms, where they exist, which differ from one country to another and from one type of destination to another.

8.3. Disputes arising between parties are settled amicably, otherwise the parties agree to address the competent courts.

Some travel agencies are not limited to leisure travel, since a number of these agencies also cater to business travel .

Assisting companies whose staff has the need to frequently travel. With a travel services agreement this is usually exchange whenever a travel agency assist big groups such as corporate accounts both for leisure and business travel, educational and incentive tours and leisure groups. But of course this is not limited to such, if individuals or smaller size groups wished to sign a travel services agreement, then they are welcomed to do so. A travel services agreement is document that consists of the arrangement between a client and the travel agency which states of the various travel services in which the client will be availing of including the terms and conditions.

This section contains the provision of travel management and related services such as, but not limited to, airline ticketing and airport transfer, hotel reservations and related services (visa service, travel insurance, car rental) and other travel management by the travel agent. This should also point to the client that travel agents has a wide array of suppliers and service providers whose own cost, terms and conditions are subject to change without notice.

Specify the list of travel services that is required of the travel agency such as the following examples:

  • Airline, boat, rail or car rental fare and hotel quotation, submits different proposal to choose from and the best possible route and cost effective route towards the city of destination
  • Issuance and delivery of airline, boat or rail tickets within 24 hours of receipt and may or may not include seat reservations or boarding pass only to the request of the traveler.
  • Information on country visa requirements, health, immigration clearance, foreign exchange control regulation and other government restrictions, and assistance in obtaining travel tax exemption certifications, passports and entry visas to the country.
  • Reconfirms and revalidates  airline tickets, re-issued tickets which are returned as a result of changed routing or fare structures and printed travel itineraries showing complete information on status of reservations on all carriers and hotels;
  • Notifies travelers should there be any changes with the flight schedule, cancellation, train strikes or other relevant disruptions from air, land or sea travel. And helps organize any rebooking or refunds due to this untimely event.
  • Investigation on any complaints from travelers and follow up the recovery of lost baggage
  • Quotes all inclusive tour or cruise packages
  • Organizes conferences and seminar packages

Arrangement of the terms of payments should be defined by both parties. Such as if the agency would require down payment for their services and to be paid in full after the tours or packages are availed. Or should there be a contract in which allows a company perhaps (usually for corporate accounts) to settle payment after an invoice has been sent, and to be paid on an certain date or period. Payment scheme must also be defined in your agreement, such as payment in credit card (if any there any additional bank fees), in cash or check. Also for the pricing, it must be stated that price and rates of certain travel products are highly subject to change. Such as airline, rail tickets, hotel and car rentals would rise or fluctuate depending on the season or if any promotions are offered by these suppliers.

A liability clause must also be defined in the agreement as to what extent is a travel agency liable. For example a travel agent arranges a full group package, should anything happen to one of the travelers, the most a travel agent can do is to offer assistance as to contact their travel insurance partner company (provided the client has also purchased the insurance along with the package). But any damages or cost incurred that isn’t at any fault of the travel agency, as they are not liable to pay or settle.

The agreement should constitute the proper scope of confidentiality and data privacy of its clients.

The agreement commences on the date the application is delivered and signed and shall continue for the duration of time the travel management services has been provided. The agreement may be terminated by either party upon on the agreed number of months.

A lot of travel agencies offer full packages that are less hassle rather than you arrange this all by yourself. And for more complicated and costly travel plans, it is best to acquire help from a travel agent who can adjust and arrange your travel plans for you that can fit your preferences. In fact large leisure or corporate groups still requires a travel agent to arrange their travel plans for them. Travel agents offer them peace of mind from all the complicated planning.

Agreement for Travel Management Services

We are Global Dream Vacation and The Traveling Compass, LLC, collectively referred to herein as “Agent”.  We look forward to the opportunity to act as your booking agent for your travel needs. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, in addition to your obligations as a client. The person, entity, or their representatives using our services, website, or booking a reservation through us are referred to as “you” and “your” throughout and includes any forms attached or any quote or invoice provided by us referencing these terms and conditions. The terms “we”, “us” and “our” refer to the Agent.

This Agreement commences on the date we accept your account application form or the date you place a booking through us (whichever occurs sooner) and shall continue for the duration of time we provide travel management services to you. This Agreement is non-exclusive.

Our Agreement With You

During the Term, we will use our best efforts to provide you, with services as requested.  We sell a variety of travel-related products from different suppliers and service providers (“Suppliers”). Each Supplier has its own terms and condition that are applicable to your particular arrangements in addition to our general terms and conditions, and you should make sure you understand them. Certain software and content found on our website are owned or licensed by us or our Suppliers, your use of which may be subject to further conditions. Our website, which is referred throughout this Agreement, can be found at www.thetravelingcompass.com .

When you make a booking with us, you acknowledge and agree that we will be acting as an agent only for the relevant transport, accommodation or other travel service provider. Our obligation to you is to (and you expressly authorize us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. The travel service provider, and not the Agent, will be responsible to you for the provision of the relevant travel service. Any services we provide to you are collateral to our agency relationship with the travel service provider and are separate to the actual provision of the travel services. We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services. Your legal recourse for travel services is against the specific travel service provider and, except to the extent a problem is caused by fault on our part, not against us. Specifically, if for any reason (excluding fault on our part), any travel service provider is unable to provide the travel services for which you have contracted, your remedy lies against the travel service provider and not with us.

Travel Insurance

For all travel, we strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. It is your responsibility to ensure you have valid travel insurance that covers and is appropriate for your needs. Travel insurance is a mandatory element of some travel arrangements. We will not be liable for any loss you incur if and insofar as you are able to claim for damages under a travel insurance policy. We can arrange travel insurance for you or provide you with a quote or general information about the travel insurance options available to you.

Understanding this Agreement

The provider of your travel service will have its own terms and conditions (such as airline conditions of carriage or accommodation or car hire terms). All such terms and conditions (including limitations of liability) apply to any travel service booked pursuant to this Agreement and, accordingly, a reference to “this Agreement” shall mean (i) the terms and conditions set out herein; (ii) the terms and conditions set out in any credit account extended to you (if applicable); and (iii) all terms and conditions of any provider of your travel services. To the extent of any inconsistency between a travel service provider’s terms and conditions and the terms and conditions set out herein, the travel service provider’s terms and conditions shall prevail, save to the extent that any provision in the travel service provider’s terms and conditions is deemed to be invalid or unenforceable. Your travel service providers will be identified on your itinerary or travel documents and their respective terms and conditions will be available directly on their websites or by contacting them. Alternatively, you can ask us for copies. You must read all applicable travel service provider terms and conditions carefully because in every case they will apply to the provision of your travel services.

Travel Documents

Travel documents include airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable, non-transferable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking or on the travel documents may result in an inability to travel on that booking and the booking being canceled. Please review your travel documentation carefully and advise us immediately of any errors in names, dates, and timings. You must ensure you have all your travel documents and e-tickets prior to travel. Please let us know if you believe you have not received any required documentation. Refunds will not be issued for passengers denied boarding due to inability to present proper documentation or failing to arrive at the airport on time.

A flight described on your travel documents and/or itinerary as “direct” will not necessarily be non-stop. All departure/arrival times are provided by the airlines concerned and are estimates only. They may change due to air traffic control restrictions, weather conditions, and operational requirements.

Our general practice is to send documents to our customers electronically whenever possible. We reserve the right to charge an administration fee should you make a request for such documents to be sent as a hard copy.

If possible, name changes provided in writing will be accepted until 48 hours before departure and are subject to the provisions and penalties of flight contracts. Name changes can be refused at any time or subject to cancellation penalties in the case of a hotel/supplier close-out. Name changes requested after documents are issued will be assessed a $50.00 per person name change fee in addition to any supplier, third party or other fees and assessments.

Where we provide you with a quote for a scheduled airline ticket, the price shall be valid at the time of quote (excluding airline taxes, which are subject to change and may be re-quoted at the time your booking is confirmed), but fare quotes are subject to change due to airline availability, pricing, and terms or other factors that are beyond our control. In all other cases, prices are subject to availability and can be withdrawn or changed without notice. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes, and airfare increases. Please contact us for up to date prices.

All airlines tickets are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. You may be charged additional sums by the Agent to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. Acceptance of these terms and conditions hereby consent you to any post-purchase price increases and authorize the Agent to charge my credit card for such additional amounts.

Deposits and Payment

Any deposits from you are non-refundable, unless otherwise specifically specified. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Suppliers.

We reserve the right to refuse personal checks as a method of payment. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of such increase. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.

Payment Terms

Corporate credit card payments will be taken at time of booking/invoicing and will incur merchant fees. You authorize us to charge all fees incurred by you in relation to the services provided to the card designated by you. If payment is not received from the card issuer or its agents for any reason, you agree to pay us all amounts due immediately on demand. You indemnify us against any loss that may be experienced by us due to any fraudulent use or otherwise of that credit card. Please note that in some circumstances we will require a photograph or facsimile of the front and back of the card along with a driver’s license or other government identification of the person named on the card and a signed authorization.

Amendment and Cancellation Fees

Canceled bookings may incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Fees and extra charges may also apply where a booking is changed and when tickets or documents are re-issued. Where we incur any liability for a travel service provider cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge. Where you seek a refund for a canceled booking for which payment has been made to the travel service provider, we will not provide a refund to you until we receive the funds from that travel service provider.

Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.

If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the United States, we will contact you by email to advise you of this. Please ensure that you have given your contact email address to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.

If you have purchased a return flight, multi-stop or round the world flight and you do not check in on a confirmed flight, the airline will register you as a ‘no show’ and your tickets on your subsequent flights will be canceled. Please contact us as soon as possible if you do not intend to check-in for a confirmed reservation in these circumstances.

After you have left the US, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 72 hours before the scheduled departure of each flight to do this. Please note that for some airlines it is mandatory to confirm with them your intention to fly.

Passports & Visas

You assume full and complete responsibility for checking and verifying all passport and visa requirements of the destinations and for complying with all laws of the country in the Itinerary.

All travelers must have a valid passport for international travel and many countries require at least 6 months validity from the date of return. Some countries also require a machine-readable passport and/or unstamped available pages. When assisting with an international travel booking, we will assume that all travelers on the booking have a valid passport. If this is not the case, you must let us know. It is important to ensure you have valid passports, visas and re-entry permits which meet the requirements of immigration and other government authorities. Any fines, penalties, payments, delay or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility (except to the extent caused by fault on our part).

If you need information regarding visas, passports and other travel document requirements for your trip, please contact us. We can provide you with general information on visa and passport requirements that apply to international travel bookings you make with us. We can also obtain more specific information from an external visa advisory service provider on your behalf (if you wish, we can obtain visas for you through this external service and fees will apply). We do not warrant the accuracy of visa and passport information provided by any external service and accept no liability for any loss or damage which you may suffer in reliance on it (except to the extent caused by fault on our part).

Travel Advice and Vaccinations

U.S. Citizens should refer to the travel advice posted by the U.S. Department of State at www.travel.state.gov  for all the countries you intend to visit. Vaccinations may be required for some or all of the places you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary. For medical information, we recommend contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel .

Airline use of Insecticide Spray

Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft.  Federal law requires that we refer you to the Department of Transportation’s Disinfection Information page on their website at the time of booking for further information.   https://www.transportation.gov/airconsumer/spray

Hazardous Materials Disclosure

Federal law forbids the carriage of hazardous materials aboard aircraft in your luggage or on your person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, and radioactive materials. Examples: paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radio-pharmaceuticals.

There are special exceptions for small quantities of medicinal and toilet articles carried in your luggage and certain smoking materials carried on your person. You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country or invalidate your travel insurance cover. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. We would be happy to provide you details of travel clinics on request.

During local or national holidays abroad, certain facilities such as museums, sightseeing tours, and shopping may be limited.  

We exercise care in the selection of reputable travel service providers but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. We are responsible to ensure that we process your booking with reasonable skill and care and, accordingly, our liability to you (except for fraud, or death or personal injury caused by our negligence) will be limited to supplying the relevant service again or paying the cost of having the relevant service supplied again. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage.

In no event, do we accept any liability in contract, tort or otherwise, for any injury, damage, property damage, accident, irregularity, loss, delay, additional expense or inconvenience caused either: (i) directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part (ii) any matter beyond our exclusive control including but not limited to a delay or cancellation of a flight that causes you to miss any portion of your trip or tour. We also do not accept any liability in contract, tort or otherwise, for consequential loss (meaning indirect loss, loss of revenue, loss of reputation, loss of profits, loss of actual or anticipated savings, lost opportunities, including opportunities to enter into arrangements with third parties or loss or damage in connection with claims against you by third parties) howsoever caused in connection with your booking. We have no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.

Special Requirements

Please speak to us about any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or access. Please understand that travel service providers may not be able to accommodate every request.

Frequent Flyer & Loyalty Programs

Please provide your frequent flyer membership details (or other applicable loyalty program details) at the time of booking. Please check your loyalty program for the specific terms of your membership. We cannot guarantee that the travel service provider will credit you with points for your booking. Any loyalty program discrepancies in relation to your booking must be communicated to us within six months of your flight departure date.

Data Protection

To protect your employees’ personal data, we maintain appropriate technical and organizational measures. The parties agree that the terms of the Privacy Policy are incorporated by reference into this Agreement and form part of this Agreement as though set out herein. All services provided under this Agreement (including any ancillary services such as booking platform access, traveler tracking and reporting) shall be considered an instruction to process personal data.

We will also provide an option for select individuals within your organization (such as travel bookers and procurement managers) to receive the latest travel news, alerts and offers. Recipients may opt-out at any time.

Money not held on trust

All money paid by you to us will be our property and will be a debt due and payable to the travel service provider. You agree and acknowledge that such money will not be held by us on trust for and on behalf of you and we may hold such money in any account as we see fit, including with our own and/or our other clients’ money.

Third Party Rights

A person who is not a party to this Agreement shall have no rights to enforce any term of this Agreement. This paragraph does not affect any right or remedy of any person which exists or is available otherwise than pursuant to that Act.

Use of our Services and Website

You agree you will only use our website or services to make legitimate reservations or purchases and shall not make speculative, false or fraudulent reservations or reservations in anticipation of demand. You will only use our website and services in compliance with applicable law. The Website is subject to the Terms of Service .

Without our prior written permission, you may not (a) access, monitor or copy any content or information on our website using any “robot”, “spider” or other automated or manual device or program, (b) deep link to any portion of our website, or (c) “frame” or incorporate any portion of our website into any other website.

Our website may contain links to third party websites that we provide only as a convenience to you. You should take precautions to ensure that whatever links you access are free of viruses, worms, trojan horses or other destructive mechanisms. Events During Your Travels

You are also responsible for respecting the authority and following the directions of the tour guide during a Tour. You may be excluded from participating in all or any part of the tour if, in our sole discretion or the sole discretion of the supplier, your condition or behavior renders you unfit for the tour or unfit for continuation once the tour has begun. Unfitness may include, without limitation, any behavior that, regardless of its cause, is inappropriate or offensive or interferes with the delivery of tour services, or may constitute a hazard or embarrassment. In such case, our liability shall be strictly limited to a refund of the recoverable cost of any unused portion of the tour. We are not responsible for the behavior of other tour participants toward you. Should you decide not to participate in certain parts of the tour, no refunds will be made for those unused parts. You agree to release us from liability for any matter for which we disclaim liability under this Agreement. You agree to indemnify and hold us harmless from and against our liability to third parties arising out of your or your companions’ actions or omissions.

Indemnification

You agree to indemnify us and our affiliates, and any of our Suppliers, and any such parties’ officers, directors, employees and agents from and against any claims, causes of action, demands, losses, damages, or other costs, (including reasonable legal and accounting fees) brought by you or third parties as a result of (a) your breach of this Agreement, (b) your violation of any law or rights of any third party, or (c) your use of our website.

Privacy Policy

You consent to our processing and sharing of personal information about you and other members of your party that you have provided to us in accordance with the terms of and for the purposes set forth in our privacy policy. You represent that you have read and agree to the terms of our Privacy Policy , which can be found at our Website.

Your continued access or use of our website or services signifies your acceptance of the modifications to the Agreement. You may not assign your rights or obligations under this Agreement to any third party. We may terminate this Agreement at any time for any reason, and such termination shall not affect any right to relief to which we are entitled at law or in equity.

This Agreement shall be governed by the laws of the State of Indiana without regard to its conflicts of laws principles. You consent and agree regardless of your physical location, business address, or residence at the time of any communication, directive, or booking that you are conducting business within the State of Indiana for all purposes and any laws or provisions of other states or territories shall not apply. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforceability of the remaining provisions will not in any way be affected or impaired.

Final Provisions

From time to time it may be necessary for us to amend this Agreement. You agree that we may make changes to this Agreement at any time and for any reason. Each time a material change is made to this Agreement by us we will provide a copy of the updated Agreement to you. It is your obligation to check the updated Agreement. If you continue to receive services from us then you agree that you are deemed to have accepted the updated Agreement.

If any dispute arises in relation to this Agreement, the laws of the State of Indiana will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts in Hamilton County, Indiana and waive any right that you may have to object to an action being brought in those courts. Any provision (or part of any provision) of this Agreement which is invalid in any jurisdiction is invalid in that jurisdiction to that extent, without invalidating or affecting the remaining provisions (or part provision) or the validity of that provision in any other jurisdiction.

If any dispute arises in relation to this Agreement, the laws of the State of Indiana will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts in Hamilton County, Indiana and waive any right that you may have to object to an action being brought in those courts.  Any dispute related to the tour shall be governed by Indiana law without regard to conflict of laws principles. You agree to present any claims against us within 30 days after the tour ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year.

Facsimile transmission, electronic signature, or electronic acknowledgment of any signed document shall be deemed delivery of an original. At our request, you shall promptly provide an original document as well. If there are any conflicts between this Agreement, the Reservation Form, and the Itinerary, this Agreement shall apply.

In instances where a single person is acting on behalf of a group of passengers in relation to the ticket purchase and check-in processes, that single person is assuming the responsibility of providing the terms and conditions to each passenger traveling and is responsible for providing the indication of understanding on behalf of the group. The group representative or entity shall provide indemnification for any misunderstanding or claim arising related to a failure to communicate or obtain consent related to the terms and conditions or this agreement.

Agreement for travel management services

  • The company or other entity named in the account application form attached to these terms and conditions or in any quote or invoice provided by us referencing these terms and conditions (“you”, “your”).

This Agreement commences on the date you sign this document or the date you place a booking through us (whichever occurs sooner) and shall continue for the duration of time we provide travel management services to you. This agreement may be terminated by either party upon three months written notice.

Understanding this Agreement

The provider of your travel service will have its own terms and conditions (such as airline conditions of carriage or accommodation or car hire terms). All such terms and conditions (including limitations of liability) apply to any travel service booked pursuant to this Agreement and, accordingly, a reference to “this Agreement” shall mean (i) the terms and conditions set out herein; (ii) the terms and conditions of the Flight Centre Travel Group Data Processing Addendum (see below); (iii) the terms and conditions set out in your credit account approval letter (if applicable); and (iv) all terms and conditions of any provider of your travel services. To the extent of any inconsistency between a travel service provider’s terms and conditions and the terms and conditions set out herein, the travel service provider’s terms and conditions shall prevail, save to the extent that any provision in the travel service provider’s terms and conditions is deemed to be invalid or unenforceable. Your travel service providers will be identified on your itinerary or travel documents and their respective terms and conditions will be available directly on their websites or by contacting them. Alternatively you can ask us for copies. You must read all applicable travel service provider terms and conditions carefully because in every case they will apply to the provision of your travel services.

For the purposes of Directive (EU) 2015/2302 on package travel and linked travel arrangements and the Danish legislation implementing that Directive, the parties agree that this Agreement is a general agreement for the arrangement of business travel.

Where we provide you with a quote for a scheduled airline ticket, the price shall be valid until close of business on the day of the quote (if nothing else is stated) or such shorter time we may specify (excluding airline taxes, which are subject to change and may be re-quoted at the time your booking is confirmed). In all other cases, prices are subject to availability and can be withdrawn or changed without notice. Price changes may occur by reason of matters outside our control which increase the cost of the product or service. Such factors include adverse currency fluctuations, fuel surcharges, taxes and airfare increases. Please contact us for up to date prices.

For travel to Australia, Canada or the United States  please be advised that there are compulsory pre-registration requirements for visa waiver programs. If you have registered before, please check your registration is valid and has not lapsed. Please note, you may not meet the eligibility requirements and may be required to obtain a visa.

Travel insurance

For all travel we strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. It is your responsibility to ensure you have valid travel insurance that covers and is appropriate for your needs. We will not be liable for any loss you incur if and insofar as you are able to claim for damages under a travel insurance policy. We can arrange travel insurance for you or provide you with a quote or general information about the travel insurance options available to you.

The Ministry of Foreign Affairs may have issued information about your travel destination. We strongly advise you go to  https://www.regjeringen.no/no/tema/utenrikssaker/reiseinformasjon/id2413163/   to find out more about your destination prior to the commencement of travel. 

You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country or invalidate your travel insurance cover. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel. We would be happy to provide you details of travel clinics on request.

When you make a booking with us, you acknowledge and agree that we will be acting as an agent only for the relevant transport, accommodation or other travel service provider. Our obligation to you is to (and you expressly authorise us to) make travel bookings on your behalf and to arrange relevant contracts between you and travel service providers. The travel service provider, and not Flight Centre Travel Group (Europe) AB, will be responsible to you for the provision of the relevant travel service. Any services we provide to you are collateral to our agency relationship with the travel service provider and are separate to the actual provision of the travel services. Your legal recourse for travel services is against the specific travel service provider and, except to the extent a problem is caused by fault on our part, not against us. Specifically, if for any reason any travel service provider is unable to provide the travel services for which you have contracted, your remedy lies against the travel service provider and not with us.

We exercise care in the selection of reputable travel service providers but we are not ourselves a provider of travel services and have no control over, or liability for, the services provided by third parties. We are responsible to ensure that we process your booking with reasonable skill and care and, accordingly, our liability to you (except for fraud, or death or personal injury caused by our negligence) will be limited to supplying the relevant service again or paying the cost of having the relevant service supplied again. Our liability will also be limited to the extent that any relevant international conventions, for example the Montreal Convention in respect of travel by air, the Athens Convention in respect of travel by sea, the Berne Convention in respect of travel by rail and the Paris Convention in respect of the provision of accommodation, limit the amount of compensation which can be claimed for death, injury, or delay to passengers and loss, damage and delay to luggage.

In no event do we accept any liability in contract, tort or otherwise, for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. We also do not accept any liability in contract, tort or otherwise, for consequential loss (meaning indirect loss, loss of revenue, loss of reputation, loss of profits, loss of actual or anticipated savings, lost opportunities, including opportunities to enter into arrangements with third parties or loss or damage in connection with claims against you by third parties) howsoever caused in connection with your booking.

Special requirements

Please speak to us about any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or access. Please understand that travel service providers may not be able to accommodate every request.

Loyalty programs

Your travelers may provide membership details for loyalty programs at time of booking or add them to their profile. Please encourage your travelers to check their loyalty program for the specific terms of their membership. We cannot guarantee that the travel service provider will credit them with points for their booking. Any loyalty program discrepancies in relation to their booking must be communicated to us within six months of their flight departure date.

Travel documents

Travel documents include airline tickets, hotel vouchers, rental car vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a travel service provider. Travel documents may be subject to certain conditions and/or restrictions including (without limitation) being non-refundable, non-date-changeable, non-transferable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking or on the travel documents may result in an inability to travel on that booking and the booking being cancelled. Please review your travel documentation carefully and advise us immediately of any errors in names, dates and timings. You must ensure you have all your travel documents and e-tickets prior to travel. Please let us know if you believe you have not received any required documentation.

A flight described on your travel documents and/or itinerary as “direct” will not necessarily be non-stop. All departure/arrival times are provided by the airlines concerned and are estimates only. They may change due to air traffic control restrictions, weather conditions and operational requirements.

Data protection

To protect your employees’ personal data we maintain appropriate technical and organisational measures as set out in the Flight Centre Travel Group (“FCTG”) Data Processing Addendum, available at https://www.fcmtravel.com/en-no/trust-and-compliance. The parties agree that the terms of the FCTG Data Processing Addendum are incorporated by reference into this Agreement and form part of this Agreement as though set out herein.

Services provided under this Agreement (including booking services and all ancillary services such as booking platform access, payment processing, traveller tracking and reporting) shall be considered an instruction to process personal data. You may provide instructions to us over the phone, by email or through one of our booking platforms.

We will also provide an option for select individuals within your organisation to receive the latest travel news, alerts and offers. Recipients may opt-out at any time.

Money not held on trust

All money paid by you to us will be our property and will be a debt due and payable to the travel service provider, if not paid directly to the travel service provider. You agree and acknowledge that such money will not be held by us on trust for and on behalf of you and we may hold such money in any account as we see fit, including with our own and/or our other clients’ money.

Anti-bribery and corruption

Each party shall comply, and shall ensure that each of its employees, officers, directors, contractors and agents complies with all applicable laws, regulations, codes and sanctions, including but not limited to anti-bribery and corruption, foreign corrupt practices, anti-terrorism and anti-slavery laws. Neither party shall engage in any course of conduct that would cause the other party to be in violation of the laws of any jurisdiction, including, without limitation, the laws, regulations, codes and sanctions referred to in this clause. Each party shall ensure that it has in place and maintains policies and procedures adequate to prevent bribery and corruption, foreign corrupt practices, terrorism, slavery and human trafficking and to ensure compliance with the applicable laws, regulations, codes and sanctions referred to in this clause. Each party shall, and shall ensure that each of its employees, officers, directors, contractors and agents shall uphold the highest standards of business ethics and conduct, and undertake not to give or receive any advantage that could be perceived as payment or receipt of a bribe, not to make facilitation payments, not to bribe a foreign public official, and not to engage in slavery or human trafficking.

Final provisions

Each time a material change is made to this Agreement by us we will provide a copy of the updated Agreement to you. It is your obligation to check the updated Agreement. If you continue to receive services from us then you agree that you are deemed to have accepted the updated Agreement.

If any dispute arises in relation to this Agreement, the laws of Norway will apply. The rules on conflicts of law shall be excluded. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Norway and waive any right that you may have to object to an action being brought in those courts. Any provision (or part of any provision) of this Agreement which is invalid in any jurisdiction is invalid in that jurisdiction to that extent, without invalidating or affecting the remaining provisions (or part provision) or the validity of that provision in any other jurisdiction.

EU Community List

We bring to your attention the existence of a 'Community List', which contains details of air carriers that are subject to an operating ban within the EU. The Community List is available for inspection at  ec.europa.eu/transport/modes/air/safety/air-ban/index_en.htm .

Booking Agreement Terms and Conditions

At The Keys to Travel, LLC,(hereinafter “Keys to Travel”, “we”, “us”, “our”) we believe that traveling strengthens relationships.  Whether you are looking for a couple’s retreat, honeymoon, family, or group travel to bond with others, we believe travel is transformative in relationships. For us, no detail is too small as we plan travel with your specific needs in mind. We are excited to serve our clients (hereinafter “traveler”, “you”) and provide you the personal touch that only comes with working with an expert.

CONTRACT. Below are the Terms and Conditions of travel. These Terms and Conditions including all brochures, documents, correspondence, and the terms and conditions of our suppliers form the basis of the contract with you.  Before making a booking with us you must ensure that you have read and understood these Terms and Conditions. We also ask that you address any questions you may have with us prior to booking. Please be aware that these terms and conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your booking you are accepting all the Terms and Conditions laid out below and acknowledging that you have read the Terms of this Contract and agree with it.  

If you are making a booking as a group, the leader of the group is responsible for sharing these Terms and Conditions with all members of the group and is financially responsible for the booking.  We will not be liable for a group leader’s failure to share these Terms and Conditions with all travelers in their group.

You represent and warrant that (a) you are of sufficient age to use our services and website and can create binding legal obligations in connection with your use, (b) you are legally authorized to act on behalf of those you represent and accept these terms and conditions on their behalf, and (c) the information supplied by you, or members of your group is true and correct.

VIOLATIONS BY YOU. You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel related product or service.

CHANGES TO THESE TERMS AND CONDITIONS. Keys to Travel reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Upon making changes, we will notify you via the email address you provide to us at booking. The current terms will apply to your booking.  You must therefore be familiar with the terms in effect at the time you book.  Your continued use of our services including continuing to use or maintain any bookings after notice of any changes to the terms and conditions constitutes your consent to the changes.

COVID 19 RELEASE OF LIABILITY. By booking a tour at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your tour. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, which cannot be controlled or eliminated by Keys to Travel.

You acknowledge that due to the uncertainty of travel at this time, your tour may be postponed or cancelled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of negative testing. Stopover countries requirements will also apply.  On your return home, additional testing, requirements, or documentation may be required.  You are responsible for understanding these requirements and must not rely on Keys to Travel to provide these details. You understand that you may become sick before, during, or after the tour and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable. 

You agree that due to uncertainty caused by COVID-19, Keys to Travel has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Keys to Travel shall not be liable to any losses howsoever arising.  Keys to Travel shall not be liable should your chosen travel protection fail to provide coverage for COVID-19  related injuries.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS The Keys to Travel LLC, its members, officers, agents, and/or employees, and suppliers (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part  to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

SCOPE/AGENCY. The Keys to Travel, LLC does not provide, own, or control the travel services and products that are provided as part of your trip, such as flights, accommodations, rental cars, packages, or travel insurance (the “Travel Products”). The Travel Products are owned, controlled, or made available by vetted third parties (the “Suppliers”) such as airlines, hotels, and tour operators. The Suppliers are responsible for the Travel Products. The Supplier’s terms and privacy policies apply to your booking so you must agree to and understand those terms. Your interaction with any Supplier is at your own risk; Keys to Travel does not bear any responsibility should anything go wrong with your booking or during your travel. Hence, as the traveler, you agree that Keys to Travel acts only as agent for the traveler in acquiring transportation, hotel accommodations, sightseeing and other privileges, or services for the travelers’ benefit, and on the express condition that Keys to Travel shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

BOOKING/PAYMENT.   If you are wondering how to get started, simply go the Services page on our website, find the travel that is right for you and click the “”Book” button. You will then provide some information about yourself and your wants and needs and submit the form to us.  We will then arrange a consultation to discuss your next trip.  If you decide that Keys to Travel is the right fit for planning the next trip of your dreams, you will pay our planning fee and enter into a client agreement with us.  As you probably know from planning trips in the past, travel planning takes time and effort.  Along with saving you that time we also bring our expertise to the table.  Our planning fee for your trip is based on those factors and is non-refundable even if you cancel your trip or decide not to book.  If you cancel and rebook a new planning fee will be due.

After we receive the planning fee, we will go to work for you planning a trip tailored specifically to you.  We will then present you with a custom itinerary and spend time with you making any changes to perfect it.  When you accept the itinerary, we will advise you of any deposits due and book your travel.  

After booking you will receive your final itinerary with an invoice with payment information and other important travel information.  This invoice is subject to change until you receive confirmation that your travel is booked.  Deposits are typically NON-REFUNDABLE, unless stated otherwise in the terms and conditions of the Supplier.  After issuance of the final itinerary, any requested changes will incur a fee of $50 per change plus any charges incurred with our suppliers.

Bookings may not include airfare and you must not make any air reservation until you receive confirmation of your booking.  Your contract for airfare is with the carrier and subject to its terms and we will not be liable for any change fees or cancellation fees or other additional cost you incur with the air carrier.

Upon booking, we will provide you with instructions of payments and all due dates.  You must make all payments in full and on time.  If you are booking within 60 days of the departure date, full payment will be due at the time of booking confirmation. If full payment is not received by the due date on your invoice, we reserve the right to cancel your travel and apply the cancellation charges set out in the cancellation section below. Failure to make a payment may result in the cancellation of your travel.  In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect.

Please review all documents carefully and promptly as we will not be responsible for any errors. It is your responsibility to review all travel documentation and alert us as soon as possible with any corrections. 

TRAVELER INFORMATION. While we DO NOT always assist with airfare, please note that names provided to secure reservations must match travelers’ passport. Middle names are not required to appear on airline tickets. Date of birth and complete passport details are required. Any minor name corrections advised after airline tickets have been issued will incur fees. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. Travelers voluntarily assume full and sole responsibility for any and all risks and/or costs involved with failure to report any errors and/or omissions to documentation.

CREDIT CARD BOOKINGS. While we do accept major credit cards including Visa, Mastercard, American Express and Discover, travelers must provide to us a click authorization for every transaction for your trip. Your authorization is an agreement for us to charge your card and an acknowledgement and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks. 

In certain cases, you can dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Keys to Travel retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.
  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Keys to Travel or the Supplier.
  • Chargebacks resulting because you do not agree with the cancellation policy.

PRICE AND RATE CHANGES.  The price of your itinerary will be based on known costs at the date of issue of the itinerary.  All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices from time to time.   Prices include a cost for fuel and local taxes that are estimated at the date of this publication.  At the time of booking confirmation, we will provide you with an invoice reflecting the current price and particular inclusions. 

We reserve the right to add a supplement to your travel prices should our costs of supplying your travel increase, until we receive your final payment.  Any increase to your travel price will be as the result of changes in our costs of supplying your travel resulting from transportation charges, (fuel, airport charges, scheduled air fares and other transport charges which form part of our contract with the transport provider), dues or taxes payable locally, currency fluctuations and government action, any other airline surcharges, taxes, or fees payable for services. If our costs to supply your travel increase, we reserve the right to increase the price of your travel and will forward a new Invoice reflecting any changes made. After final payment your price is locked in.

We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed.  We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.

CANCELLATION. Cancellation of travel must be made in writing and is effective from the date we receive the written notification.  Our planning fee is always non-refundable.  Keys to Travel incurs costs with the suppliers of your trip well in advance of your departure date. All suppliers have their own cancellation policies, which apply to your booking.  Upon receipt of your cancellation request we will contact the suppliers for any applicable refunds subject to the supplier’s terms and conditions.  If you are entitled to a refund, please note that the supplier is responsible for this refund, not Keys to Travel. Suppliers may choose to provide a travel voucher or credit in lieu of refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency. 

If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage.

Airline tickets are governed by the air carriers’ terms, and we are not responsible for any air carrier’s decision regarding refund.

CHANGES AND CANCELLATION BY THE SUPPLIER. We will inform you as soon as reasonably possible if a supplier needs to make a significant change to your confirmed booking or to cancel. We will also liaise between you and the supplier in relation to any alternative arrangements offered by the supplier, but we will have no further liability to you. 

If between planning time and/or during actual travel, circumstances require changes, Keys to Travel and its suppliers, reserve the right to cancel or vary any itinerary and substitute components of any tour, including but not limited to hotels and accommodations of comparable quality, if air schedule or surface transportation charges, security matters, and/or other events make such alterations necessary. Suppliers may substitute transportation equipment depending on any variety of factors, including the volume of passengers on a tour. During local or national holidays or special events, peak seasons, on certain days of the week, and during religious occasions, certain facilities such as museums, churches, restaurants, sightseeing tours, hotels, and shopping may be limited or not available. Alternatives will be offered whenever possible. Keys to Travel cannot be held responsible for any closures, necessary itinerary changes, or curtails for any reason. These changes will not be considered material changes and will not be consider cause for cancellation by the traveler. Normal cancellation penalties still apply to the tour that has been changed.

NO REFUND FOR UNUSED ARRANGEMENTS.   As Keys to Travel’s prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while your trip is in progress, there is no refund for the unused portion.

FORCE MAJEURE. Keys to Travel assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Keys to Travel that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if we can recover any monies from our suppliers, we will refund these to you. Our planning fee is always non-refundable.

NON-OPERATION OF GROUP TOURS. All group tours are based on a minimum number of participants.  Keys to Travel makes every effort to ensure that tours meet their minimum requirements.  However, if the tour drops below the minimum number of participants cancellation of the tour may occur at the sole discretion of Keys to Travel.  In such case, guests will be advised at least 45 days prior to departure.  Keys to Travel reserves the right to change the departure date. We may offer alternative tour dates or other travel arrangements.  You may choose to accept these arrangements or to cancel your booking, in which case a full refund will be provided.  Any air cancellation will be in accordance with the terms of the carrier and Keys to Travel will not be liable for the carrier’s refusal to make any refund whatsoever.  In such case Keys to Travel will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance or any other purchases made by the guest in anticipation of the tour.

TRAVEL PROTECTION. It is the traveler’s responsibility to protect their purchases. For this reason, Travel Protection Coverage including additional cancel for any reason coverage is strongly recommended. Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase.

Keys to Travel is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Keys to Travel cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker. 

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Keys to Travel cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.   

DESTINATIONS AND DOCUMENTATION.  Travel to certain destinations may involve greater risk than others. Keys to Travel urges Travelers to remain informed daily as to current news, as well as to review travel prohibitions, warnings, announcements, and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to destinations can be found at http://www.state.gov , and http://www.cdc.gov . In addition, you should consult with government websites to ensure that you are following all requirements for admittance into that country, including COVID- 19 requirements, as well as understanding local laws that govern travel within a country, such as medical tests and tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, Keys to Travel will not be liable for damages or losses that result from travel to such destinations. 

It is the responsibility of each traveler to obtain and carry a valid passport, visa(s), inoculations, vaccinations, and all other documents required by applicable government regulations. For up-to-date requirements US citizens should visit www.travel.state.gov. When travelling domestically within the USA or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight, found here: http://www.tsa.gov/traveler-information/acceptable-ids . Keys to Travel strongly recommends that you consider that certain countries will not admit a passenger if their passport expires within six (6) months of the date of entry. Non-USA citizens may require additional documentation. Children and infants also require all such travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities. 

Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries.  If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. We feel it is an invasion of privacy for any member of our staff to make such an inquiry.  It remains the traveler’s responsibility to make relevant inquiries and meet any requirements for travel.

Recommended inoculations and vaccinations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/ . 

You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing traveler to miss flight(s), and subsequent scheduled travel bookings tours.  Keys to Travel bears no responsibility for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

INSECTICIDE NOTICE.   Travelers are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s Web site, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements .

NON-RESPONSIBILITY.   The Keys to Travel LLC, and its employees, shareholders, agents, and representatives use third party suppliers to arrange tours, transportation, sightseeing, lodging, and all other services related to this tour. Keys to Travel is an independent contractor and is not an employee, agent, or representative of any of these suppliers. Keys to Travel does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. All suppliers are independent contractors and are not agents or employees or representatives of Keys to Travel. All tickets, receipts, coupons, and vouchers are issued subject to the terms and conditions specified by each supplier, and by accepting the coupons, vouchers, and tickets, or utilizing the services, all travelers agree that neither Keys to Travel, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any tour traveler or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Keys to Travel. Keys to Travel assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any traveler that may result from any act or omission on the part of others; Keys to Travel assumes no responsibility or liability for personal property; and Keys to Travel shall be relieved of any obligations under these terms and conditions in the event of any strike, labor dispute, act of God, or of government, fire, war, whether declared or not, terrorism, insurrection, riot, theft, pilferage, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, delay, or cancellation. Keys to Travel accepts no responsibility for lost or stolen items. Keys to Travel reserves the right to refuse any traveler or potential traveler at its sole discretion.

ASSUMPTION OF RISK/WAIVER.  Traveler is aware that travel such area as traveler is undertaking on the trip may involve inherent risks, some in remote areas of the world. Inherent risks include, but are not limited to, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including tour guides, other travelers, Keys to Travel and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in remote places where there are no available medical services; fatigue, chill, overheating, and/or dizziness,; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Traveler understands the description of these risks is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of this trip, traveler is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Traveler hereby accepts and assumes full responsibility for any and all risks of illness, injury or death and of the negligence of Keys to Travel and agrees to and shall hold harmless and fully release The Keys to Travel, LLC its owners, members, agents, and assigns (together Keys to Travel) from any and all claims associated with the trip, including any claims of third party negligence and/or the negligence of Keys to Travel and traveler hereby covenant not to sue Keys to Travel for any such claims or join any lawsuit or action that is suing Keys to Travel. This agreement also binds your heirs, legal representatives, and assigns.  The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

INDEMNIFICATION. Each traveler is expected to act responsibly and adhere to all behavior guidelines established by Keys to Travel and our local suppliers. Our local suppliers reserve the right to remove you from any trip if you endanger yourself or others or disrupt others. In any such case, there will be no refund.

Traveler agrees to and shall indemnify and hold harmless The Keys to Travel LLC, and each of our officers, directors, employees and agents (collectively “Keys to Travel”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Keys to Travel (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) traveler’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by traveler while participating in the trip.

BAGGAGE FEES . Due to continual changes in airline baggage policies, it is suggested that you inquire with your airline’s website for up-to-date fees and information. Keys to Travel is NOT responsible for additional fees incurred for baggage or seating. 

RE-CONFIRM YOUR FLIGHT. Keys to Travel advises you personally to re-confirm your flight schedule within 24 hours prior to departure directly with the airline in case of any last-minute changes or delays. Most airlines allow you to check in online 24 hours prior to departure.

PRE-EXISTING MEDICAL CONDITIONS/PERSONS WITH DISABILITIES. Keys to Travel is a certified autism travel professional. Please ask us how we can assist you craft a vacation for your family member with special needs. 

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your tour, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in finding the perfect vacation for you and your family. Keys to Travel will communicate requests to Suppliers, but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the traveler requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility.

Our Suppliers are, unfortunately, unable to offer additional assistance to travelers with limited mobility and all such assistance will need to be provided by whoever the traveler is traveling with. Travelers with disabilities must notify Keys to Travel at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. GOVERNING LAW/SUBMISSION TO JURISDICTION/ CLASS ACTION WAIVER/ DAMAGES/NOTICE OF CLAIM. This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Colorado exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Adams County, Colorado. You agree that you will only bring claims against Keys to Travel in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. Keys to Travel shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Keys to Travel unless you have first provided a typewritten notice of claim to Keys to Travel within 30 days after the trip or cancellation of the trip. ENTIRE AGREEMENT & SEVERABILITY . This agreement, including the terms and conditions of our suppliers, any other documents, including invoices, we provide you, constitutes the entire agreement and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Keys to Travel. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

History of Khabarovsk Krai

In the Middle Ages, the territory of today’s Khabarovsk Krai was inhabited mainly by the peoples of the Tungus-Manchu language group, as well as Nivkhs. In China they were known collectively as “wild Jurchen”. In the 13th-14th centuries, the Mongol rulers of China repeatedly organized expeditions to the lower Amur.

Russians began the development of the Far East in the 17th century. In 1639, a Cossack troop headed by Ivan Moskvitin reached the coast of the Sea of Okhotsk. The first stockade town was built in the mouth of the Ulya River. Later, Vasily Danilovich Poyarkov and Yerofei Pavlovich Khabarov were the first who started joining the Amur lands to Russia. Before Russians came here, the tribes of Daurs, Evenks, Natks, Gilyaks and others lived in this area (only about 30 thousand people).

The area was quickly populated by Russian settlers; new stockade towns were founded. But the process was interrupted due to a conflict with the Qing Dynasty. From the 1680s, Manchus started to fight against the Russian state.

Russia could not move significant military forces to the Amur region and had to sign the Treaty of Nerchinsk (1689). According to it, Russians had to leave the left bank of the Amur River but managed to uphold its rights for the area behind Lake Baikal and the Sea of Okhotsk coast.

In the 18th century, Okhotsk became the main Pacific port of the Russian Empire. Development of the northern coast of the Pacific, exploration of the Kuril Islands and Sakhalin prepared the basis for the return of the Amur region.

In 1847, Nikolai Nikolayevich Muravyov was appointed a governor-general of Eastern Siberia. He did his best to return the Amur area to the Russian Empire. The number of Russians in the region began to grow. In 1858, the town of Khabarovsk was founded.

As a result of the weakening of China during the Opium Wars, two agreements were signed - the Aigun Treaty in 1858 and the Beijing Treaty in 1860. The Russian-Chinese border was established on the Amur and Ussuri rivers.

In 1884, Zabaikalskaya, Amurskaya and Primorskaya regions were united into Priamurskoye region with the center in Khabarovsk. Until the late 19th century, the Amur area was settled slowly. The situation changed in the early 20th century. In 1900, the Trans-Baikal Railway was opened, in 1902 - the Chinese Eastern Railway.

As a result, the number of settlers grew rapidly. In 1900-1913, about 300,000 peasants from other regions of the Russian Empire came to the Amur area. There were three towns (Khabarovsk, Nikolayevsk-on-Amur and Okhotsk) on the territory, which makes Khabarovsk krai today. By 1915, there were more than six thousand settlements with a total population of 316,300 people in Primorskaya oblast.

The Civil War lead to a great number of deaths and economic collapse in Russia. The restoration of pre-war level of economy was achieved by 1926. New cities were built in the region - Komsomolsk-on-Amur, Birobidzhan. October 20, 1938, Dalnevostochny region was divided into Khabarovsky and Primorsky regions.

In 1947-1948, Sakhalin and Amur regions were separated from Dalnevostochny region. In 1953, Magadan region was formed and separated from Dalnevostochny region. In 1956, Kamchatka region became independent too. In 1991, the Jewish autonomous region was separated from Dalnevostochny region.

Khabarovsk Krai - Features

Khabarovsk Krai is one of the largest administrative-territorial units of the Russian Federation. The territory of the region stretches for about 1,800 kilometers from north to south, and for 125-750 km from west to east. The distance from Khabarovsk to Moscow is 8,533 km by rail, 8,385 by roads and 6,075 km by air.

Part of the southern boundary of the Khabarovsk region is the state border of Russia with China. The province is washed by the Sea of Okhotsk and the Sea of Japan. The coastline extension is 3,390 km, including islands, the largest of them are Shantarsky Islands. The highest point is Berill Mountain (2,933 meters).

The climate of the region changes from north to south. Winters are long and snowy. The average temperature in January is in the range of minus 22-40 degrees Celsius, on the coast - minus 18-24 degrees Celsius. Summers are hot and humid. The average temperature in July is about plus 15-20 degrees Celsius.

In general, Khabarovsk Krai is one of the most sparsely populated regions of Russia, which is due, firstly, the general economic decline of the post-Soviet time, and secondly - the severity of the local climate, comparable with the regions of the Far North.

The largest cities and towns are Khabarovsk (613,500), Komsomolsk-on-Amur (239,400) Amursk (38,200), Sovetskaya Gavan (22,900), Nikolaevsk-on-Amur (17,400), Bikin (15,900).

Khabarovsk Krai - Economy and Transport

The main branches of the local economy are mechanical engineering and metalworking, ferrous metallurgy, mining, fishing, food, light and timber industries. The mineral resources of the region include gold, tin, aluminum, iron, coal and lignite, graphite.

The main highways of Khabarovsk Krai are M60 “Ussuri” (Khabarovsk - Ussuriysk - Vladivostok) and M58 “Amur” (Chita - Never - Svobodny - Arkhara - Birobidzhan - Khabarovsk). The railway station “Khabarovsk-2” is a large railway hub. The directions are as follows: to the south (to Vladivostok and Port Vostochny), to the west (to Moscow) and to the north (to Komsomolsk-on-Amur).

The river port in Khabarovsk is the largest on the Amur River. The other river ports of the region are located in Komsomolsk and Nikolayevsk. The sea ports of the region are Okhotsk, Ayan, Nikolayevsk-on-Amur, Vanino, Sovetskaya Gavan.

Tourism in Khabarovsk Krai

The rich natural potential of the region provides endless opportunities for the development of ecological tourism. You can see reindeer, brown and Himalayan bears, bighorn sheep and even the Siberian tigers on the territory of Khabarovsk krai.

The Amur River is the main attraction of the region. Most of natural, cultural and historical tourist sites are concentrated in the valley of this river.

Shantarsky Islands, one of the most beautiful and unique places of unspoiled nature, are another natural attraction of this region. The inaccessibility of the islands allowed to preserve pristine nature. Shantarsky Islands are a habitat of whales, seals, killer whales. It is a great place for fishing.

If you prefer ethnographic tourism, you may be interested in cave paintings located near the Nanai village of Sikachi-Alyan and Lake Bolon, which is a large bird sanctuary. In the past, there were a Buddhist temple and ancient settlements in the vicinity of the lake.

Lovers of adventure tourism may be interested in rafting, fishing tours, caving and winter recreation.

The best time for tourism in Khabarovsk krai: “late spring - early summer”, “end of summer - early fall.”

The largest international airport in the region is located in Khabarovsk. The flights to Moscow, Vladivostok, Yuzhno-Sakhalinsk, Novosibirsk, Yakutsk, Krasnoyarsk, Irkutsk, Bangkok, Seoul, Harbin are available.
