OCI Cardholders

Do you hold an oci card.

While your passport is the primary travel document, an Overseas Citizen of India (OCI) card is more like a lifelong visa. Since the OCI cardholders are not considered Indian citizens, they must have a valid passport during their stay in the country.

What you need to keep in mind

• The government of India has done away with the 'U' visa sticker on the passports of OCI cardholders. Immigration authorities shall not insist on producing foreign passports containing the 'U' visa sticker from OCI cardholders entering or exiting India. They will be given immigration clearance based on their valid foreign passport and OCI Registration Certificate (OCI booklet, also known as OCI card).
• In cases where the applicant appears different than on the OCI card owing to age, cardholders aged 20 years or younger must renew their card each time a new passport is issued and once after completing 50 years of age.
• For an OCI cardholder who is 21 to 49 years of age, re-issuance of OCI card registration is optional each time a new passport is issued. Applicants wishing to use this service can apply online under the OCI miscellaneous services.
• In case of a change in nationality of OCI cardholders, they can enter or exit India on the strength of their OCI card and a valid passport of the new nationality. This rule does not apply to Pakistani and Bangladeshi passports. The OCI cardholder must update the new nationality through miscellaneous services.

India has suspended visa service for Canadians. Here are your top questions answered

India's ministry of external affairs says it will review the situation on a regular basis'.

India's visa processing centre in Canada suspended services Thursday as a rift widened between the countries after Prime Minister Justin Trudeau said India may have been involved in the killing of a pro-Khalistan activist and president of Guru Nanak Sikh Gurdwara in British Columbia, Hardeep Singh Nijjar. 

So what does that mean for Canadians planning trips to India? Here's what we know so far:

Who does this affect? 

Canadian citizens who do not have a visa for India or were in the process of applying for one. 

What type of Indian visa can I apply for?

India's Ministry of External Affairs confirmed the decision to stop all categories of visas, including e-visas, for Canadian Citizens. If you're a Canadian national wondering whether you can apply for an Indian visa from a third country, like the U.S., you will be subjected to the same suspension of services.  

I've already got a plane ticket and I'm heading to the airport. Will my trip be affected?

If you have a valid visa or an Indian passport, you can travel. There is no travel restriction. The announcement is about suspension of visa services in Canada, which means Canadian nationals can't apply for visas or get them processed until the Government of India resumes visa services. 

NOTE: A visa does not guarantee you admission to a country. It permits one to present themselves at a port of entry to seek admission. 

Should I be worried for my Canadian family member in India right now? Can they return to Canada? 

If a Canadian national in India needs an extension of visa, they won't be able to receive one. But if they have a visa, they are allowed to stay in India or travel back and forth.

Canada has regional travel advisories for Indian states of Jammu and Kashmir, Punjab, Gujrat, and Rajasthan.

I'm planning to go back in November or December for a wedding. What does this mean for that trip?

A lot of people travel to India during those months, be it for holidays or for weddings. If you have a visa or an Indian passport you can travel.

The Ministry of External Affairs in India says it will "review the situation on a regular basis." You can find updates on India's visa processing platform, BLS International. CBC is also closely monitoring the situation. You can find updates on our website or CBC News app. 

Does this mean people in India won't be able to book trips to Canada?

Indian nationals with a valid visa to Canada are still allowed to travel to Canada. Canada is making staffing changes to its high commission and consulate in India, citing online threats to diplomats. It is too early to say what the situation will look like in the coming months, weeks or even days. 

Will this affect Indians applying for Canadian visas? What about incoming international students? 

So far, Canada has not suspended its visa services in India. 

The Indian government says it's asked for "parity" in staffing, pointing out that Canada has more diplomatic presence in India than India does in Canada. India has requested Canada's presence be reduced. 

The High Commission of Canada has said it is temporarily adjusting its staff presence at its commission and consulate locations in India, due to "some diplomats having received threats on various social media platforms."

In the coming days and weeks, this could mean delays in visa processing, or suspension of visa services. 

Can people who already possess visas still enter the country? 

Those in Canada who possess valid visas to India, or those who have overseas citizenship of India are free to travel to India. 

The personal impact of India's suspension of visa processing

I am an indian citizen. can i travel to india .

Yes. If you are an Indian national (passport holder), you don't require any visa to enter India. 

What if I applied for a visa before this announcement? 

Your visa application will not be processed until further notice from the Indian government. 

Do Canadians need a transit visa? 

If you don't need to leave the airport, you do not need a transit visa in India. However, if your trip requires a stay in India, you require a transit visa. Canadian nationals are unable to obtain a transit visa until the suspension of visa services is lifted. 

How long will this last? 

That's the million-dollar question. This is an evolving situation. The Indian government has said they are reviewing the situation on a regular basis. 

What if I have tickets booked and don't have a visa? 

In a statement to CBC News, Air Canada said, "We continue to operate our normal service to India of 19 flights a week. For customers who may be affected by new visa requirements we have put in place a flexible rebooking policy so they can change their flights with no change fee if they need more time to prepare."

We have a cruise booked for December and have applied for, but not received, our travel visa for India. Will we have to remain on board when we are in port or can we even board the ship if we don't get our visa?

No. Regardless of how you enter any country, by air, land, or water, you require a visa unless you're exempt from visa requirements for that country. In this case, you need a one year tourist visa. At the moment you won't be able to get one due to the visa suspension. 

I understand your trip is in December, I hope things change before that. 

But if I were you, I would have a backup plan. If the suspension isn't lifted, can you rebook, can you get a refund? Can you ask the cruise for a different destination?

I have a valid multiple-entry Indian visa. I went to India in February and need to go again in November. My visa expires on Dec. 20, 2023. Can I still use the visa to go to India in November if I return by Dec. 20th?

Yes. According to the Consulate General of India's website, you can travel with a passport on which visa is applied, it must have at least two blank pages and must have a validity of more than 190 days.  Passengers holding valid visas may be denied entry into India if the validity of their passports is less than 180 days at the time of entry into India.

You have to just make sure you leave before your visa expires, in your case it seems like it is valid till Dec 20th. 

Did the Indian government state when or if they are going to refund e-visa applications that are currently in processing?

Application fees for an Indian visa are non-refundable if you get rejected, or if service is denied. 

I am an Indian student in the process of applying for a Canadian visa for my winter 2024 intake at a Canadian university, should I be concerned about India asking Canada to remove diplomats?

 If Canada removes 41 out of its 62 diplomats in India by Oct. 10, it will affect their functioning and services in India. That could mean delays or suspension of visa services for Indian people applying for a Canadian visa.

I have a student visa and my tickets are booked. Can I still enter? 

Yes, there are no travel restrictions if you have a valid student, work, or tourist visa. Please check the travel advisories before you travel.

Mass gatherings (large-scale events)

Security situation

In the context of recent developments in Canada and in India, there are calls for protests and some negative sentiment towards Canada in traditional media and on social media. Demonstrations, including anti-Canada protests, could occur and Canadians may be subjected to intimidation or harassment. In Delhi and the National Capital Region, you should keep a low profile with strangers, and not share your personal information with them. Avoid crowded areas, including public transportation. You should always travel with someone and inform a friend or a family member of your travel plans.

Consular services in person are temporarily unavailable in and around Bengaluru, Chandigarh and Mumbai. Consular services in person at the High Commission of Canada in New Delhi will remain available.

Union Territory of Jammu and Kashmir

The security situation in the Union Territory of Jammu and Kashmir is tense. There are high risks of violent protests, civil unrest and acts of terrorism and militancy.

Violent clashes between militants and security forces occur regularly. Terrorist attacks against security forces have led to civilian casualties. Further attacks could take place at any time. You could find yourself in the wrong place at the wrong time.

The Indian army has enhanced powers in this territory. Authorities may impose curfews and security restrictions on short notice.

• Avoid gatherings and demonstrations
• Always carry ID
• Expect a heightened security presence and security checks

Border areas with Pakistan

The level of tension between India and Pakistan may change suddenly. You could experience difficulties when travelling between the two countries. You may be subject to scrutiny if officials from either country become aware that you have recently travelled to the other.

The security situation along the border with Pakistan, especially along the Line of Control (LoC), which separates the Union territories of Jammu and Kashmir and Ladakh from Pakistan-administered Kashmir, remains volatile. Cross-border gunfire and shelling are occurring sporadically along the LoC. The presence of landmines and unexploded ordnance also constitute a risk.

Although international travellers regularly use the Wagah border crossing linking Amritsar, India, to Lahore, Pakistan, it remains vulnerable to attack. Security measures are in place. You may experience long delays.

Parts of Northeastern India

Several extremist and insurgent groups are active in the northeastern states of Assam and Manipur. They regularly target local government and security forces and may use various criminal activities to finance their activities.

Ethnic tensions in the State can also lead to conflict and civil unrest.

There is a threat of terrorism in India, particularly in:

• the Union territory of Jammu and Kashmir
• the State of Manipur
• the State of Assam
• areas of East India where Naxalites groups are active

Maoist extremist insurgents, known as Naxalites, are responsible for the majority of terrorist attacks in India. These groups are usually based in rural and forested areas within zones of concerns, as defined by the Government of India, which include:

• Andhra Pradesh
• Chhattisgarh
• Madhya Pradesh
• Maharashtra
• Uttar Pradesh
• West Bengal

Extremist and insurgent groups usually target government and security forces, and sometimes, trains and railway tracks. While tourists are not usually specifically targeted, bystanders could be affected. Be particularly vigilant during election periods and in the lead-up to, and during, religious holidays and times of national significance, such as:

• Republic Day (January 26)
• Independence Day (August 15)

Targets of terrorist attacks could include:

• government buildings, including schools
• places of worship
• airports and other transportation hubs and networks
• public areas such as tourist attractions, restaurants, bars, coffee shops, shopping centres, markets, hotels and other sites frequented by foreigners

While in India:

• always be aware of your surroundings when in public places
• if you see a suspicious package, immediately leave the area and report it to authorities

Petty crime, such as pickpocketing and purse snatching, is common. Criminals may target foreigners, especially in major cities and tourist areas.

• Be vigilant in all crowded locations
• Don’t carry large sums of money
• Ensure that your personal belongings, including your passport and other travel documents, are secure at all times

Petty crime frequently occurs on public transportation and overnight trains.

• Ensure that the train compartment contains packages belonging only to you and other occupants
• Store personal belongings in a safe place, and don’t leave the compartment unattended
• Securely lock the doors

Serious crime against foreigners is less frequent, but incidents do occur.

Credit card and ATM fraud occurs. Be cautious when using debit or credit cards:

• pay careful attention when your cards are being handled by others
• use ATMs located in well-lit public areas or inside a bank or business
• avoid using card readers with an irregular or unusual feature
• cover the keypad with one hand when entering your PIN
• check for any unauthorized transactions on your account statements

Exercise caution in tourist areas and airports where scammers particularly target foreigners.

Scams involving the exportation of jewels, gemstones, carpets, and other items have occurred. Taxi drivers may approach you, offering money to export such items.

• Don’t accept any offer, no matter how convincing
• Beware of offers for cheap transportation or accommodation, extended taxi rides and unsolicited guided tours

Romance scams

If you’re travelling to India to meet someone you’ve otherwise only met online, you may be the victim of a scam.

Be alert to attempts at fraud by persons who profess friendship or romantic interest over the internet.

Investment scams

Unsolicited emails offering attractive business or financial opportunities are most likely fraudulent.

Don’t travel to India to obtain restitution after losing money to a scam.

Overseas fraud

Spiked food and drinks

Never leave food or drinks unattended or in the care of strangers. Be wary of accepting snacks, beverages, gum or cigarettes from new acquaintances. These items may contain drugs that could put you at risk of sexual assault and robbery.

Women’s safety

Crimes committed against women frequently occur in India. Foreign women are often the target of unwanted attention.

Staring, verbal abuse, groping, and other forms of sexual harassment can occur anywhere, including in tourist sites and areas. Attackers sometimes act as a group.

Reports of rape and assault against foreign women have increased. You should be particularly vigilant:

• on all forms of public transportation
• at Yoga centres, ashrams and other places of spiritual retreats

Local authorities may not always respond adequately to reports of sexual violence and harassment.

• Avoid travelling alone, particularly at night
• Be extremely vigilant on public transportation, taxis and auto-rickshaws
• Be careful when dealing with strangers or new acquaintances
• Be wary of accepting snacks or beverages from new acquaintances
• Avoid less populous and unlit areas
• Respect local customs and dress codes
• Reach police immediately if you feel threatened

If you are the victim of a sexual assault, you should report it immediately to local authorities and the nearest office of the Government of Canada.

Advice for women travellers

Forced marriages

Forced marriage affecting foreigners occurs, sometimes without the affected person’s prior knowledge or consent.

Some Canadians have been forced into marital arrangements and have been detained against their will. They have been subjected to threats, intimidation and violence by family members.

If you’re in Canada

If you’re in Canada and you believe that you’re being forced to travel overseas to marry, you should call your local police for assistance.

If you’re in India

If you’re in India and you believe that you’re being forced to marry, contact the nearest office of the Government of Canada. You may also contact the Emergency Watch and Response Centre .

Family members may retain passports to prevent victims from returning to Canada. Keep digital or physical copies of your travel documents in a safe place.

General information and advice about forced marriage

Demonstrations and mass gatherings

Protests in manipur.

Violent demonstrations have been taking place in Manipur State since May 3, 2023, resulting in casualties. Protests have led to disruptions to traffic and public transportation. Curfews have been imposed in several districts and mobile and internet services may be limited.

If you are in Manipur:

• monitor local media for the most recent information
• follow the instructions of local authorities
• be prepared to modify your plans in case of disturbances
• expect enhanced security measures and an increased police presence

Demonstrations, mass gatherings, general strikes, “bandh” or “hartal,” take place frequently. Even peaceful demonstrations can turn violent at any time. They can also lead to disruptions to traffic and public transportation.

Stampedes have occurred during mass gatherings, including religious ceremonies, and resulted in deaths and injuries.

Local authorities may impose curfews and other restrictions on short notice.

Road safety

Road conditions and road safety are poor throughout the country. Most roads, including major highways, are poorly maintained. There is severe traffic congestion. Driving conditions may be hazardous during the rainy season, and some roads can become impassable.

Drivers don’t respect traffic laws. They are often aggressive or reckless. Driving can be hazardous due to the presence of livestock or wandering cows, including in urban areas.

Fatal road accidents are frequent. They can lead to mob anger and assault.

• Avoid travelling outside urban centres after dark
• Avoid driving or riding motorcycles in India, even if you are an experienced motorcyclist
• Be very careful when crossing the street, even at pedestrian crossings
• If involved in an accident, contact local authorities immediately

Public transportation

India has an extensive passenger train system. Rail accidents are common, mostly due to poor maintenance. Thefts are frequent on certain train lines.

If you use a taxi, get it from a reputable hotel, an official taxi stand, or a trusted ride-sharing app. At the airport, use officially marked taxis or pre-paid transport services.

• Negotiate fares in advance, or insist that the driver use the meter, as you may be overcharged
• Avoid travelling alone, especially at night
• Don’t share taxis with strangers

Maritime transportation

Maritime accidents occur regularly due to the overloading and poor maintenance of some vessels.

• Don’t board vessels that appear overloaded or unseaworthy
• Always wear a life jacket

Pirate attacks and armed robbery against ships occur in coastal waters. Mariners should take appropriate precautions.

Water activities

Coastal waters can be dangerous. Riptides are common. Several drownings occur each year.

Beaches are not usually supervised by lifeguards. Many beaches don’t display warnings of dangerous conditions.

• Seek local advice before swimming
• Avoid swimming if red flags are flown
• Avoid swimming during Monsoon season
• Always wear a life jacket if you use a boat or a small embarkation

Water safety abroad

No commercial mountain rescue services are operating above 3,000 metres.

If you intend on trekking:

• never do so alone and always hire an experienced guide from a reputable company
• buy travel insurance that includes helicopter rescue and medical evacuation
• ensure that your physical condition is good enough to meet the challenges of your activity
• ensure that you’re adequately equipped and well informed about weather and other conditions that may pose a hazard
• inform a family member or friend of your itinerary, including when you expect to be back to camp
• know the symptoms of acute altitude sickness, which can be fatal
• obtain detailed information on trekking routes or ski slopes before setting out and do not venture off marked trails or slopes

Wildlife viewing

Wildlife viewing may pose risks, particularly on foot or at close range. If you plan on visiting a wildlife area such as a tiger reserve:

• always maintain a safe distance when observing wildlife
• only exit a vehicle when a professional guide or warden says it’s safe to do so
• only use reputable and professional guides or tour operators
• closely follow park regulations and wardens’ advice

Large groups of monkeys are present in several parts of India, including some urban regions. Monkeys can get aggressive and rapidly overwhelm travellers in their search for food. They can also steal your belongings.

Be vigilant when in the presence of monkeys.

Information about foreign domestic airlines

Every country or territory decides who can enter or exit through its borders. The Government of Canada cannot intervene on your behalf if you do not meet your destination’s entry or exit requirements.

Entry requirements vary depending on the type of passport you use for travel.

Before you travel, check with your transportation company about passport requirements. Its rules on passport validity may be more stringent than the country’s entry rules.

Regular Canadian passport

Your passport must be valid for 6 months from your date of entry into India and must contain at least two blank pages for use by immigration officials.

Passport with “X” gender identifier

While the Government of Canada issues passports with an “X” gender identifier, it cannot guarantee your entry or transit through other countries. You might face entry restrictions in countries that do not recognize the “X” gender identifier. Before you leave, check with the closest foreign representative for your destination.

Latest information – Indian Visa Application Center in Canada

Ensure you apply for the proper type of visa for the specific purpose of your trip. If you are denied entry by immigration officials, you will be returned to your point of departure.

Canadian-Pakistani citizens are subject to different visa application and registration procedures.

You can only stay in India for up to 180 consecutive days on a tourist visa, even when its validity exceeds 180 days.

If you stay in India for more than 180 days, you must register within 14 days of arrival with the Foreigners Regional Registration Office (FRRO).

Penalties for overstaying

Strict penalties are enforced for overstaying. If you overstay, you could be subject to fines, detention and a future travel ban.

If you have overstayed your visa, you must request an exit visa from the Foreigners Regional Registration Office (FRRO). This process can be lengthy.

Other entry requirements

Customs officials may ask you to show them a return or onward ticket and proof of sufficient funds to cover your stay.

Dual citizenship

If you hold an Overseas Citizens of India (OCI) card, you must present it upon entry and exit.

You must present a boarding pass and a photo identification to access airport departure terminals and public areas.

Lost or stolen passport

If your passport is lost or stolen, an exit visa is required to leave India.

To obtain an exit visa, you must present the FRRO with:

• a police report
• two current passport-size photographs
• a letter providing details of the loss or theft from the High Commission of Canada to India in New Delhi or Consulate General of Canada in either Chandigarh or Mumbai

The FRRO will verify the entry details before issuing an exit visa. This process can take several days.

Restricted and Protected Areas

Special permits are required to visit certain parts of India designated as restricted or protected areas.

You may need to produce proof of polio vaccination if you are arriving in India from:

• Afghanistan
• the Democratic Republic of the Congo

Confirm this requirement with the nearest Indian diplomatic office before travelling.

Routine vaccines

Be sure that your  routine vaccinations , as per your province or territory , are up-to-date before travelling, regardless of your destination.

Some of these vaccinations include measles-mumps-rubella (MMR), diphtheria, tetanus, pertussis, polio, varicella (chickenpox), influenza and others.

Pre-travel vaccines and medications

You may be at risk for preventable diseases while travelling in this destination. Talk to a travel health professional about which medications or vaccines may be right for you, based on your destination and itinerary. 

Yellow fever   is a disease caused by a flavivirus from the bite of an infected mosquito.

Travellers get vaccinated either because it is required to enter a country or because it is recommended for their protection.

• There is no risk of yellow fever in this country.

About Yellow Fever

Yellow Fever Vaccination Centres in Canada * It is important to note that  country entry requirements  may not reflect your risk of yellow fever at your destination. It is recommended that you contact the nearest  diplomatic or consular office  of the destination(s) you will be visiting to verify any additional entry requirements.

There is a risk of hepatitis A in this destination. It is a disease of the liver. People can get hepatitis A if they ingest contaminated food or water, eat foods prepared by an infectious person, or if they have close physical contact (such as oral-anal sex) with an infectious person, although casual contact among people does not spread the virus.

Practise  safe food and water precautions and wash your hands often. Vaccination is recommended for all travellers to areas where hepatitis A is present.

Measles is a highly contagious viral disease. It can spread quickly from person to person by direct contact and through droplets in the air.

Anyone who is not protected against measles is at risk of being infected with it when travelling internationally.

Regardless of where you are going, talk to a health care professional before travelling to make sure you are fully protected against measles.

Japanese encephalitis is a viral infection that can cause swelling of the brain.  It is spread to humans through the bite of an infected mosquito. Risk is very low for most travellers. Travellers at relatively higher risk may want to consider vaccination for JE prior to travelling.

Travellers are at higher risk if they will be:

• travelling long term (e.g. more than 30 days)
• making multiple trips to endemic areas
• staying for extended periods in rural areas
• visiting an area suffering a JE outbreak
• engaging in activities involving high contact with mosquitos (e.g., entomologists)

  Hepatitis B is a risk in every destination. It is a viral liver disease that is easily transmitted from one person to another through exposure to blood and body fluids containing the hepatitis B virus.  Travellers who may be exposed to blood or other bodily fluids (e.g., through sexual contact, medical treatment, sharing needles, tattooing, acupuncture or occupational exposure) are at higher risk of getting hepatitis B.

Hepatitis B vaccination is recommended for all travellers. Prevent hepatitis B infection by practicing safe sex, only using new and sterile drug equipment, and only getting tattoos and piercings in settings that follow public health regulations and standards.

Coronavirus disease (COVID-19) is an infectious viral disease. It can spread from person to person by direct contact and through droplets in the air.

It is recommended that all eligible travellers complete a COVID-19 vaccine series along with any additional recommended doses in Canada before travelling. Evidence shows that vaccines are very effective at preventing severe illness, hospitalization and death from COVID-19. While vaccination provides better protection against serious illness, you may still be at risk of infection from the virus that causes COVID-19. Anyone who has not completed a vaccine series is at increased risk of being infected with the virus that causes COVID-19 and is at greater risk for severe disease when travelling internationally.

Before travelling, verify your destination’s COVID-19 vaccination entry/exit requirements. Regardless of where you are going, talk to a health care professional before travelling to make sure you are adequately protected against COVID-19.

 The best way to protect yourself from seasonal influenza (flu) is to get vaccinated every year. Get the flu shot at least 2 weeks before travelling.  

 The flu occurs worldwide. 

•  In the Northern Hemisphere, the flu season usually runs from November to   April.
•  In the Southern Hemisphere, the flu season usually runs between April and   October.
•  In the tropics, there is flu activity year round. 

The flu vaccine available in one hemisphere may only offer partial protection against the flu in the other hemisphere.

The flu virus spreads from person to person when they cough or sneeze or by touching objects and surfaces that have been contaminated with the virus. Clean your hands often and wear a mask if you have a fever or respiratory symptoms.

Typhoid is a bacterial infection spread by contaminated food or water. Travellers going to countries in South Asia should speak to a health care professional about getting vaccinated.

Malaria  is a serious and sometimes fatal disease that is caused by parasites spread through the bites of mosquitoes.   There is a risk of malaria in certain areas and/or during a certain time of year in this destination. 

Antimalarial medication may be recommended depending on your itinerary and the time of year you are travelling. Consult a health care professional or visit a travel health clinic before travelling to discuss your options. It is recommended to do this 6 weeks before travel, however, it is still a good idea any time before leaving.    Protect yourself from mosquito bites at all times:  • Cover your skin and use an approved insect repellent on uncovered skin.  • Exclude mosquitoes from your living area with screening and/or closed, well-sealed doors and windows. • Use insecticide-treated bed nets if mosquitoes cannot be excluded from your living area.  • Wear permethrin-treated clothing.    If you develop symptoms similar to malaria when you are travelling or up to a year after you return home, see a health care professional immediately. Tell them where you have been travelling or living. 

In this destination, rabies is carried by dogs and some wildlife, including bats. Rabies is a deadly disease that spreads to humans primarily through bites or scratches from an infected animal. While travelling, take precautions , including keeping your distance from animals (including free-roaming dogs), and closely supervising children.

If you are bitten or scratched by an animal while travelling, immediately wash the wound with soap and clean water and see a health care professional. Rabies treatment is often available in this destination. 

Before travel, discuss rabies vaccination with a health care professional. It may be recommended for travellers who are at high risk of exposure (e.g., occupational risk such as veterinarians and wildlife workers, children, adventure travellers and spelunkers, and others in close contact with animals). 

Safe food and water precautions

Many illnesses can be caused by eating food or drinking beverages contaminated by bacteria, parasites, toxins, or viruses, or by swimming or bathing in contaminated water.

• Avoid getting water into your eyes, mouth or nose when swimming or participating in activities in freshwater (streams, canals, lakes), particularly after flooding or heavy rain. Water may look clean but could still be polluted or contaminated.
• Avoid inhaling or swallowing water while bathing, showering, or swimming in pools or hot tubs. 

Cholera is a risk in parts of this country. Most travellers are at very low risk.

To protect against cholera, all travellers should practise safe food and water precautions .

Travellers at higher risk of getting cholera include those:

• visiting, working or living in areas with limited access to safe food, water and proper sanitation
• visiting areas where outbreaks are occurring

Vaccination may be recommended for high-risk travellers, and should be discussed with a health care professional.

Travellers' diarrhea is the most common illness affecting travellers. It is spread from eating or drinking contaminated food or water.

Risk of developing travellers' diarrhea increases when travelling in regions with poor standards of hygiene and sanitation. Practise safe food and water precautions.

The most important treatment for travellers' diarrhea is rehydration (drinking lots of fluids). Carry oral rehydration salts when travelling.

Typhoid   is a bacterial infection spread by contaminated food or water. Risk is higher among children, travellers going to rural areas, travellers visiting friends and relatives or those travelling for a long period of time.

Travellers visiting regions with a risk of typhoid, especially those exposed to places with poor sanitation, should speak to a health care professional about vaccination.  

Insect bite prevention

Many diseases are spread by the bites of infected insects such as mosquitoes, ticks, fleas or flies. When travelling to areas where infected insects may be present:

• Use insect repellent (bug spray) on exposed skin
• Cover up with light-coloured, loose clothes made of tightly woven materials such as nylon or polyester
• Minimize exposure to insects
• Use mosquito netting when sleeping outdoors or in buildings that are not fully enclosed

Find out what types of insects are present where you’re travelling, when they’re most active, and the symptoms of the diseases they spread.

There is a risk of chikungunya in this country.  The risk may vary between regions of a country.  Chikungunya is a virus spread through the bite of an infected mosquito. Chikungunya can cause a viral disease that typically causes fever and pain in the joints. In some cases, the joint pain can be severe and last for months or years.

Protect yourself from mosquito bites at all times. There is no vaccine available for chikungunya.

Crimean-Congo haemorrhagic fever is a viral disease that can cause fever, pain and bleeding under the skin.  In some cases, it can be fatal.  It spreads to humans through contact with infected animal blood or tissues, or from the bite of an infected tick.  Risk is generally low for most travellers.  Protect yourself from tick bites and avoid animals, particularly livestock.  There is no vaccine available for Crimean-Congo haemorrhagic fever.

Visceral  leishmaniasis   (or kala azar) affects the bone marrow and internal organs. It is caused by a parasite spread through the bite of a female sandfly. It can also be transmitted by blood transfusion or sharing contaminated needles. If left untreated it can cause death. Risk is generally low for most travellers. Protect yourself from sandfly bites, which typically occur after sunset in rural and forested areas and in some urban centres. There is no vaccine or medication to protect against leishmaniasis.

Lymphatic filariasis , also known as elephantiasis, is caused by filariae (tiny worms) spread to humans through the bite of an infected mosquito. It can cause a range of illnesses. Risk is generally low for most travellers. Protect yourself from mosquito bites. There is no vaccine available for lymphatic filariasis although drug treatments exist.

• In this country,   dengue  is a risk to travellers. It is a viral disease spread to humans by mosquito bites.
• Dengue can cause flu-like symptoms. In some cases, it can lead to severe dengue, which can be fatal.
• The level of risk of dengue changes seasonally, and varies from year to year. The level of risk also varies between regions in a country and can depend on the elevation in the region.
• Mosquitoes carrying dengue typically bite during the daytime, particularly around sunrise and sunset.
• Protect yourself from mosquito bites . There is no vaccine or medication that protects against dengue.

Zika virus is a risk in this country. 

Zika virus is primarily spread through the bite of an infected mosquito. It can also be sexually transmitted. Zika virus can cause serious birth defects.

During your trip:

• Prevent mosquito bites at all times.
• Use condoms correctly or avoid sexual contact, particularly if you are pregnant.

If you are pregnant or planning a pregnancy, you should discuss the potential risks of travelling to this destination with your health care provider. You may choose to avoid or postpone travel.

Animal precautions

Some infections, such as rabies and influenza, can be shared between humans and animals. Certain types of activities may increase your chance of contact with animals, such as travelling in rural or forested areas, camping, hiking, and visiting wet markets (places where live animals are slaughtered and sold) or caves.

Travellers are cautioned to avoid contact with animals, including dogs, livestock (pigs, cows), monkeys, snakes, rodents, birds, and bats, and to avoid eating undercooked wild game.

Closely supervise children, as they are more likely to come in contact with animals.

There is a risk of Nipah virus infection in this country. Nipah virus infections can range from asymptomatic (no symptoms) to severe illness and death.

Nipah virus is spread to people from animals (such as fruit bats) but it can also be spread through contaminated food or close contact with someone who is ill.

Travellers to areas where Nipah virus is found should:

• avoid consuming date palm sap products, including raw date palm juice
• thoroughly wash and peel fruit before consumption
• wash hands regularly with soap and water
• discard fruit with signs of bites or fruit that has been found on the ground
• avoid contact with fruit bats and areas where they are known to roost

There is no vaccine or medication that protects against Nipah virus infection.

Person-to-person infections

Stay home if you’re sick and practise proper cough and sneeze etiquette , which includes coughing or sneezing into a tissue or the bend of your arm, not your hand. Reduce your risk of colds, the flu and other illnesses by:

•   washing your hands often
• avoiding or limiting the amount of time spent in closed spaces, crowded places, or at large-scale events (concerts, sporting events, rallies)
• avoiding close physical contact with people who may be showing symptoms of illness 

Sexually transmitted infections (STIs) , HIV , and mpox are spread through blood and bodily fluids; use condoms, practise safe sex, and limit your number of sexual partners. Check with your local public health authority pre-travel to determine your eligibility for mpox vaccine.  

Tuberculosis is an infection caused by bacteria and usually affects the lungs.

For most travellers the risk of tuberculosis is low.

Travellers who may be at high risk while travelling in regions with risk of tuberculosis should discuss pre- and post-travel options with a health care professional.

High-risk travellers include those visiting or working in prisons, refugee camps, homeless shelters, or hospitals, or travellers visiting friends and relatives.

Medical services and facilities

The quality of health care varies significantly throughout the country.

Medical care in major cities may be good, but it’s usually very limited or unavailable in rural areas.

Government hospitals provide free services or at a minimal cost. Private facilities often offer a higher level of care but can be expensive. Most hospitals require up-front payment or confirmation of insurance coverage before commencing treatment.

Specialised treatment for psychiatric illness may not be available outside major cities.

Make sure you get travel insurance that includes coverage for medical evacuation and hospital stays.

Travel health and safety

Ambulances are often equipped with basic and old medical equipment.

Response times can be very slow. Traffic doesn’t yield to emergency vehicles.

In case of serious illness or injury, you may consider taking a taxi or private vehicle to go to the hospital rather than wait for an ambulance.

Medical tourism

Some Canadian citizens have had severe health complications following cosmetic or other elective surgeries abroad.

Before leaving for medical travel:

• make sure you have done your research
• use competent health-care providers only

Keep in Mind...

The decision to travel is the sole responsibility of the traveller. The traveller is also responsible for his or her own personal safety.

Be prepared. Do not expect medical services to be the same as in Canada. Pack a   travel health kit , especially if you will be travelling away from major city centres.

You must abide by local laws.

Learn about what you should do and how we can help if you are arrested or detained abroad .

Penalties for possession, use or trafficking of illegal drugs are severe. Convicted offenders can expect heavy fines and jail sentences. Detention during the investigation is common and can be lengthy.

Laws regarding the purchase and consumption of alcohol, including the legal drinking age, differ from state to state. Authorities often call for dry periods during:

• religious festivals
• national holidays

Drugs, alcohol and travel

It is prohibited to import, possess or use e-cigarettes, vaporisers and their refills.

Beef consumption

Cows are protected and venerated by several groups of faith in India.

Several states impose prohibitions on beef slaughter and consumption. In some rural areas, cow protection vigilantes have attacked people suspected of selling, consuming, or possessing beef or items made with cowhide.

Avoid consuming beef or its derived products while in India.

Religious proselytism

In certain states, it’s illegal to engage in religious proselytism, such as preaching, possessing, or distributing religious literature or material with the intent of converting. Indian authorities require foreign missionaries to obtain a missionary visa.

If you plan to conduct religious activities in India, ensure that:

• the activities are legal
• you possess the proper visa for the activities you plan to perform

Satellite devices

It’s illegal to carry or use a satellite device in India.

Photography

It is prohibited to take pictures of military installations, airports and dams.

Ask permission before photographing places of worship such as temples or mosques.

Imports and exports

There are strict regulations on the importation or exportation of items such as:

• antiquities
• electronic equipment
• local currency
• ivory and gold objects
• protected animals
• pornographic material

Among others, you must register antique items for export with local police, with a photograph of each item.

Dress and behaviour

India is a traditional, conservative and multi-faith society. To avoid offending local sensitivities:

• Dress conservatively
• Behave discreetly
• Respect religious and social traditions
• Avoid displays of affection in public
• Avoid using footwear in places of worship

Indian family law is very different from Canadian law.

In case of dispute, consult a local lawyer to be fully aware of local laws regarding marital fraud, dowry abuse or extortion, custody, guardianship and visitation rights. Individuals facing charges may be forced to remain in India until their cases have been settled or charges dismissed.

Commercial surrogacy

If you’re planning to visit India to commission surrogacy arrangements, you should consider the potential challenges involved in pursuing international surrogacy. Seek specialist legal advice on Indian and Canadian laws before making any arrangements.

A proposed Indian government ban on foreign commercial surrogacy could affect Canadians travelling to India to enter into a surrogacy agreement.

You should also consult with Immigration, Refugees and Citizenship Canada (IRCC) on current policies regarding citizenship through descent and the issuance of Canadian travel documents.

Land and property disputes

If you plan on buying property or are involved in a land dispute in India, you should seek legal advice. Do so before making commitments. Related disputes could take time and be costly to resolve.

The offices of the Government of Canada in India can’t provide assistance or legal advice related to private legal matters.

2SLGBTQI+ travellers

Indian law doesn’t criminalize sexual acts or relationships between persons of the same sex.

However, 2SLGBTQI+ travellers could be discriminated against based on their sexual orientation, gender identity, gender expression, or sex characteristics.

Dual citizenship is not legally recognized in India.

If local authorities consider you a citizen of India, they may refuse to grant you access to Canadian consular services. This will prevent us from providing you with those services.

Travellers with dual citizenship

International Child Abduction

The Hague Convention on the Civil Aspects of International Child Abduction is an international treaty. It can help parents with the return of children who have been removed to or retained in certain countries in violation of custody rights. It does not apply between Canada and India.

If your child was wrongfully taken to, or is being held in India by an abducting parent:

• act as quickly as you can
• consult a lawyer in Canada and in India to explore all the legal options for the return of your child
• report the situation to the nearest Canadian government office abroad or to the Vulnerable Children’s Consular Unit at Global Affairs Canada by calling the Emergency Watch and Response Centre.

If your child was removed from a country other than Canada, consult a lawyer to determine if The Hague Convention applies.

Be aware that Canadian consular officials cannot interfere in private legal matters or in another country’s judicial affairs.

You must carry your passport and Indian visa at all times.

International Driving Permit

The currency in India is the Indian Rupee (INR).

Non-residents are prohibited from importing or exporting the Indian rupee. A limit of 25,000 rupees is imposed on residents.

Upon entering or leaving India, you must make a declaration to customs if you have USD 5,000 or more, or the equivalent in other currencies.

India is prone to extreme weather events such as:

• dust storms
• earthquakes

Extreme temperatures can occur in both spring and summer.

The rainy (or monsoon) season extends from June to September.

Heavy rain can cause flooding throughout the country, resulting in significant loss of life and extensive damage to infrastructure. Seasonal flooding and landslides can hamper overland travel and reduce the provision of essential services. Roads may become impassable and bridges damaged.

India’s coastline is subject to cyclones, particularly between April and December. These severe storms can put you at risk and hamper the provision of essential services.

If you decide to travel to a coastal area:

• know that you may expose yourself to serious safety risks
• be prepared to change your travel plans on short notice, including cutting short or cancelling your trip
• stay informed of the latest regional weather forecasts
• carry emergency contact information for your airline or tour operator
• follow the advice and instructions of local authorities
• Tornadoes, cyclones, hurricanes, typhoons and monsoons
• Large-scale emergencies abroad

Seismic activity

Parts of India are located in active seismic zones. Earthquakes occur.

In the event of an earthquake, follow the instructions of local authorities.

What to do during an earthquake

Air pollution

Smoke haze and other types of air pollution can be extremely hazardous in urban areas and cities such as Delhi. It’s typically at its worst in winter. In rural areas, air quality can be affected by agricultural burning.

Dust storms also occur across northern India.

Monitor air pollution levels, which change quickly, especially if you suffer from respiratory ailments or have pre-existing medical conditions.

During periods of high pollution:

• limit your activities outdoors
• monitor local media

Rules & Restrictions for OCI Card Holders

Changes at a Glance

• Most Overseas Citizen of India (OCI) cardholders do not need to have their OCI cards reissued every time they get a new passport.
• Those having OCI cards issued before the cardholder was 20 years old, on the other hand, only need to get a new OCI card once when they get a new passport after turning 20.
• There are new requirements for OCI cardholders who are under the age of 20 to notify the government when they receive a new passport, as well as for OCI cardholders who are married to Indian nationals or other OCI cardholders.
• The government's eased OCI card re-issuance requirements decrease the administrative burden of needing to apply for a new OCI card and show the government's flexible attitude in the wake of recent restrictions for OCI card holders.

Overseas Citizen of India

People eligible to be registered as oci, application for oci card.

• PIOs who have moved from India and earned citizenship in a foreign nation other than Pakistan or Bangladesh are eligible for Overseas Citizenship of India.
• A visa that allows you to visit India multiple times and for multiple purposes for the rest of your life.
• No need to report to the police for the duration of your stay in India.
• Financial, economic, and educational parity with NRIs, save in the purchase of agricultural or plantation lands, and
• A person who has been registered as an OCI for five years and has lived in India for one year out of the five years prior to filing the application is eligible to apply for Indian citizenship under section 5(1) (g) of the Citizenship Act, 1955.

Benefits of OCI

The following benefits are not available to oci card holders:, change in rules, key changes introduced.

• research activities;
• missionary / Tabligh / mountaineering / journalistic activities;
• internships or employment with any India-based, foreign diplomatic missions or foreign government organisations; and
• visits to any areas or places notified as protected / restricted / prohibited space by the Central Government (or by any relevant authority).
• Air costs inside India; and
• Entry fees for museums, national parks, national monuments, wildlife sanctuaries, and historical sites in India.
• inter-country adoption of India born children (subject to adherence and compliance with adoption procedure laid down under applicable laws and regulations);
• appearing for the all-India entrance examinations, such as, JEE (Joint Entrance Examination) Advanced and Mains, NEET (National Eligibility cum Entrance Test), or other tests that makes an OCI card holder eligible for admission to any NRI seat or any supernumerary seat (to clarify, OCI cardholders are not eligible to get admission for seats reserved exclusively for Indian citizens);
• purchase or sale of immovable properties, except agricultural land, farmhouses, or plantation properties; and

• Definition of Resolution plan will now include provisions for corporate restructuring: The amendment act has inserted an explanation in the definition of resolution plan to clarify that a resolution plan that proposes the insolvency resolution of a corporate debtor may include the provisions for corporate restructuring, including by way of merger, amalgamation and demerger.
• NCLT will have to record reasons for delay in discarding an application for initiation of CIRP: As per the Code, the NCLT must dispose of an application for initiation of CIRP within a period of 14 days from the receipt of application. However, there have been cases when the NCLT has taken more than 14 days to make a decision on the application. Therefore, to ensure speedy disposal and value maximization of the corporate debtor's assets, a proviso has been added which requires that NCLT to record its reasons in writing in case an application is not disposed within 14 days.
• Corporate Insolvency Resolution Process to be concluded within 330 days: Earlier, the IBC demanded completion of CIRP within 180 days including a one-time extension of 90 days. However, many a times the Courts have allowed removal of certain periods, for instance, time consumed in litigation, from the compulsory completion period resulting in a lot of unresolved CIRPs well beyond the time duration allowed in the IBC. The Amendment act makes it compulsory for a CIRP to be completed within 330 days including any extension of time granted and time taken under legal proceedings. It further states that any pending CIRPs that have been going on for over 330 days should be completed within 90 days from the date of commencement of the Amendment Act.
• Voting by authorised representative representing a class of financial creditors: To avoid any confusion and facilitate decision making in the Committee of Creditors, especially in cases where financial creditors are a large group, the Amendment Act provides that an authorized representative representing a class of financial creditors shall vote on behalf of all the financial creditors he/she represents in accordance with the decision approved by more than 50% of such financial creditors. This principle however would not be applicable in case of voting for withdrawal of CIRP.
• Amount payable to functional creditors and disagreeing financial creditors: The Amendment Act provides that payment of debts of operational creditors shall be the higher of
• the amount to be paid to these creditors at the time of liquidation of the corporate debtor u/s 53 or
• the amount that would have been paid to such creditors, if the amount to be distributed under the resolution plan had been distributed in accordance of priority as mentioned u/s 53 (1)
• NCLT has not approved or rejected a resolution plan
• an appeal is pending at the Supreme Court or at the NCLAT (National Company Law Appellate Tribunal)
• a lawsuit has been launched in a court challenging the decision of NCLT in relation to a resolution plan
• Committee of Creditors (COC) to contemplate way of distribution submitted in the resolution plan: Besides the current need of approval of resolution plan after keeping in mind the practicality and acceptability of the resolution plan, the amendment act requires that the CoC consider the manner of distribution proposed in the resolution plan by taking into account the order of priority amongst creditors, as prescribed u/s 53 (1) relating to liquidation waterfall, including the priority and value of security interest of a secured creditor.
• NCLT approved resolution plan will be binding on the Central Government, State Government or any local authority to whom corporate debtor owes a statutory debt: As per the Code, the approved resolution plan was only binding on the corporate debtor and its employees, creditors, members, guarantors and other stakeholders included in the resolution plan resulting in instances where the Government used to follow up for the balance dues after the said approval of resolution plan. The Amendment Act has now modified Section 31(1) to illuminate that any NCLT approved resolution plan will be binding on the Central Government, State Government and any local authority to whom a corporate debtor owes a debt in respect of payment of dues arising under any law.
• Liquidation after setting up the Committee of Creditors (COC): The Amendment Act simplifies by way of an explanation, u/s 33(2) which covers liquidation, that the COC may decide to liquidate the corporate debtor any time after the setting-up of the COC until the confirmation of the resolution plan, including at any time before the development of the information memorandum. This change is pertinent as there have been cases where NCLTs have demanded that a liquidation order may be passed only after failure of the CIRP even though an early liquidation would have resulted in value maximization.

Indian visa service in Canada shut down: what happens now?

Canadian citizens can no longer get a visa to travel to india. but what about those with oci cards how long will this situation last.

As diplomatic tensions with Canada continued to rise, India on Thursday (September 21) suspended visa services in that country .

The announcement was made on the visa facility website of the Indian High Commission in Canada.

A day earlier, on Wednesday, New Delhi had advised all Indian nationals in Canada, as well as those who were planning to visit that country, to “exercise utmost caution”, given the “growing anti-India activities and politically-condoned hate crimes and criminal violence in Canada”.

Exactly who in Canada is impacted by the suspension of visa services?

Canadian nationals who intend to visit India, but who do not have an Indian visa yet, will be impacted. This group would include mainly Canadian tourists, business travellers, and students, as well as family members of Indian citizens travelling to visit relatives and friends.

Tour operators in India had been expecting a large number of tourists from Canada to visit this winter. Foreign tourist arrivals have been impacted from the 2019-20 season onward as a result of the Covid-19 pandemic and its aftermath, and it is widely anticipated that the coming season will be busy. Some operators were already bracing for cancellations from Canada on Thursday.

Will Indian-origin Canadians with OCI cards also be impacted?

No, Indian-origin Canadians who have a valid Overseas Citizen of India (OCI) card, or a valid long-term visa for India, will not be impacted by the suspension of visa services.

OCI cards allow holders lifetime entry into India, and to live and work in the country indefinitely.

What happens to Canadians who already have a valid Indian visa, and may be planning to visit India at this point?

Canadians with a valid Indian visa will not be impacted by the Indian government’s latest decision. As of now, their visa stands. They have not been cancelled yet.

For how long is this situation going to last?

As of now, visa services have been temporarily suspended. Where the situation goes here onward will depend on the way political and diplomatic relations between the two countries evolve.

The current crisis began on Monday (Canada time) after Canada’s Prime Minister Justin Trudeau alleged a “potential link” between “agents of the Government of India” and the killing of Khalistani separatist, Hardeep Singh Nijjar, in Canada in June. Canada expelled a senior Indian diplomat, and India retaliated on Tuesday by expelling a senior Canadian diplomat. There has been no thaw yet.

Could Canada reciprocate with its own curbs on Indians seeking Canadian visas?

How does India's visa office suspension affect Canadian travellers?

The suspension of Indian visa services for Canadians this week has prompted uncertainty among many who had hoped to travel to India in the near future.

The news came Thursday as India's visa processing centre in Canada halted services for Canadian citizens, with India saying it anticipates Ottawa will reduce its diplomatic presence in the country. Prime Minister Justin Trudeau told Parliament earlier in the week there were “credible allegations” of Indian involvement in the June killing of Sikh independence activist Hardeep Singh Nijjar.

"Due to operational reasons, with effect from 21 Sept. Indian visa services have been suspended [until] further notice," stated the BLS Indian Visa Application Center in Canada on its website.

Here's what the visa centre closure could mean for India's sizable diaspora community in Canada, which is now caught in the middle of rising diplomatic tensions between the two countries.

WHAT SERVICES DOES THE CENTRE OFFER?

With offices in Montreal, Ottawa, Toronto, Brampton, Ont., Winnipeg, Calgary, Edmonton, Vancouver and Surrey, B.C., BLS is the agency that processes visa requests for India, including for entry, tourist, student and employment visas. 

Its services are divided into three main categories: passports, temporary visas and Overseas Citizenship of India (OCI) cards. Those eligible for OCI cards are persons of Indian origin who formerly held an Indian passport, along with their children and spouses.

It's essentially a "lifetime visa for India," the office states online. Cardholders are "granted multiple entry, multi-purpose, lifelong visa for visiting" the country.

But it cautions that OCI status is "not to be misconstrued as 'dual citizenship,'" as India forbids its citizens from holding citizenship of a foreign country simultaneously.

Under normal circumstances, it usually takes about two to three months for the office to process OCI applications, while single entry visas would only take about a week to approve, said immigration consultant Pragati Sharma.

It is not clear how many Canadians hold OCI status, but Indian media reports suggest there were roughly six million cardholders worldwide as of 2020.

ARE CURRENT OCI OR VISA HOLDERS AFFECTED BY THE OFFICE'S CLOSURE?

The suspension won't affect Canadian citizens who already hold OCI cards, or those whose single entry visas have already been processed, said Sharma, who operates Westlink Immigration in Winnipeg.

However, any Canadian who planned on travelling to India but had not yet been granted an OCI or visa is out of luck for now, she said. That includes those who already applied but had not yet seen their submission processed.

"There are lots of calls I was getting this week because of the situation. People are worried how this is going to impact their applications, those who have already submitted those applications," Sharma said.

"There is a rift between two countries and obviously they have taken some steps, so this is definitely going to impact Canadians."

HOW IMPACTFUL COULD THIS BE?

With Canada home to around 1.4 million residents of Indian descent, according to the 2021 census, travel between the countries is common.

In 2021, 80,000 Canadian tourists visited India, making them the fourth-largest group, according to India's Bureau of Immigration. Meanwhile, Canada remains an attractive destination for Indians, especially students. In 2022, nearly 300,000 Indians were pursuing higher education in Canada.

"This, of course, is going to affect those who are travelling in the next few months," Vinay Kanetkar, director of the University of Guelph's Canada India Research Centre for Learning and Engagement, said in an email.

The restrictions come at a time when many Indian expats often make the trip back home. Sharma noted that there are a series of Indian festivals which begin in October, including Diwali the following month.

"People tend to go back during these festival seasons and they like to visit their family. That would be a big issue," she said.

"They have to cancel those plans. Obviously, there will be uncertainty during this period."

Almost one in five recent Canadian immigrants were born in India, making it the leading country of birth for recent immigration to Canada, Statistics Canada said last year.

WHAT ABOUT THOSE TRAVELLING FROM INDIA TO CANADA?

Thus far, it appears India's suspension of services will have no effect on those seeking to travel to Canada, according to Sharma. That is despite India having urged caution for its citizens planning to visit Canada, citing security risks.

"I got so many calls this week, those people who have submitted an application for a study permit, work permit, like all those things, how this is going to impact them," she said.

"There is nothing as such I'm aware of, to be very frank."

India has suspended all visa applications for Canadians. Here’s what that means for travel

UPDATE : On Nov. 22, India resumed issuing e-visas for Canadian tourists and business travellers after annoucing it would do so on Oct. 25 .

India is temporarily suspending all visa services for Canadians in the wake of Prime Minister Justin Trudeau’s bombshell allegation that New Delhi was involved in the killing of a Sikh leader in British Columbia.

Indian External Affairs Ministry spokesperson Arindam Bagchi confirmed there is temporary suspension of all visa services for Canadians, including e-visas and visas issued in third countries.

BLS, the agency that processes visa requests for India, including for entry, tourist, student and employment purposes, posted on its website: “Due to operational reasons, with effect from 21 September 2023, Indian visa services have been suspended till further notice.”

The move has sparked confusion as to what the suspension will mean for Canadians planning to travel to India.

Here’s what we know so far.

What types of visas are affected by the suspension?

All types of visas are affected, including for work, business and tourism. Applications through the online e-visa program are also suspended. According to Mr. Bagchi, any application that would have to go through the high commission of India in Ottawa or another Indian consulate are included in the pause.

Can I still travel to India if I already have a visa, or have a valid Overseas Citizen of India (OCI) card?

Those who already have an OCI card, a Person of Indian Origin (PIO) card, or a valid Indian visa of any kind can still travel to India, because only new visa applications are affected by the suspension. There are no flight or travel restrictions at this time for a person who holds valid travel documents.

“The issue is not about travel to India. Those who have valid visas, those who have other kinds of documents like OCIs are free to travel to India. But the issue is of incitement of violence and the creation of an environment that disrupts the functioning of our high commission and consulates,” Mr. Bagchi said in a news conference.

I’m a permanent resident in Canada. Can I still visit India?

There are currently no changes to permanent residency policies for Indian citizens living in Canada, and permanent residents can still travel to India and back. That means all Indian passport holders can travel without issues or restrictions. On Sept. 20, the Indian government requested all Indian citizens living or studying in Canada register with the high commission or an Indian consulate to “better connect … in the event of any emergency or untoward incident.”

I have recently acquired Canadian citizenship. Does the suspension impact new OCI applications or passport surrender services?

Kubeir Kamal, an immigration consultant, says that new OCI applications are expected to be affected by the suspension. BLS International has not been able to confirm if they will continue accepting new OCI applications at this time.

According to the Indian Citizenship Act, 1955, India does not allow dual citizenship with another foreign country. A person is expected to surrender their Indian passport before they can apply for OCI or PIO card. Mr. Kamal says that Indian passport surrender services are expected to operate in normal fashion.

Will in-process visa applications also be affected?

Yes, in-process visa applications will also be delayed seeing that all visa operations have been suspended until further notice.

I have booked a trip to India in early 2024. Is it likely that Indian visas will be issued again before then? Should I cancel now?

According to Mr. Kamal, it’s too early to tell if a traveller with a flight booked to India in the early months of 2024 should cancel their trip. “There is no way to speculate when the situation will deescalate and visa services will return to normal,” he said. Instead, he recommends following the official Twitter account of the High Commission of India in Ottawa for updates on the visa services.

Are there any travel advisories in place for Canadians who plan to travel to India?

Global Affairs Canada is urging travellers to “exercise a high degree of caution” when visiting India. Canada updated its travel advisory on Sept. 24 to include safety and security warnings about protests in the region. It advises travellers to avoid non-essential travel in parts of Northeastern India such as Assam and Manipur, and to avoid all travel to Jammu and Kashmir due to the threat of terrorism, militancy, civil unrest and kidnapping.

How are Canada’s consulates in India affected?

Canada’s embassy in New Delhi remains open , as do Canadian consulates across India, said Global Affairs spokesman Jean-Pierre Godbout in a statement. However, the Canadian government is reducing staff levels at its diplomatic missions in India, citing fear for the safety of its employees. This reduction in staff will likely mean disruptions for members of Canada’s Indian diaspora who maintain business or administrative ties with the country, explains Mississauga, Ont., paralegal Bobby Sidhu. “It’s definitely going to affect the lives of many, many Indian-Canadian citizens,” Mr. Sidhu said.

• Acceptance of visa application does not ensure that visa shall be granted. Applicants must note that grant or refusal of visa is sovereign right of India and it cannot be claimed as a matter of right by the applicant.
• Grant of visa, its duration or number of entries is purely the discretion of the Consulate and BLS has no role to play in this decision.
• Visa fee is non-refundable and non-transferable. Fee, once charged, will not be refunded even in cases where visa is refused or the application is withdrawn.  For fee please refer to https://www.cgitoronto.gov.in/page/consular-fees/  
• Passport on which visa is applied must have at least 2 blank pages and must have a validity of more than 190 days.  Passengers holding valid visas may be denied entry into India if the validity of their passports is less than 180 days at the time of entry into India.
• The validity of visa starts from the date of its issue and not from the date of entry into India.
• Processing time for visa applications is 30 days from the date application has been accepted by BLS and a receipt is generated.  However, in certain cases the processing time mayexceed 30 days.
• Visa applicants are advised not to purchase travel tickets before visa is obtained. 
• Long-term visa holders intending to stay in India for more than 180 days are required to register at their nearest Foreigners Regional Registration Office (FRRO) or District Superintendents of Police.
• The Consulate, at its discretion, mat call any applicant to attend interview in person in the Consulate General of India, Vancouver irrespective of his/her location of residence.  Failure to attend the interview may result in rejection of visa application.
• In case of visa for Research, Missionary work, Journalism, travel document holders, Pakistani nationals/persons of Pakistan origin and Chinese national, separate rules would apply.
• Change of purpose is not permitted on any visas, once granted.
• Foreigners entering India are advised that use or carrying satellite telephone sets such as Iridium, Inmarsat, Thuraya etc. is prohibited in India.Any violations would result in confiscation of the these sets will be seized and the holder can be prosecuted under Section 6 of Indian Wireless Act and Section 20 of Indian Telegraph Act.
• Previously issued 10 year Tourist paper visa are currently not valid for travel to India. As and when the 10 year Tourist paper visas previously issued get reinstated the same will be notified. 
• Currently Regular Tourist visas are also not being issued from the Consulate. As and when the service is started the same will be notified. However, e-tourist visa can be applied for at  https://indianvisaonline.gov.in/

More red tape for new Canadians needing travel visas for India

Canadians of Indian descent are scrambling to surrender their Indian passports so they can travel to their home country.

Indian-born travellers have to submit “surrender certificates” in order to apply for a visa and Overseas Citizen of India (OCI) card to return to India after the Indian government suspended its e-visa program last month.

A surrender certificate is a document issued when an Indian passport is handed in once the holder receives a Canadian passport. The certificate is now crucial for obtaining an entry visa to India and to apply for an OCI card. On Oct 25, the Indian Embassy in Ottawa announced the partial resumption of visa services for Canadians travelling to India, but it has not restarted the e-visa program.

Sanjay Verma, Indian High Commissioner in Canada, confirmed there has been an increase in the total number of OCI applications from across the country and that processing times will be longer than usual as a result.

“India has unilaterally (not as a part of any reciprocal measure) provided eVisa facility to citizens of many nations, including Canada, till the suspension of all visas in September 2023 was implemented for Canadian citizens,” Verma said in an emailed statement.

“Visa-related decisions are sovereign actions of issuing countries. My advice to all Canadian citizens eligible to apply for an Indian visa is to submit their applications well in advance and not to buy travel tickets without having (an) Indian visa in hand. All Canadian citizens of Indian descent fall in this category too. They may also consider applying for OCI Cards for their future journeys.”

Tejas, who recently got his Canadian citizenship, stood for four nights in the queue outside the BLS Centre in Brampton, Ont. hoping to get a surrender certificate because he couldn’t book an appointment online and in-person appointments are limited. He asked that NCM use only his first name because he fears repercussions.

He first went to BLS Brampton on Oct. 26, and he was the 79th person in the queue. He said he has to visit India in December for a family function and was not expecting the sudden changes in visa procedures. Tejas received his Canadian citizenship in September and surrendered his passport at the end of the month.

A surrender certificate is expected to take six to eight weeks to be issued, but he is hoping to get an entry visa based on the formal acknowledgement that he has surrendered his Indian passport.

“I finally got into the BLS Centre on Monday (Oct. 30) and they accepted my entry visa application without a surrender certificate as I had adequate documents to prove that I was born in India,” said Tejas. “I would recommend to people that if they have not surrendered the Indian passport, it’s better to submit it on the same day, along with the visa application. I think they make an exception to surrender certificate submission on a case-to-case basis.”

Said Verma, Indian High Commissioner in Canada: “We try to help the OCI applicants in the best possible ways. If they meet the documentation requirements, the process mentioned can be followed.”

Application fees, document requirements, photo specifications, processing time.

• All OCI applications will be submitted online along with the requisite documents (self-attested), photograph and signature (in the case of minors who cannot sign, left hand thumb impression (for boys) and right-hand thumb impression (for girls).
• After filing of the online OCI application and uploading the supporting documents, signature, and photograph online, applicants must submit the supporting documents and relevant fees to BLS International (outsourced agency of High Commission/Consulate General of India) for necessary verification.
• No OCI application or service request will be accepted in the offline mode any longer.

Who can apply?

Following categories of foreign nationals are eligible for registration as Overseas Citizen of India (OCI) Cardholder:

• who was a citizen of India at the time of, or at any time after the commencement of the Constitution of India i.e. 26.01.1950; or
• who was eligible to become a citizen of India on 26.01.1950
• who belonged to a territory that became part of India after 15.08.194
• who is a child or grandchild or a great grandchild of such a citizen
• who is a minor child of such persons mentioned above
• who is a minor child and whose both parents are citizens of India or one of the parents is a citizen of India
• spouse of foreign origin of a citizen of India or spouse of foreign origin of an Overseas Citizen of India (OCI) Cardholder registered under section 7A of India's Citizenship Act, 1955 and whose marriage has been registered and subsisted for a continuous period of not less than two years immediately preceding the presentation of the OCI application.

Who cannot apply?

No person, who or either of whose parents or grandparents or great grandparents is or had been a citizen of Pakistan, Bangladesh or such other country as the Government of India may, by notification in the Official Gazette, specify, shall be eligible for registration as an OCI Cardholder."

Note: As per Indian Mission Officer’s directions, BLS Intl. Submission Officer may request for additional documentation, which is not mentioned in the checklist, at the time of submission or during the processing of the application. If applicant needs to be contacted by HCI / CGI or BLS Intl.: Kindly ensure that you provide the current contact number and email address in your application form to avoid any delays.

Rules and regulation of Overseas Citizenship of Indian (OCI) process are subject to change by Indian Mission without any prior intimation to the applicant.

The decision to grant or refuse Overseas Citizenship of Indian (OCI) service is made solely by the officers at Indian Mission. BLS Intl. has no influence over the outcome of an application.

Please do not club demand draft of CGI/HCI if you are applying OCI/OCI Misc services together. For BLS Demand draft, it could be combined. Please see the relevant scenarios:

Applicants are advised to submit visa applications minimum 15 days in advance of their travel plans.

Please be advised that the estimated processing times are mentioned below. However, how long an application will take to process is also dependent on the following factors such as the city the application was submitted in, in which city or country was the previous / old passport issued.

Please keep in mind that incomplete applications will lead to a delay in the processing of an application, and all applicant(s) are requested to comply with any changes that may occur during this time. You are requested to make your travel arrangements only after receiving relevant service.

Note: Applications sent by post will take additional 3-4 working days for processing.

• Processing time mentioned above is an approximate estimate from HCI / CGI. Therefore, BLS International has no influence on the processing time taking when under process at HCI / CGI
• BLS International cannot guaranty the processing time that will be taken after normal processing time due to subject to clearance reason. Contact HCI / CGI procedure: Only after normal processing time has exceeded, applicant can contact the nearest Indian Mission via email for information beyond BLS International Service conditions
• The estimated processing time mentioned below does not include the time that the courier company will take to deliver the passport.

• Duration of the Visa is the sole discretion of the Indian Mission officer. India-Canada row: Visa suspension will not affect OCI services, says official

India has suspended visa services for canadian citizens citing security threats to its staff in its consulates in canada.

India may have suspended visa services for Canadian nationals, applications for issuance of fresh Overseas Citizen of India or OCI have not been impacted.

While there was confusion about whether recent Canadian citizens who have surrendered their Indian passports and others of Indian origin could apply for a new OCI card, a senior Indian official said, “Suspension is only for visa services. OCI services not affected by the suspension.”

The suspension was put in place on Wednesday night amid turmoil in the relationship between Canada and India and after Canadian Prime Minister Justin Trudeau made a statement in the House of Commons on Monday that there were “credible allegations” of a potential link between Indian agents and the murder of Khalistani figure Hardeep Singh Nijjar on June 18.

Responding, Foreign ministry spokesperson Arindam Bagchi said in New Delhi earlier that “no specific information” has been received from Canada.

The reason given by BLS International, which has the third-party contract to process applications in Canada, was that it was “due to operational reasons” and visa services would remain suspended till further notice.

While the External Affairs Ministry had said OCI services would not be impacted, it was unclear whether that applied to current OCI holders or fresh applicants as well.

On Thursday, Bagchi, spokesperson for the Ministry of External Affairs said, “The question is not about travel to India. Those who have valid visas, those who have other kind of documents like [Overseas Citizen of India cards] are free to travel to India.”

He had blamed the failure of Canadian authorities to act on the incitement of violence against Indian diplomats for the suspension of visa services. “That’s what’s making us stop temporarily the issuance of visas or providing visa services,” he added. The secessionist group Sikhs for Justice or SFJ has called for a shutdown of Indian missions on Monday.

However, an official said there will be greater scrutiny of OCI applications, particularly in the context of some persons of Indian origin in Canada being involved in pro-Khalistan activities.

Canadian Prime Minister Justin Trudeau has asserted that the “credible allegations” related to the potential link between Indian agents and the killing of Khalistani figure Hardeep Nijjar were communicated to New Delhi “weeks ago.”

Trudeau’s charges have led to a series of fallouts, including both countries expelling diplomats.

Emboldened by Trudeau’s allegations, the secessionist group Sikhs for Justice or SFJ has called for shutting down India’s mission in Canada on September 25 and for the expulsion of India’s High Commissioner to Ottawa.
