Firstly, it’s important to know about the visitor visa you have applied for, as there are mainly three subclass visitor visas:  

• Subclass 651 – eVisitor
• Subclass 601 – Electronic Travel Authority Visa
• Subclass 600 – Visitor Visa

If you have the Subclass 651 visa , then you can stay up to three months at a time each year. This visa is primarily used as a tourist visa or for business purposes.

The Subclass 601 Visa permits you to stay up to 12 months with three months at a time on multiple visits. Again, this visa allows you to visit Australia as a tourist or for business purposes. This visa can only be obtained by certain visa holders from specific countries.

Finally, Subclass 600 is a fit for all visas, wherein you can stay up to 12 months. This visa can be applied for if you want to visit Australia as a tourist, are sponsored on a family visa, on a business trip, are a frequent traveller, or are on an ADS visa. The ADS or Approved Destination Status visa is a type that allows Chinese tourists to travel in groups in Australia. This type of visa takes at least six to nine months to process. However, the Subclass 600 is comparatively cheaper and costs about $150.

However, you should know that while applying for any of the visitor visas or converting them to a student visa, you shouldn’t hold any bad records. Bad records can range among the following:

Are you in Australia on a Tourist visa and considering applying for a Student visa onshore? It is important to be aware that progressing from a tourist visa to student visa Australia whilst you remain onshore  can be a complex pathway to pursue and may pose a higher risk of refusal, depending on your personal circumstances. It may also be the case that an onshore student visa application is not an available option, due to whats known as the ‘No Further Stay Condition’ imposed on your visitor visa. If you are subject to this visa condition on your tourist visa, you would be unable to progress from a tourist visa to student visa Australia whilst you remain onshore; in this situation, you would need to depart Australia and apply for a student visa from offshore, unless you successfully apply to the Department to have this condition waived.

In this article, we take a closer look at why it can be a risky strategy to apply onshore for a student visa whilst you hold a tourist visa, that is, to progress from a visitor visa to student visa whilst you remain onshore. We also discuss visa condition 8503 in more detail and how you can apply to the Department of Home Affairs (the Department) to have it waived (this would allow you to progress from a visitor visa to student visa; provided you meet all valid visa application and visa grant requirements for a student visa).

Also be aware that if you are seeking advice on how to convert tourist visa to student visa in Australia, you are actually looking at how to apply for a student visa whilst you hold a tourist or visitor visa (the terms tourist and visitor visa are interchangeable; a Subclass 600 Visitor visa includes a tourist stream). You cannot convert one visa to another. You can only apply for a visa.  Keep this in mind as you read below.

Why Can It Be Risky To Apply For A Student Visa In Australia If You Hold A Tourist Visa?

One key criterion for grant of a student visa is the Genuine Temporary Entrant  (GTE) requirement. To satisfy this, you must demonstrate to Immigration that you intend to genuinely stay in Australia temporarily and comply with the conditions imposed on your student visa, should it be granted. To make this assessment, the Department will consider the following:

Your Circumstances In Your Home Country

• Reasons for not undertaking studies in your home country or region;
• Whether your economic situation, personal ties and military service commitments (where applicable) in your home country would support a temporary stay in Australia;
• Whether there is any civil or military unrest in your home country that would not support a temporary stay in Australia.

Your Potential Circumstances In Australia

• Incentives you may have to remain in Australia;
• Your knowledge of living in Australia.

Your Immigration History

• Whether there is anything in your immigration history that would not support an intention of a temporary stay in Australia. Further scrutiny will be applied if you have maintained ongoing residence in Australia on a range of short-term temporary visas

As a tourist visa holder, this aspect is likely to pose the highest risk for your student visa application. The Department will seek to confirm that you are not using the visa program to maintain ongoing residence in Australia and that you are a genuine student visa applicant.

The Value Of The Course To Your Future

• Whether the course is relevant and appropriate to your current employment and education background;
• Your future employment/career prospects.

Your Record Of Compliance With Previous Visa Conditions

• Your record of compliance with conditions of your current tourist visa, or other visas previously held;
• Your stated intention to comply with conditions for which the student visa is granted.

Any Other Relevant Matter

• The Department can take into account any matter it considers relevant in assessing whether you meet the GTE requirement which has not already been covered above. If there is some objective evidence or reason to doubt your genuineness as a student, the Department can conduct further enquiries, as required, in making its assessment

As part of your student visa application, you should prepare and submit a signed written statement to demonstrate that you satisfy the GTE requirement and address the matters listed above. This should be accompanied by supporting documentary evidence.

When Are You Not Permitted To Apply For A Student Visa In Australia?

In assessing your eligibility to apply for a student visa in Australia, you should carefully check your tourist visa grant notification letter to confirm whether visa condition 8503  has been imposed. The effect of this visa condition is as follows:

 ‘a visa holder will not, after entering Australia, be entitled to be granted a substantive visa, other than a protection visa, whilst the holder remains in Australia.’

Visa condition 8503 must be imposed if your visitor visa has been sponsored by a family member/relative.  The Department also has the discretion to impose this condition for non-family sponsored tourist visas.

Under the migration provisions, a person who is onshore and who, since last entering Australia, holds or has held a visa with no further stay condition 8503, is unable to make a valid visa application for any class of substantive visa (except for a protection visa or a specifically prescribed class of substantive temporary visa), even if the visa on which the condition was imposed has ceased to be in effect. In this case, you would be unable to progress from a visitor visa to student visa whilst you remain onshore; you would need to depart Australia and apply for a student visa (or any other visa, provided you are eligible from outside Australia).

This is unless the Minister or a delegate has waived the condition.

Therefore, If your tourist visa is subject to condition 8503, you can apply to the Department in writing to have it waived. To have this condition waived, you must satisfy Immigration that circumstances have developed since your tourist visa was granted that have resulted in a major change in your circumstances. This change in your circumstances must have been beyond your control and be compelling and compassionate in nature.

You must also request that condition 8503 be waived in writing (it is also open to a delegate of the Department to find that circumstances for a wavier exist and to waive the condition.

It is important to point out that if condition 8503 is waived, this does not necessarily mean that you are eligible to apply for any visa (including progressing from a tourist visa to student visa Australia whilst you remain onshore). You must still satisfy all valid visa application and visa grant requirements to be eligible for the visa.

What Are Compelling And Compassionate Circumstances?

For a waiver of condition 8503 to be granted, the circumstances that have developed since the visa was granted must be both compelling and compassionate .

According to immigration policy, compelling and compassionate circumstances would exist where they:

‘are sufficiently forceful and convincing for the condition to be waived; are not unreasonable; and give rise to feelings of sympathy for the suffering or misfortune of others.’

Compelling and compassionate circumstances may involve one factor only, or a number of factors. The Department will assess each waiver request on its merits.

Let us now revisit our central question posed at the beginning of this article, that is, how to convert visitor visa to student visa in Australia (that is, how to apply for a student visa whilst you remain onshore as the holder of a visitor visa). As you can see, the answer is not so simple. It can be a risky strategy to pursue, and may not even be an option if you are subject to visa condition 8503 on your visitor visa. It is therefore very important that you are fully informed about the relevant migration provisions, how they apply to you and the risks involved in seeking to progress from a tourist visa to student visa Australia. Many international students choose to stay on in Australia to complete further studies or gain a higher qualification (progressing from a bachelor degree to an honours year or masters degree, for example). Continuing your studies will enable you to maximise your time in Australia and gain more advanced qualifications and skills that will assist you in gaining employment. You may choose to continue studying at your current institution or move to a different institution (or even a different city) to try a new experience.

If you wish to continue your studies in Australia, you will need to:

• lodge an application for a new Student Visa from the Department of Immigration and Border Protection before your current visa expires
• make sure you have enough money to continue paying for your studies and living expenses
• extend your Overseas Student Health Cover (OSHC)
• apply for your chosen course by the deadline.

If you do not wish to travel, live or work in Australia after you graduate, you will most likely be returning to your home country. After years of living in Australia, it can be difficult to pack everything up and move. You will need to cancel services such as electricity, bank accounts and your mobile phone account; pay final bills; sell any large items that you can’t take home with you; and (if you are renting) end your lease and hand back the keys.

There are many reasons why international students may wish to stay in Australia after their studies are completed. Visit the Extending Your Stay section of the Department of Immigration and Border Protection website for more information.

If you don’t intend on completing further studies, you may wish to extend your time in Australia to work or travel. While you will no longer receive a student visa, there are a range of other temporary visa options that you can apply for through the Department of Immigration and Border Protection. You may wish to extend your stay for the following reasons:

• Travel: Many students decide to take a break when they finish their studies before they return home or start looking for a full-time job. Australia is a large, beautiful and diverse country — if you want to spend some time exploring the country, a Tourist Visa is a good option that will let you stay in the country for a period of up to three, six or 12 months. If you wish to work in order to fund your travels, you will need to apply for a Working Holiday Visa (see below).
• Attend your graduation ceremony: Those wishing to stay in Australia to attend their Australian graduation ceremony are also able to apply for a Tourist Visa from the Department of Immigration and Border Protection to extend their stay. Many Australian institutions also hold graduation ceremonies overseas, which may allow you to return home after completing your studies and attend a graduation ceremony closer to home.
• Take a working holiday: People aged between 18 and 30 from approved countries are able to apply for a Working Holiday Visa or a Work and Holiday Visa from the Department of Immigration and Border Protection, both of which allow you to work and travel in Australia for up to 12 months.
• Continue working for your current employer: If you wish to stay working with your current employer and they are willing to sponsor you either temporarily or permanently through the Department of Immigration and Border Protection's Employer Nomination Scheme , you are able to live and work in Australia for as long as you work for that employer.
• Gain pro fessional work experience: Engineering, accounting and computer science graduates are able to complete a Professional Year Program, which is a structured 12-month program designed to help them develop industry-specific skills through study and work experience. This program is ideal for students who want to qualify for permanent residency in Australia — those who complete a program earn an extra five points in the skilled migrant visa points test.
• Develop your skills: The Department of Immigration and Border Protection's Temporary Graduate Visa (Subclass 485) allows international students to remain in Australia for up to 18 months after they complete their studies to travel, gain work experience or improve their English language skills. This is a good option for students who wish to extend their stay for quite some time and work towards achieving permanent residency. The post-study work stream of this visa allows international students completing an Australian bachelor, masters or doctoral degree to remain in Australia to gain practical work experience after they graduate. Graduates of bachelor and masters by coursework degrees can apply for a two-year work visa at the completion of their degree; masters by research graduates are eligible for a three-year visa; and PhD graduates can apply for a four-year work visa.

Many international students enjoy their time in Australia so much that they apply for permanent residency so they can continue to live and work in Australia. You can express your interest in applying for permanent residency through the Department of Immigration and Border Protection's SkillSelect migration program , which could lead to permanent residency through a Skilled Independent Visa , the Employer Nomination Scheme or the Regional Sponsored Migration Scheme . After having your skills assessed through a points test (resulting in a points score), you may then be invited to apply for a visa. Those students who do not pass the points test or meet the requirements of SkillSelect may be able to complete further studies or apply for one of the temporary visa options above to stay in Australia and develop their skills.

Australian Visa Information

Unless you are an Australian citizen, you will need a valid Australian visa to enter the country. New Zealand passport holders can apply for a visa upon arrival in the country. All other passport holders, regardless of age, must apply for a visa before leaving home. You can apply for a range of Australian visa types, including tourist visas and working holiday visas, via the ETA app or on the  Department of Home Affairs website.

There are different Australian visa types available for travellers to Australia. Knowing which Australian visa to apply for depends on the length of your stay, your passport and the purpose of your visit. You’ll also need to meet certain financial and medical requirements, be outside of Australia when applying and maintain health insurance for the duration of your stay. 

Electronic Travel Authority visa  (subclass 601) This visa allows you to visit Australia as many times as you want, for up to a year, and stay for three months each visit. This visa is available to passport holders from a number of countries and regions, who live outside Australia. A step-by-step guide on how to apply is  here .

All ETA-eligible passport holders must apply for an ETA using the Australian ETA app. Agents can assist you in the application process, but you must be physically present as a live facial image is required.

eVisitor  (subclass 651) This is a free visa for multiple visits to Australia for tourism or business purposes for up to three months at a time within a 12-month period. This visa is available to passport holders from a number of European countries and it cannot be extended.

Visitor visa  (subclass 600) The Visitor visa allows you to visit Australia, either for tourism or business purposes. It is open to all nationalities. Generally, a period of stay of up to three months is granted, but up to 12 months may be granted in certain circumstances. Applicants will have to pay a fee to submit their application.

The application process may differ depending on which visa you need.

You can only apply for the  Electronic Travel Authority visa  (subclass 601) through the Australian ETA app. A step-by-step guide on how to apply is located  here .

For other visas, you can apply online by creating an ImmiAccount and completing the application process. Be sure to submit your application well in advance of your travel date to allow enough time for processing. You may be asked to provide further supporting information. You will be notified in writing if your tourist visa is approved and it will be digitally linked to your passport. If you are already in Australia and hold a valid Electronic Travel Authority visa (subclass 601) you can extend your stay by applying for another visa, such as a Visitor visa (subclass 600). An eVisitor (subclass 651) cannot be extended.

Working Holiday Visas

Australia's Working Holiday Maker program allows visitors aged under 30 (or 35 in certain cases) who hold a passport from a participating country to travel and work in Australia. Working holiday visas are valid for one year, or up to three years if you meet certain conditions.

Australia’s 6 New Student Visa Rules in 2024: Fully Explained

On 23rd March 2024, Australia brought in 6 new changes in the immigration laws for international students.

These changes are primarily aimed at identifying and sorting out genuine study-abroad aspirants and skilled graduates.

These new set of rules were brought in following a drastic 60% surge in immigration in 2023.

Let’s look in detail at these 6 new student visa rules.

1. Replacement of GTE with GS

Genuine Temporary Entrant (GTE) – Requires the student to submit a 300-word statement explaining why they want a temporary stay in Australia.

Genuine Student (GS) – Involves a set of questions to be answered in 150 words or less. This is for the immigration department to evaluate the student visa application.

Through the answers, students must demonstrate the genuineness of their;

• Current familial, career, and economic circumstances.
• Reason to select the preferred university and course in Australia.
• Career prospects of the chosen course.
• Previous employment and educational qualifications.
• Plans for the potential stay in Australia.
• History of immigration to Australia or any other country.

2. Revision of Language Eligibility Scores

The minimum score required to show English proficiency in IELTS or any equivalent examination has been increased. 

The score essential for Student Visa Subclass 500 has changed from an IELTS (or equivalent) score of 5.5 to 6.0. For Temporary Graduate Visa Subclass 485, it has been lifted from 6.0 to 6.5. 

Additionally, the validity of the examination is decreased from 3 years to 1 year for the Temporary Graduate Visa Subclass 485. 

3. Increased Financial Requirement

Prospective students planning for admission in Australian universities must now show savings of at least $29,710, which reflects a 21% increase from previous levels.

This change is introduced taking into consideration the increased cost of living for students studying in Australia. 

4. Reduction of Age Limit for Temporary Graduate Visa

Effective from 1 July 2024, the maximum age limit for individuals applying for the Temporary Graduate Visa (Subclass 485) will be lowered to 35 years . Earlier the age limit was till 50 years.

5. The ‘No Further Stay’ Condition

International students who have finished their study period and visa validity are not allowed to apply for another visa type such as a work visa or permanent residency while in Australia ( except for specific conditions approved by the Australian government). 

To convert to another visa category, international students must exit Australia and apply for it from their home country. 

Conditions Where Visa Extension Is Not Allowed

• Several international students who find less chances for permanent residency, extend their student visa by moving from course to course, particularly to courses that are below their current level of study, to prolong their stay in Australia.
• Also the government will restrict “Temporary Graduate Visa” holders from transferring back to student visas while onshore.

In order to restrict this visa hopping, the government has introduced stricter GS evaluation for students applying for a new student visa while in Australia.

• Graduates who are equipped with the skills enlisted in the Skilled Occupation List will be able to apply for the new Skills in Demand visa or a permanent skilled visa. The graduates who are not eligible must exit Australia and apply for it from their home country. 

6. Introduction of the “Skills in Demand” Visa

The “Temporary Skills Shortage (Subclass 482)” Visa is substituted by the new “Skills in Demand” Visa.

This visa offers three pathways for migrant workers namely;

• Specialist Skills Pathway
• Core Skills Pathway
• Essential Skills Pathway

Re-alignment of visa streams.

The Temporary Graduate visa streams will be re-aligned to better reflect the level of study of applicants:

• Post-Vocational Education Work Stream : Previously known as the Graduate Work stream , this stream is for those with an associate degree, diploma, or trade qualification closely related to an occupation on the Medium and Long-term Strategic Skills List (MLTSSL).
• Post-Higher Education Work Stream : Previously known as the Post-Study Work stream, this stream is for those with higher education qualifications, such as bachelor’s, master’s, and doctoral degrees.

Age Limit Reduction

One of the most notable changes is the reduction of the maximum eligible age for applicants from 50 to 35 years. This adjustment aims to attract younger, skilled graduates who can contribute to the Australian workforce for a longer period.

Exceptions :

• Hong Kong and British National Overseas (BNO) passport holders remain eligible to apply up to the age of 50.
• Masters (research) and doctoral degree (PhD) graduates are also exempt from the new age limit and can apply up to the age of 50.

Stay Duration Adjustments

The duration of stay for the Temporary Graduate visa has been updated to reflect the qualification level:

Second Post-Higher Education Work Stream

The Second Post-Study Work stream will be renamed to the Second Post-Higher Education Work stream. There are no other changes to this stream.

Replacement Stream Discontinuation

The Replacement stream will cease to exist under the new changes.

Australia temporary graduate visa rules for international students modified!

The graduate work stream will be renamed to the post-vocational education work stream..

The Australian Government announced changes to the Temporary Graduate visa programs in its recent Migration Strategy. These changes are intended to take effect from July 1, 2024. A temporary Graduate visa is a temporary visa that allows international students to live, study, and work after they have finished their studies. Graduate Work stream, Post-Study Work stream, Second Post-Study Work stream, and Replacement stream are the four types of Temporary Graduate visa.

Temporary Graduate Visa Streams Modified

The Graduate Work stream will be renamed to the Post-Vocational Education Work stream and the Post-Study Work stream will be renamed to the Post-Higher Education Work stream. The restrictions for applicants whose first Student visa was granted because of an application made before November 5, 2011 will no longer apply.

Your qualification to meet the Australian study requirement determines the stream you can apply for. Other qualifications you hold will not be considered to determine eligibility.

You should apply for the Post-Vocational Education Workstream with an associate degree, diploma, or trade qualification. The qualification you use must be closely related to your nominated occupation on the Medium and Long-term Strategic Skills List (MLTSSL). You should apply for the Post-Higher Education Workstream if your qualification is degree level or higher.

Eligibility for the Temporary Graduate visa before the proposed changes

The applicants must have completed their qualification and lodged their Temporary Graduate visa application before July 1, 2024. Further, the aplicants must meet the Australian study requirement, and also meet the eligibility requirements for the stream applied for. They also need to provide evidence from their education provider of the date of course completion, prior to visa decision.

The ‘completion’ date means the date on which the academic requirements for the award of the degree, diploma or trade qualification were met and does not include the formal conferral of the degree, such as through graduation.

Any applications lodged on or after July 1, 2024 will be assessed under the new requirements.

Post-Vocational Education Work stream (former Graduate Work stream)

The maximum eligible age for Post-Vocational Education Work stream applicants will reduce to 35 years of age or under at the time of application. Hong Kong and British National Overseas passport holders will still be eligible if they are under 50. Applicants who are no longer eligible for the Post-Vocational Education Work stream due to the age reduction may qualify for other visas.

Applicants may continue to stay for up to 18 months. Hong Kong or British National Overseas passport holders may be able to stay for up to 5 years.

Post-Higher Education Work stream (former Post-Study Work stream)

The maximum eligible age for Post-Higher Education Work stream applicants will reduce to 35 years of age or under at the time of application. Masters (research) and doctoral degree (PhD) graduates and Hong Kong and British National Overseas passport holders will still be eligible if they are under 50 years of age. Applicants no longer eligible for the Post-Higher Education Work stream due to the age reduction may be eligible for other visas.

The ‘select degree’ 2 year extension will cease. From July 1, 2023, a two-year extension of post-study work rights was available for international graduates enrolled in eligible courses including teaching, nursing, and engineering.

Stay periods will change to the following:

Bachelor degree (including honours) – up to 2 years Masters (coursework and extended) – up to 2 years Masters (research) and doctoral degree (PhD) – up to 3 years. Hong Kong and British National Overseas passport holders may be able to stay for up to 5 years.

Stay periods for Indian nationals, as agreed in the Australia- India – Economic Cooperation and Trade Agreement (AI-ECTA), remain as:

Bachelor degree (including honours) – up to 2 years Bachelor degree (with first class honours in STEM, including ICT) – up to 3 years Masters (coursework, extended and research) – up to 3 years Doctoral degrees (PhD) – up to 4 years.

The Second Post-Study Work stream will be renamed the Second Post-Higher Education Work stream. There are no other changes to this stream. Second Post-Study Work stream visa is for holders of a Temporary Graduate visa (first Post-Study Work stream or Replacement stream) who graduated with a degree from an Australian institution located in a regional area. The Replacement stream for current and former Temporary Graduate visa holders who lost time on their original visa due to COVID-19 travel restrictions will cease.

Nestled off the southern coast of the mainland, Tasmania boasts pristine wilderness, rugged coastlines and captivating wildlife.

With English as the primary language and a culture of warmth and hospitality, American travelers will find themselves instantly at ease. But don't be fooled, the island's allure lies in its breathtaking sights.

From exploring ancient rainforests to indulging in culinary surprises, Tasmania promises an unforgettable escape. I visited the island for the first time in May, the start of Australia's winter, and my jaw was on the floor most of the time there. Here's what you need to know before planning your own trip to Tassie.

1. The flights are exactly what you'd expect

There are no direct flights from the U.S. to Tasmania. You'll have to connect through Sydney or Melbourne to Launceston or Hobart. I went from Washington, D.C., to San Francisco to Melbourne to Launceston. It was terrible, I'm not going to lie. Next time I go, I'll spend a day on the West Coast before taking the U.S.-Australia 14-hour flight.

My recommendation is to take a red-eye flight to Australia and use it to sleep and switch over time zones.

Flight availability from the U.S. to Melbourne and Sydney (to transfer to Tasmania) is plentiful, with several major airlines offering regular routes. Travelers can choose from direct flights departing from major U.S. cities like Los Angeles, San Francisco, Houston, Dallas and even New York (with direct service to Auckland). Airlines such as United, American, Delta, Hawaiian, Qantas and Air New Zealand provide nonstop services.

(New direct service from Dallas to Brisbane via American Airlines is expected to launch in October, and from Los Angeles to Brisbane via Delta in December.)

2. Americans need a visa to enter the country

American travelers should be aware of the visa requirements before heading down under.

U.S. citizens need an Electronic Travel Authority (ETA) or an eVisitor visa, which can be easily obtained online before departure.

The process is straightforward, typically requiring basic personal information and a valid passport. Once approved, the visa allows for multiple entries into Australia for up to 90 days at a time over a 12-month period. I downloaded the Australian ETA app ( iOS and Android ), filled out a quick application, and my visa was granted in less than an hour.

3. Don't fret about the time zone difference

There's a 14-hour time difference from the U.S. East Coast. It sounds complicated but just embrace it.

The unique advantage of Tasmania’s 14-hour time difference is that you can truly disconnect and savor your vacation. The time zones down under can offer the perfect balance of relaxation and connectivity. Travelers can immerse themselves in the serene landscapes and vibrant culture during the day while still having a few hours in the morning and evening to connect with loved ones back home. It’s the ideal scenario for those seeking to unwind without completely losing touch.

4. Connection with nature

Travelers can immerse themselves in Tasmania's breathtaking nature through a variety of experiences.

At Cradle Mountain in Lake St. Clair National Park, visitors can hike rugged trails and take in stunning alpine views. If you visit at night, you can enjoy a view of cute wildlife with McDermotts Coaches .

I f you hold an American passport , you're likely used to traveling internationally with relative ease. Therefore, you may be surprised to learn that many countries require Americans to jump through some hoops to visit in the form of obtaining a visa.

Beginning in January, 13 countries will issue American citizens a visa to visit as tourists. Note this list does not contain information regarding countries that the U.S. Department of State has advised U.S. citizens to refrain from traveling to by issuing Level 4 alerts. It also does not detail destinations that are not currently issuing visas for Americans.
