Without the option of an ITC, a 5% GST is applied to the gross tour price, while an 18% GST rate is applied with ITC. These various rates have an impact on the total pricing for both travellers and tour operators.

Scope of taxation on tours and travels 

The  Goods and Services Tax (GST) regulations provide tour operators with three different ways to operate and claim input credits.  Input tax credit (ITC) in GST refers to the tax amount that businesses can subtract from the tax owed on the purchase of goods and services.

Here is a detailed explanation:

  • Acts as a tour operator with no ITC:  A tour operator charges 5% GST to the customer on the total package but does not claim any ITC. 
  • Acts as a tour operator and claim ITC:  The tour operator charges 18% GST to the customer on the total package and claims ITC. Although, it is important to consider the place of supply rule when claiming ITC. 
  • Acts as a pure agent:  The tour operator acts as an intermediary and raises an invoice to the customer charging 18% GST. However, the entity's role is that of a facilitator, and the actual expenses incurred for services like travel, hotel, and boarding are separately mentioned on the invoice and taken as reimbursements from the customer. The tour operator must maintain proper records of these expenses.

Value of supply for GST on tours and travels

If a tour operator works as a pure agent, then they can exclude the expenses incurred by the service provider from the value of their supply . This allows for a more accurate determination of the tax liability and ensures that the tax is levied only on the actual service provided by the pure agent.

Time of supply for GST on tours and travels

The  time of supply for GST depends on whether the tour operator is acting as a pure agent or not. 

If they are not acting as a pure agent, the GST should be charged and paid at the time of payment or issuance of the invoice, whichever occurs earlier. In such cases, the tour operator should recognise its revenue on a payment basis for GST purposes.

However, if the tour operator opts to act as a pure agent, the GST should be charged at the time when the final invoice is raised or when the commission is received, whichever happens, earlier. 

Place of supply for GST on tours and travels

When making a hotel reservation, the  place of supply is the city in which the hotel is located, and the hotel will include GST in its invoice. However, the company cannot claim ITC on that specific invoice if it is not registered for GST in the place of supply.

The same applies to flight tickets, where the place of supply is the place of flight departure. If the tour operator is not registered under GST in the state from which the flight departs, ITC cannot be claimed for that invoice.

GST on tours and travels with HSN code

Under Heading 9985 of the GST Tariff Act, the applicable GST rate for tours and travel services is 5% if the following conditions are met. 

  • The tour operator providing the services will not be eligible for ITC on services like hotels, air tickets, etc. However, ITC can be claimed on tour operator services obtained from another tour operator.
  • The tour operator must indicate in its invoice that the charged amount is the gross amount and includes charges for accommodation and transportation.

In case the tour operator chooses to charge GST at the rate of 18% on the total amount, it will be eligible to claim ITC on various services such as rent, professional fees, lease lines, telephone, etc.

Cbdt’s faqs/clarifications on tcs for lrs & overseas tours.

The Central Board of Direct Taxes (CBDT) recently issued Circular 10/2023 on June 30th, 2023, providing valuable clarifications and FAQs regarding the implementation of changes related to Tax Collection at Source (TCS) on the Liberalised Remittance Scheme (LRS) and the purchase of overseas tour program packages. This article aims to discuss the key points from the circular and provide insights into the implications of these clarifications.

CBDT Income Tax Circular 10/2023 dated 30/06/2023: FAQs/ Clarifications on TCS for LRS & Overseas Tours

1. No TCS on Expenditure through International Credit Cards

One of the significant clarifications is related to the use of international credit cards while being overseas. As per the circular, the classification of such transactions under LRS is postponed until further notice. Consequently, no TCS shall be applicable on expenditure made through international credit cards while being overseas until a subsequent order is issued.

2. Combined Threshold of Rs 7 Lakh Applicable for TCS on LRS

The circular addresses the common query about whether the threshold of Rs 7 lakh for TCS to become applicable on LRS applies separately for different purposes such as education, health treatment and others. The circular clarifies that the threshold of Rs 7 lakh is a combined threshold for the applicability of TCS on LRS, irrespective of the purpose of the remittance. This clarification is based on the first proviso to sub-section (1G) of section 206C of the Act, which states that TCS is not required if the remittance amount or aggregate amount is less than Rs 7 lakh in a financial year. The recent amendment by the Finance Act, 2023 restricted this threshold to education and medical treatment purposes. However, with the latest press release, the previous threshold of Rs 7 lakh is reinstated, applying to all purposes.

To provide a practical example, remittances up to Rs 7 lakh under LRS during a financial year will not be liable for TCS. However, any subsequent remittance beyond Rs 7 lakh under LRS will be subject to TCS based on the applicable rates. The TCS rates will depend on the time of remittance, as the rates change from October 1st, 2023. Here is a breakdown of the applicable TCS rates:

i) The first Rs 7 lakh remittance under LRS during the financial year 2023-24 for education purpose (or any purpose) – No TCS applicable.

ii) Remittances beyond Rs 7 lakh under LRS during the financial year 2023-24, if made on or before September 30th, 2023 – TCS at 5% (unless it is for education purpose financed by a loan from a financial institution, in which case the rate is 0.5%).

iii) Remittances beyond Rs 7 lakh under LRS during the financial year 2023-24, if made on or after October 1st, 2023 – TCS at 0.5% (for education purpose financed by a loan from a financial institution), 5% (for education or medical treatment), and 20% (for other purposes).

3. Rs 7 Lakh Threshold per Financial Year

Another common query addressed in the circular is whether the threshold of Rs 7 lakh for TCS to become applicable on LRS applies separately for each six-month period of the financial year, in view of different TCS rates applicable for first six months up to 30th September, 2023 and next six months beginning from 1st October, 2023. The circular clarifies that the threshold of Rs 7 lakh applies for the entire financial year and is not separate for each six-month period. Therefore, if the threshold of Rs 7 lakh is crossed at any point during the financial year, TCS will be applicable on the remittance amount exceeding Rs 7 lakh.

4. Rs 7 Lakh Threshold for Remitter and not for Authorized Dealer

The threshold of Rs 7 lakh for Tax Collected at Source (TCS) under the Liberalized Remittance Scheme (LRS) applies to the remitter and not to the authorized dealer. This means that if the amount or aggregate of amounts being remitted by a buyer is less than Rs 7 lakh in a financial year, TCS is not required.

As of now, the Reserve Bank of India (RBI) is still developing the facility to provide real-time updates of remittances under LRS by the remitter. Therefore, authorized dealers can obtain details of earlier remittances made by the remitter during the financial year through an undertaking at the time of remittance. If the authorized dealer correctly collects the TCS based on the information provided in the undertaking, they will not be considered as “assessee in default.” However, if false information is provided in the undertaking, appropriate action can be taken against the remitter under the Income Tax Act.

The same methodology of obtaining an undertaking from the buyer of an overseas tour program package can be followed by the seller of such a package.

5. Independent Thresholds for TCS on LRS and Overseas Tour Packages

The circular clarifies that the threshold of Rs 7 lakh for TCS under LRS and the threshold of Rs 7 lakh for the purchase of overseas tour program packages are independent of each other. These thresholds should not be confused or combined. Each threshold applies separately based on the corresponding provisions, to determine the applicable TCS rate as 5% or 20%.

6. TCS on Rs 3  Lakh Remitted under LRS for Overseas Tour ?

If a resident individual spends Rs 3 lakh on an overseas tour program package purchased from a foreign tour operator and remits the money under the Liberalised Remittance Scheme (LRS), Tax Collection at Source (TCS) provisions for the purchase of the tour program package will apply, rather than the TCS provisions for remittances under LRS.

Since the threshold of Rs 7 lakh for TCS applicability under LRS does not apply to the purchase of an overseas tour program package, TCS is applicable and the seller is responsible for collecting the tax. In this case, the tax will be collected at a rate of 5% since the total amount spent on the tour program package during the financial year is less than Rs 7 lakh. The seller should collect the TCS amount from the buyer.

7. Scope of Remittance under LRS for Medical Treatment and Education

A. medical & health treatment:.

The scope of remittance under LRS (Liberalized Remittance Scheme) for medical treatment purposes includes the following:

i) Remittance for purchasing tickets for the person receiving medical treatment and their attendant to travel between India and the overseas destination.

ii) Medical expenses incurred during the treatment.

iii) Day-to-day expenses required for the purpose of medical treatment.

It’s important to note that under the RBI (Reserve Bank of India) master direction for LRS, the code 50304 (under the Purpose Group Name “Travel”) is used for remittance related to medical treatment. This code covers transactions related to health services, including medical services, healthcare, food, accommodation and local transport, for residents traveling abroad for medical reasons.

Additionally, the code 51108 (under the Purpose Group Name “Personal, Cultural & Recreational services”) covers transactions for health services rendered remotely or on-site, without any travel by the service recipient. This includes services from hospitals, doctors, nurses, paramedical professionals and similar services.

B. Education

For remittance related to education purposes, the scope includes:

i) Remittance for purchasing tickets for the person undertaking study overseas to commute between India and the overseas destination.

ii) Payment of tuition fees and other fees required by the educational institute.

iii) Other day-to-day expenses necessary for the study.

Under the RBI master direction for LRS, the code 50305 (under the Purpose Group Name “Travel”) is used for remittance related to education, including fees, hostel expenses, etc. This code covers education-related services such as tuition, food, accommodation, local transport and health services acquired by resident students while residing overseas.

Similarly, the code 51107 (under the Purpose Group Name “Personal, Cultural & Recreational services”) covers transactions for education, such as fees for correspondence courses abroad, where the person receiving education does not travel overseas.

TCS (Tax Collected at Source) provisions apply when remittance is made under the codes 50304 or 51108 for medical treatment and under codes 50305 or 51107 for education purposes.

8. TCS on Purchase of Overseas Tour Program Packages

To determine the applicability of TCS on the purchase of overseas tour program packages, the circular provides specific guidelines. It states that the purchase of only an international travel ticket or hotel accommodation on a standalone basis does not qualify as an “overseas tour program package.” To be considered as such, the package must include at least two components from the following:

i) international travel ticket,

ii) hotel accommodation (with or without food, boarding/lodging, etc. ), or

ii) any other similar expenditure.

If the total amount spent on an overseas tour program package is less than Rs 7 lakh during a financial year, TCS will be applicable at a rate of 5%.

These clarifications offer valuable guidance to taxpayers, authorized dealers and other stakeholders involved in these transactions. It is crucial for individuals and businesses to understand and comply with the TCS provisions to ensure smooth and lawful cross-border transactions under LRS and the purchase of overseas tour program packages.

Services Provided by Tour operators & Travel agents – A GST Perspective

Brief Background

Tour Operator (hereinafter referred as Service Provider) provides services to the ultimate consumers (Recipient) through various counterparts such as the Airline companies, local taxi operators, hotel, embassy issuing visas and many other services. The major sources of Income for Tour Operators are:

1. Domestic/ International Hotel Bookings

2. Air Ticket & Commission from Airlines Companies

Travel agent ready to serve in choosing and selling tour, cruise, airway or railway tickets or vacation package

3. Sale Tour Packages

4. Travel Related Services like Visa, Passport, etc.

5. Railway Reservations

6. Car Rental Services, Travel Insurance

With reference to the provisions of the Central Goods and Services Act, 2017 (“CGST”) and Integrated Goods and Services Tax Act, 2017 (“IGST”) services made by travel agents are analyzed through the consequent framework:

Definitions

“Tour agents” or “Tour operator” means any person engaged in the business of planning, scheduling, organizing, arranging tours (which may include arrangements for accommodation, sight-seeing or other similar services) by any mode of transport and includes any person engaged in the business of operating tours”.

– Based on the Entry No. 23 of Notification No. 11/2017 – Central Tax (Rate)

An Overview

1. Domestic/International Hotel Bookings:

A . In case of domestic hotel booking Tour, operator is acting as an intermediary for the purpose of booking tours and hence Place of supply will be the Location of Hotel.

B. In the case of international booking Place of supply shall be location of agent.

Place of supply:

> When Agent receives commission from Hotel/ Cruise:

  • If hotel/cruise is located in India then POS of the agent will be the location of hotel/cruise.
  • If hotel/cruise is located outside India then POS of the agent will be the location of agent.

> When Agent receives commission from the recipient:

  • If recipient is registered then the place of supply of the agent will be the location of the recipient.
  • If recipient is unregistered then the place of supply of the agent will be the location of Hotel/Cruise.

A. Air travel agents are required to pay 18% GST on commission earned from airlines and also service charges, handling charges etc. (by whatever name called) collected from the customers/ passengers.

B. Air travel agents can avail ITC on input services to support the output services of travel agents.

C. As an alternative to GST payment in the above manner, rule 32 (3) of CGST rules, 2017 permits an air travel agent to discharge GST at fixed percentage of basic fare on which commission is normally paid by the airlines to the agent

Place of supply of service:

> In case travel agent receives processing fees/ service charges from passengers place of supply of Air travel agent Location of recipient weather or not the recipient is registered or not.

> In case travel agent receives commission from airlines place of supply of Air travel agent Location of airlines.

3. Sale of Tour Packages  

A. Both Service provider and Recipient in India:

 B. Either of them outside India:

1. Tours organized by the tour operator, within India for the tourist coming from abroad is generally known as inbound tours .

Commission Basis

4. Travel Related Services like VISA, Passport, etc.

A. VISA processing charges charged by visa statutory authorities will be exempt from GST.

B. If visa/ passport is obtained from Visa Facilitation Centers (VFCs) then the same shall be liable to tax.

C. However, when Air travel agent provides these services to their clients after adding further fees, he shall be liable to pay tax on them as well he can take ITC of the tax paid to VFC.

D. GST will be applicable at 18% for the services provided by Air travel agent.

A. Rail travel agent are required to pay 18% GST on service charges collected from passengers.

B. SAC for Rail travel agent is 9967.

Foreign Railway Booking

6. Car Rental Services

GST applicable for renting motor vehicle shall be at 5% without ITC or at 12% with ITC.

If the aggregate commission income is less than 10K, just declare it u/h. 'IFOS' ....

But if regular agent, better declare income u/h. PGBP

Air travel agent is getting commission from various comapies of more then 10000 and TDS is also deducted on it, and travel agency is his major source of income. So whether i should go for PGBP or IFOS. If PGBP is opted then can we file it under 44AD?

Travel agent can select ITR-3 without any contradiction.because normally a travel agent have more cash deposit for less profit.no audit required reciving acommissin from agencys only.when this commission and profit will cross morthan 20 lacs he have to register under GST.sorry for any mistake in my comment.i am nota CA..thanks.

Which purchases count as travel with Chase Sapphire Preferred and Chase Sapphire Reserve?

Thanks to its plethora of premium travel perks, the Chase Sapphire Reserve® is well-known in the travel credit card space. The Chase Sapphire Preferred® Card is the Sapphire Reserve's mid-tier sibling that features a $95 annual fee — which is also the more affordable card considering the Reserve's annual fee is $550 — and remains a top pick, winning Best Travel Rewards Credit Card for the sixth straight year at the 2023 TPG Awards .

No matter which Sapphire card you have, Chase clearly defines what counts as travel. Both cards generously award for travel booked through Chase Travel℠ and all other travel purchases.

We'll go over the purchases that count (and don't count) toward earning bonus points in this guide.

How many points do the Chase Sapphire Reserve and Preferred cards earn on travel?

The Chase Sapphire Reserve awards 10 points per dollar on hotels and car rentals booked through Chase Travel and 5 points per dollar on flights booked through Chase Travel.

But suppose you're looking to book directly with the airline, hotel or another company or get awarded for other travel purchases like taxi rides and parking fees. In that case, you'll still earn 3 points per dollar on these purchases.

The Sapphire Preferred earns 5 points per dollar on all travel purchases booked through Chase Travel and 2 points per dollar on other travel purchases.

You'll also earn a boosted rate of 10 and 5 points per dollar spent on Lyft rides on the Reserve and Preferred, respectively (through March 2025).

'Travel,' according to Chase

The Chase Travel portal allows you to book various types of travel. For "all other travel purchases," here's how Chase defines it:

Merchants in the travel category include airlines, hotels, motels, timeshares, car rental agencies, cruise lines, travel agencies, discount travel sites, campgrounds and operators of passenger trains, buses, taxis, limousines, ferries, toll bridges and highways, and parking lots and garages.

Compared to bonus categories from other credit cards, Chase's travel category is extremely generous.

While cards such as the American Express® Gold Card and The Platinum Card® from American Express offer bonus points for airfare purchases made directly with the airline (with a spending cap of $500,000 on the Amex Platinum per calendar year, then 1 point per dollar), the Sapphire Preferred and Sapphire Reserve cards let you earn a bonus on virtually every trip-related charge.

The travel category encompasses a wide variety of purchases, from hotels and airfare (which doesn't have to be booked directly with the airline) to cruises, tolls and even parking fees. Uber and Airbnb purchases count as travel as well.

The following purchases do not apply toward the 2 or 3-points-per-dollar bonus categories on these cards, but most of them shouldn't be a huge surprise or disappointment:

Merchants in this category include airlines, hotels, motels, timeshares, car rental agencies, cruise lines, travel agencies, discount travel sites, campgrounds and operators of passenger trains, buses, taxis, limousines, ferries, toll bridges and highways, and parking lots and garages. Some merchants that provide transportation and travel-related services are not included in this category; for example, real estate agents, educational merchants arranging travel, in-flight goods and services, on-board cruise line goods and services, sightseeing activities, excursions, tourist attractions, RV and boat rentals, merchants within hotels and airports, public campgrounds and merchants that rent vehicles for the purpose of hauling. Purchases from gift card merchants or merchants that sell points or miles will not qualify in the travel category.

A few notable travel-related charges that have not been posted as travel for the purposes of bonus points with Chase for TPG staffers in the recent past include an RV rental as well as some vacation rentals via Vrbo and similar services. Whether a vacation home rental automatically codes as travel depends on whether an individual or a conglomerate operates it. In the latter case, that charge may code as "professional services" instead of travel.

If you're ever unsure whether a given purchase counts as travel, it could be worth making a small charge and checking whether it earns any bonus points on your online Chase account.

Additionally, suppose you feel like a travel purchase should have earned bonus points but didn't. In that case, you can always try calling or secure messaging Chase and requesting consideration for that charge to be awarded points as a travel charge. Even if you don't get the outcome you're looking for, you'll at least get some clarity on how certain charges are coded and can plan future spending accordingly.

  • Onboard cruise line goods and services
  • Purchasing points or miles
  • Public campgrounds
  • Real estate agents
  • RV and boat rentals
  • Sightseeing activities
  • Tourist attractions
  • Vacation rentals ( some VRBO rentals operated by a conglomerate rather than an individual )

Bottom line

Cardholders of the Chase Sapphire Reserve and Chase Sapphire Preferred have plenty of opportunities to earn 3 or 2 points per dollar spent, respectively, on "other travel purchases." Based on TPG's valuations , that means you could be getting a return of up to 6.15% on these purchases, and you can put your points to use with Chase's airline and hotel partners .

On top of that, these Chase cards have some of the most generous travel and purchase protections on the market, making either card a valuable addition to your wallet.

ToursTravel is a group project for Application Programming for the Internet unit developed entirely with laravel.

Setting up the project locally;

  • git clone https://github.com/muchaisam/Tours-Travel

change directory to the project 2. cd Tours-Travel

Install composer dependencies

Create a copy of the .env file

  • cp .env.example .env

Generate the app's encryption key

  • php artisan key:generate

Create an empty database for the application

After this, in the .env file, add database information to allow Laravel to connect to the database

  • In the .env file fill in the DB_HOST, DB_PORT, DB_DATABASE, DB_USERNAME, and DB_PASSWORD options to match the credentials of the database you just created.

Migrate and seed the database

  • php artisan migrate | php artisan db:seed

Run the application

Very good app. Maps need improvement

Overall, I think this app is pretty well put together, and anyone visiting a National Park or NPS-maintained site should have this app downloaded. It is very nice that you can download individual parks for offline use. This is especially helpful for parks where there might not be cell service. However, there are a couple things that I would change about the app. First, there should be a way to link your park passes (daily entry, tours, A the B, etc.) to the app. That way you can have everything organized in one place. Second, the maps for individual parks, especially the larger ones, are way too cluttered. Using Yellowstone as an example, there are 515 unique markers on the Yellowstone map. Before it was shuttered, the old Yellowstone app had the PERFECT setup for the map. It would have large markers for the most used points of interest (Old Faithful, Grand Prismatic, Mammoth Hot Springs, etc.), while having smaller markers for less used points (trailheads, vault toilets, picnic areas, etc.) Then, when you zoomed out on the map, you would only see the large, important markers. As you zoomed in, the smaller, less used markers would appear. This helped tremendously by keeping the map from being too littered with markers and by making it easy to find the famous points of interest that most people will be looking for.

Useful app but info not available from other devices

The information on the NPS Park app is very helpful. It contains detailed information about the parks, history, access, parking, lodging, and other amenities. A few areas of improvement would be: 1. to be able to retrieve information saved on one device from another device For example, if you save all the parks that you have visited over the years onto one phone, you can’t retrieve it from a tablet or laptop. On top of which once you get a new phone there’s no way to transfer the information. You have to enter it all over again since there’s no way to retrieve that history. 2. The app has a lot of good information but is not the most intuitive to navigate. Frequently you are told where you can locate information, but there is no link provided to let you go to that page. 3. A note to the NPS developers. While there are buttons on each page that ask whether the page was helpful, there is no place to provide general feedback so that the end-user could provide suggestions.

Awesome start. Hoping for many more features.

Honestly this is one of my favorite apps. Even if I’m not traveling, I like to load the app and explore parks from afar. I love how much love and energy went into this app. It’s obvious that the content comes from people who love the parks as much as we do. Here’s what I’d love to see: Improve offline access: being able to save parks for offline use is awesome. However, the app spends a really long time trying to load when you don’t have internet access before finally giving an error message and then loading after a delay. I wish the app would start in offline mode (offline is default) and then access the internet once the app is loaded. Sort by ability or activity level: I wish I didn’t have to load every single item in a list to see if a trail or thing is ADA accessible. Maybe add an icon to the items on a list… or add a filter. Passport stamp locations: I love this feature. Can the items on this list be clickable? Take me to the entry for that visitors center, so I can find info on accessing it. More pictures: I’m disabled and physical access can be an issue. It’s so cool to be able to see places I’ll never be able to visit. Show me the super advanced hikes I’ll never get to. And show us more wildlife we might have trouble seeing on our visit! I’ve got a million suggestions but you all are busy people. Thanks for making a cool app. Looking forward to updates.
