TSA Regulations

The Transportation Security Administration (TSA) is a US government agency responsible for upholding the security and safety of transportation systems, particularly air travel. Before boarding any flight in the United States, all passengers need to go through TSA checks.

Since TSA’s main priority is to keep travelers safe, actively searching for drugs is the least of their concerns. However, TSA regulation 2 currently states: marijuana products containing more than 0.3% THC on a dry weight basis are not allowed on flights. If you’re caught, by chance, during one of their standard screening procedures, the TSA will endorse you to a law enforcement officer. 

The rule is enforced regardless of what state you’re traveling to and from. 

Delta 8 TSA restrictions for products derived from hemp with less than 0.3% THC are unheard of. However, while most Delta-8 products are derived from hemp rather than marijuana, this distinction might not always guarantee a trouble-free experience at airport security checks. It is ultimately up to the TSA agent’s discretion to decide what steps to take next.

In general, it’s best to leave your Delta-8 products at home when traveling internationally, even if it’s legal in the country you’re traveling to. This is because you’ll have to go through customs when entering your destination country. Many countries will not allow cannabis products through customs due to international trade restrictions. 

If you’re caught traveling with Delta 8 into a country where it is illegal, you could face harsh financial or even legal consequences. 

How to Fly with Delta 8

If you’re planning to travel with Delta-8, be aware of the airline’s protocols and state regulations. Also, regardless of what type of product you’re taking, be discreet about it. Avoid using it in the airport or on the aircraft. As mentioned above, it’s best to stick to products with less than 0.3% THC to adhere to TSA’s current guidelines. 

If you want to erase the general anxiety of traveling with a cannabis product on-air, consider purchasing alternatives once you reach your destination. Many states sell variants of Delta-8 products, and you might be able to find something similar to yours.

Containers must be sealed and kept in a small plastic bag. You can bring a larger size if you take the tincture in a carry-on bag. However, keeping the tincture in a plastic bag is important to prevent it from spilling on the rest of your luggage. 

Similar to Delta-8 gummies , it’s crucial to anticipate the possibility of your tincture being taken at security checkpoints. Confiscation is ultimately up to the discretion of the TSA agent. Because of this, it’s best to avoid flying with tinctures.

As a regular user, it may seem natural to bring delta 8 products along wherever you travel. Maybe you just aren’t in the mood to abstain for a few days. You might also use delta 8 THC to help you sleep or as a travel-related stress aid.

Traveling with cannabis has always been a minefield. If your product contains over the limit of 0.3% delta 9 THC, it’s illegal to carry over state lines. This also applies to medical marijuana. Legal cardholder or not, marijuana is federally a Schedule I drug. You can’t fly with it on hand, even if your destination has legal weed.

While you probably won’t be arrested for bringing delta 8 carts on an airplane, there are some major caveats. Any hemp product you bring on a US flight can be confiscated at the discretion of a Transportation Security Administration (TSA) employee.

The legality of hemp is still complicated. While the 2018 Farm Bill legalized hemp-derived products containing less than 0.3% THC, not everyone understands the ins and outs of this loophole—including TSA agents. International travelers have no legal protection either. Anyone can find themselves in a tough situation if found in possession of cannabis products .

Current TSA delta 8 policy (2023)

United States hemp laws have evolved rapidly, and so have policies issued by national and global institutions. Staying up to date can prevent accidental violations.

As of August 2023, the TSA’s “What can I bring?” checklist doesn’t directly reference delta 8 or most hemp products. CBD oils are mentioned , as some contain over the federal limit of THC. However, airline passengers may still run into problems with delta 8 THC.

TSA employees don’t check bags specifically looking for drugs, marijuana, or paraphernalia. But just because agents aren’t going out of their way to search for something, don’t assume they won’t notice it. Oil carts or a small tincture bottle may be enough to pique suspicion.

Hemp products are a gray area within the TSA’s policies. Although they’re not addressed in any public documentation, airport employees will use their own discretion when assessing passengers’ belongings. For the smoothest ride, leave any cannabis products at home, including non-intoxicating substances like CBD .

Agents are required to contact local authorities if they discover marijuana and delta 9 derivatives in a passenger’s luggage. Hemp may be falsely flagged, leading to an ordeal that no one has time for during their trip.

All reputable hemp manufacturers will provide a detailed description of the product’s cannabinoid content, including the exact amounts of delta 8 and delta 9 THC.

Dos and don’ts of traveling with delta 8

We don’t recommend bringing cannabis products of any kind on a flight. Delta 8 is legally evolving, and possession could cause problems with the TSA and local law enforcement, even if an arrest is unlikely. It’s up to you whether or not to take that risk.

You’re not explicitly breaking federal law or TSA policy by bringing delta 8 on a domestic flight, but it’s a gamble. Here are the procedures you’ll need to follow in doing so.

Carts and disposable vapes

Yes, you can fly with vape carts . Flyers must abide by Federal Aviation Administration (FAA) regulations if they’re looking to travel with vaping equipment of any kind.

First and foremost, you can’t store delta 8 disposables or vape pens in your checked luggage. These products must come on the plane with you, either in your carry-on or personal storage. Certain devices powered by a lithium battery need to stay on your person during a flight, as well as all uninstalled batteries. Disposable vapes and 510 thread batteries are subject to this rule, which is a precaution against fire.

Anyone who’s flown knows the TSA’s liquids policy by heart: containers can be no more than 100 mL (3.4 ounces) each, and they must be sealed inside a quart-sized plastic bag. Delta 8 tinctures are required to follow these guidelines.

As we’ll get into later, there have been at least two instances of travelers being arrested over hemp tinctures. Maybe that was bad luck, or maybe tincture bottles are more likely to catch the eye of TSA agents. We can’t say for sure, but it’s worth keeping in mind.

Can you take delta 8 on an international flight?

There’s no short answer here. Regardless of U.S. law or the TSA’s hemp policies, you’ll need to review the laws of your destination country too. We cannot stress this enough. Laws around marijuana, hemp, and their derivatives vary hugely between nations.

Some countries, such as Canada, are more lenient than the U.S. There are also plenty of areas across the globe where cannabis products are outlawed, and the punishment for possession or trafficking can be severe.

International travelers found with delta 8 might find themselves detained after arrival. Unlike in the United States, this situation can quickly lead to dire, long-term legal trouble. Citizens of a country with legal hemp aren’t protected on foreign soil.

Will you be arrested for bringing D8 on a plane?

Arrests at the airport did occur in the early days of federally legal hemp. Shortly after the 2018 Farm Bill’s passage, misunderstandings about hemp and its legal standing were even more rife than they are today. Just don’t expect TSA agents to be experts in cannabis law.

One infamous case involved a 71-year-old woman traveling to Oregon. She was arrested at a North Texas airport after non-intoxicating CBD oil was found in her travel bag. A similar instance happened at the same Texas airport, also back in 2019. A 22-year-old student ran into problems after a bottle of CBD oil was found in their possession . It’s not clear if the latter case led to an arrest.

It’s not known whether similar issues have occurred since then. If so, nothing appears to have been publicized. What we do know is that hemp arrests at the airport can happen, no matter how uncommon.

Can you bring delta 8 on a bus or train?

Alternative methods of travel are an option, but major bus or railroad companies aren’t clear about their stance on hemp products. Again, delta 8 isn’t outright barred, but the guidelines are murky at best.

Like the TSA, Amtrak and Greyhound have no written hemp policies at all. These services sometimes involve fewer security hoops, so if that helps you feel more secure, it’s worth considering.

Be wary if your station uses dogs to sniff out security threats—it’s more common than you’d expect. This could lead to your delta 8 being flagged. Just as in an airport, you may be detained or told to dispose of your products.

There’s no official TSA policy on hemp. Each agent uses discretion to permit, confiscate, or dispose of particular products. If an airport employee finds your delta 8 and asks you to throw it in the garbage, do as they’ve requested. It’s not worth missing your flight (or worse) over a vape cart.

According to the Agricultural Improvement Act of 2018 , the previous TSA rules banned all “marijuana and cannabis-infused products.” Still, the new rule makes an exception for “products that contain no more than 0.3 percent THC on a dry weight basis or are approved by the FDA.”

Federal law specifies that hemp products, including cannabinoids, isomers, and other extracts that contain less than 0.3% Delta 9 THC, are federally legal.

That means that Delta 8  is not a Controlled Substance and is instead a legal hemp product, and there’s nothing explicitly barring you from carrying Delta 8  on the plane.

In fact, TSA is not precisely concerned with sniffing out cannabis products. If they do happen to find illicit substances while searching your bags, however, their policy is to turn it over to local law enforcement.

Of course, even if your Delta 8  products are flagged as Delta 9 THC products by mistake, you’re going to be subject to interrogation while the products are being tested.

You'll also need to check the regulations provided by your airline of choice. Travelling by Car

When travelling by car, you need to make sure that Delta-8-THC is legal in every state you will pass through.

Aside from ensuring that Delta-8-THC is generally legal in each state, you also need to check out the general hemp laws. That's because Delta-8-THC may be legal in certain areas where specific types of hemp products are not.

It's fair to say that these restrictions may not apply to federally legal hemp products in states where they are also legal. For now, the overall atmosphere for Delta-8 on public transportation is unclear.

To date, no major transportation companies have made any public statements or amendments to their rules regarding hemp products. The best approach may be to reach out to these companies individually to understand the rules about carrying federally legal hemp products on board.

Delta-8-THC on Cruise Ships

Taking Delta-8-THC on a cruise ship is an even trickier feat. Most cruise ships don’t allow you to bring much in the way of mind-altering substances. Even alcoholic beverages, which are widely legal, are not typically allowed in your carry on bags.

In actuality, though, the rules on Delta-8 products are not so clear. Most cruise lines have spoken out against “marijuana products,” but have not made any announcements regarding hemp products since the 2018 Farm Bill separated hemp products from the legal definition used for “marijuana.”

For example, Carnival Cruise Line, amended their rules in November 2018 to suggest that passengers would be fined up to $500 for using cannabis on board. The rules state that a passenger could even be removed from the ship entirely, and would be responsible for the costs of transportation and other means to return home.

The policy states that “Carnival recognizes that some state and local governments in the U.S., and in the destinations we visit, might allow marijuana use. However, Carnival Cruise Line follows U.S. federal law, which strictly prohibits possession and use of recreational/medicinal marijuana and other illegal controlled substances.”

Because this statement seems to align Carnival Cruise Line with U.S. federal law, it’s reasonable to say that they may have a different outlook on hemp-derived products, but it’s no guarantee.

The same is true for other cruise lines, so it may be best to reach out to the company and ask about their Delta-8 policy before you make plans to travel with Delta-8. If you can’t get direct approval, you should probably just forgo Delta-8 for the trip.

Where to Store Delta-8-THC When Travelling

If you've determined that it's legal to take Delta 8 on your next trip, you may also be looking for tips on how to store it during your travels. Again, the best storage methods depend on your mode of travel, but the general rule of thumb is to keep Delta-8 in a sealed container and out of reach when you are operating a vehicle.

When travelling by car , you may reference the laws for driving with THC in states where cannabis is legal. It varies slightly from place to place, but the law generally requires drivers to leave THC products in their original, sealed containers and place them in the backseat or trunk.

I tried delta-8 THC: Here’s what it feels like

Delta-8 THC is one of the hottest topics in cannabis right now. It’s a minor cannabinoid that can get you high like traditional THC, but much less so. Delta-8 found in small amounts in the cannabis plant and is often converted from other compounds like CBD. If you haven’t heard of it yet, you surely will soon enough. 

Reason #1 that interest in delta-8 products is surging is its existence in a legal grey area: Delta-8 can be made from hemp. Thanks to the 2018 farm bill , cannabis with less than 0.3% THC is considered hemp, and anything that naturally derives from hemp is federally legal. 

That means if you convert hemp CBD into delta-8, you end up with a federally legal cannabis product that gets people high, although less high than traditional THC. Some states have begun to regulate delta-8, some not. (Read more on what delta-8 is and its legality .)

Reason #2 people are so curious about delta-8 is because it’s supposed to be a much less intense, much more approachable experience than the high you feel from consuming traditional cannabis with THC. 

So does it get you high? We put delta-8 to the test.

Is delta-8 less intense than THC?

To test out delta-8 THC, I slid to a dispensary in Portland, Oregon to grab up the 250mg pack (ten 25mg servings) of Smokiez Sour Blue Raspberry Gummiez . I chose Smokiez because their traditional gummies are some of my favorites, giving me a great comparative reference. Plus, when trying new products, it’s important to find reputable brands that you can trust to put out the good on a consistent basis. 

With delta-8 expected to have less intense effects than traditional THC, I decided to try them in separate doses of 50mg and 100mg, or two and four gummies, respectively. Activation time on the package said 45 minutes.

I took each dose on an empty stomach for the fastest onset time possible, and then allowed a period of four hours to pass, since edibles are expected to peak within 3-4 hours. I did not consume any other cannabis that day, so I started from a completely sober state.

Here’s my experience.

NOTE: The following experience is a single human trial, not a true scientific experiment. Experience with cannabis, frequency of use, and your body chemistry all come into play when deciding how high one will get. Consumption results may vary.

50mg dose experience

I ate the first dose at 10:30am, and after about 30 minutes, I started to feel the familiar head and body buzz that let me know there’s some weed in my system. Or excuse me, hemp.

The first thing to know before discussing the delta-8 experience is my tolerance. I chain-smoke joints all day, every day, with dabs tossed in the mix here and there. It would take a lot of weed to floor me at this rate. 

However, with traditional edibles, it tends to be the opposite. They always creep up on me because I forgot I ate them and then BAM—it’s Couchlock City, USA. That’s why I usually stay away from them.

That said, normally a 50mg dose of edibles would absolutely rock me to sleep within a couple of hours, but the delta-8 gummies produced a stimulating, sort of energetic experience that comes from a good morning wake ‘n’ bake mixed with a nice cup of coffee. 

It was almost like smoking a joint of CBD-dominant flower, where you feel alert, clear-headed, and ready for any obstacles the day may throw your way. Within less than an hour of eating those gummies, I was locked into Google Docs knocking out days’ worth of writing work.

Truthfully, I expected to feel absolutely nothing when I ate those two gummies. I was ready to hate. But the Smokiez delta-8 gummies experience had me blasting music, dancing around my Airbnb, and punching out sentences that writer’s block had been stifling for over a month. 

Sometimes, my head can get pretty foggy from the weight of the world’s news and personal anxieties around them. It leads me to a state where it’s hard to even approach daily life, let alone daily work. Cannabis is one of my remedies for this, and delta-8 proved to have the same benefits that I get by smoking a joint and telling myself that everything is going to be all right. All without the sleepy comedown. 

It was a really pleasant surprise, honestly. Something tells me delta-8 might actually be as advertised. It might really be the weaker version of THC that makes cannabis more approachable for people with lower tolerances.

By 12pm, the delta-8 high had started to subside, and at 2pm the only lingering effects of the high were dry mouth and dehydration. 

50mg verdict

All in all, if I were to describe the 50mg high in one word, I’d say “energizing.” 

Never once did I feel a groggy comedown. Never once did I feel my body succumb to the THC. Instead, I felt productive, motivated, and happy. It was the same type of high I get from consuming strains like Apple Fritter , Super Silver Haze , and Chocolope . 

This is opposed to traditional edibles, where it’s only a matter of time before I’m horizontal on the couch with the Roku remote in-hand ready to waste hours of life watching Joe Budden Podcast episodes on YouTube. With delta-8, I popped a few of those bad boys and locked into Google Docs for four straight hours. Ernest Hemingway could never.

So yes, based on personal experience alone, I’d say that delta-8 gummies do get you high, and that the high is less intense than smoking joints of traditional flower or eating traditional edibles. 

100mg dose experience

I ate the 100mg dose of delta-8 gummies at 4pm. If I’m keeping it real, the experience felt exactly the same as the 50mg dose. I wasn’t higher or anything, it was just right back to a quick head and body buzz that never once tailed off into a sleepy comedown, even as I moved well into the evening. 

I was low-key disappointed with that—I thought boys were about to take off for the moon. In the end, it showed me that I could probably pop delta-8 gummies all day long without feeling like I need a 48-hour nap to clear out the oh-my-god-I’m-so-high cobwebs I sometimes get from traditional THC.

Does delta-8 THC get you high?

Yes, delta-8 definitely gets you high, but it was a lighter high than I’m accustomed to from smoking joints, taking dabs, and eating regular edibles.

These gummies were definitely less intense than the normal Smokiez fruit chews, and in the end, this home-cooked experiment left me feeling like delta-8 could be great for people who want an energizing experience from cannabis but don’t want to smoke joints or take dabs for it. 

Or, if you simply get way too high from joints and dabs and you’ve been running from cannabis and its many benefits, delta-8 could be the training wheels you’ve needed all along.

Most of the time, people expect edibles to hit hard and have you stuck to the couch in slump mode. Perhaps delta-8 is the solution to avoid that. 

Or perhaps it’ll be outlawed before we get the chance to see.

Planning to travel but can't decide which flight carrier to book with? 

Well, a new study has revealed which US airlines offer the most legroom - and which seats are the most cramped.

The research, conducted by airline travel blog Upgraded Points , considered seven US-based airlines, analyzing the model of planes used by each one across the 10 busiest domestic flight paths in the nation.

To calculate the relative leg room, researchers measured horizontally from a given point on one seat to the same point on the seat in front of it in economy class, resulting in a figure reflecting the 'average seat pitch' of the airplane model. 

The resulting findings showed just over four inches differentiated the most cramped and most roomy of the seating configurations - just enough to make all the difference comfort-wise on a lengthy flight. 

Coming out on top with the roomiest economy class seating was JetBlue, with an average distance of 32.3 inches between seats.

2. Southwest Airlines: 31.8 inches

3. Alaska Airlines & Delta Air Lines: 31.0 inches

4. American Airlines: 30.2 inches

7. Frontier Airlines & Spirit Airlines: 28.0 inches

The report attributed the spaciousness to the airline's 'modern fleet' of the Airbus A320 and A321 models.

Coming in second place was Southwest Airlines, with an average seat pitch of 31.8 inches.

Third place was a tie between Delta and Alaska Airlines.

Passengers on either airline can enjoy on average 31 inches of space. 

In fourth place was American Airlines, with 30.2 inches of space.

Fifth on the list was United Airlines, with 30.1 inches of space.

Hawaiian Airlines came in sixth, with a mere 29.0 inches.

And last with but not least on the list: Spirit Airlines and Frontier Airlines tied. 

Both 'ultra-low cost' airlines touted an average seat pitch of a mere 28 inches.

The study also highlighted certain airplane models - untethered to any specific brand of airline - ranking them by generousness of legroom.

In first place: the Embraer 190, with a 32 inch average seat pitch. 

Coming in last was the Airbus A320neo, with an average of 28 inches between a seat and the equivalent point at the one in front of it - four inches less then the top aircraft.

The newly announced Wells Fargo Autograph Journey℠ Visa® Card earns one of the highest rates of return on hotel bookings for a credit card that isn't co-branded with a specific hotel chain. 

This card has a $95 annual fee, inviting direct comparisons to two other cards on this list: The Sapphire Preferred Card , and the Capital One Venture Rewards Credit Card . You'll earn 5 miles per dollar on hotels and rental cars booked through Capital One Travel and 2x miles on all other purchases.

The Capital One Venture Rewards Credit Card also offers one of the most straightforward ways to redeem rewards for travel: you're able to use your miles to cover recent travel purchases from your card statement, at a rate of 1 cent per mile. 

You also have the option to transfer Capital One miles *** to more than a dozen frequent flyer and hotel loyalty programs, including Air Canada Aeroplan, Etihad Guest, and Singapore Airlines KrisFlyer. Capital One also added new partners including British Airways and Turkish Airlines, and improved the transfer ratio to 1:1 for most partners. 

The selection of transfer partners is best suited to someone who wants to travel internationally and who doesn't mind spending some time researching the best ways to redeem miles with the different frequent flyer program options. The American Express® Gold Card is an ideal travel card for anyone who frequently eats out and/or shops at U.S. supermarkets. You'll earn 4x Amex Membership Rewards points on these purchases (though note the $25,000 calendar year annual cap for U.S. supermarkets; after that, you'll earn just 1 point per dollar, but that's a pretty high cap). The card also earns 3x points on flights booked directly with the airlines or through AmexTravel.com, and 1 point per dollar on everything else.

While the $250 annual fee is on the high side, you can offset it thanks to an annual statement credit. You can get up to $120 in annual dining credits**, but it's divided into up to $10 in credits each month, and the credit only applies at select restaurants and delivery services, including Grubhub, Seamless, Milk Bar, Wine.com, and Goldbelly, and participating Shake Shack locations.

You'll also get up to $120 Uber Cash ($10 per month) credit each calendar year (this is only applicable to U.S. Eats orders and rides, and the Gold Card needs to be added to the Uber app to receive the Uber Cash benefit).

What the experts love: "4x points on restaurants and at U.S. supermarkets (on up to $25,000 per year, then 1x) is great — usually, a card favors one or the other," says Rathner. Plus, the card offers monthly dining credits.

What the experts don't love: Wilson notes that other cards offer similar benefits for a lower annual fee, and Rathner notes that the card's travel and dining credits come with some important limitations — so read the fine print.

Best Premium Card for Travel Insurance and Bonus Categories

The Chase Sapphire Reserve® has a $550 annual fee, which means it's not for everybody, but if you're serious about maximizing your rewards and you travel frequently, it could be worth it. It offers a bonus of 60,000 bonus points after you spend $4,000 on purchases in the first three months from account opening. 

Not only do you get up to $300 in statement credits toward travel each year (and Chase has a very generous definition of travel — including everything from airfare to highway tolls), but you also earn 5x total points on air travel and 10x total points on hotels and car rentals purchased through Chase Ultimate Rewards (excluding the $300 travel credit) and 3x points on all other travel and dining. You also get airport lounge access through the Priority Pass network , which has more than 1,300 locations worldwide.

New benefits also include access to Chase Sapphire lounges in JFK , LaGuardia , Boston , and Hong Kong, as well as the Chase Sapphire Terrace at Austin Airport . You'll also receive benefits with DoorDash  and Instacart that can save you money on delivery (activation required).

The Chase Sapphire Reserve® is currently offering cardholders two years of complimentary Lyft Pink All Access membership (valued at $199 per year) for member-exclusive pricing, priority pickup, and more (activation required). 

When it comes to redeeming points, you can book travel through Chase and get 1.5 cents per point (a 50% bonus over the standard 1-cent-per-point rate), or you can transfer your Chase Ultimate Rewards to travel partners like Hyatt, British Airways, and United.

Plus, like the less-expensive Chase Sapphire Preferred® Card, the Chase Sapphire Reserve® offers some of the best credit card travel insurance around. This includes primary car rental insurance, trip delay insurance, trip cancellation protection, and lost baggage insurance.

The Chase Sapphire Reserve® card was previously our pick for the best travel card overall, before the annual fee increased from $450 to $550. While the Reserve did add some additional benefits, the Reserve no longer makes as much sense for casual travelers. As a result, we now recommend the Chase Sapphire Preferred® Card as the best travel credit card for most people.

Best for Luxury Travel Benefits and Airport Lounge Access

The Platinum Card® from American Express has one of the highest rewards card annual fees —  $695 — but it can still be well worth it if you can put all of its statement credits and generous welcome bonus offer to use.

You'll earn 5x points on flights when you book directly through the airline or through American Express Travel (on up to $500,000 per calendar year), which makes the card a great choice for purchasing airfare. The card offers trip cancellation and interruption insurance, plus some of the best purchase protection, so it's a good option for buying expensive items (and don't forget to see if you can take advantage of an Amex Offer ** for bonus points or cash back).

The Platinum Card® from American Express offers more airport lounge access than any other personal travel card — in addition to Priority Pass membership**, you get access to Amex Centurion Lounges , Delta Sky Clubs (when you're flying Delta), and more. 

The card's annual statement credits can go a long way toward offsetting the high annual fee. You get up to $200 in statement credits toward airline incidental fees** like checked bags and inflight purchases; up to $100 each year in credit toward Saks Fifth Avenue purchases**; and up to $200 in annual Uber credits (including Uber Eats)**. 

Just keep in mind that you're limited to one designated airline you choose each year in your Amex account for the airline incidental fee credit, and both the Saks and Uber credits are divided into portions. You'll get up to $50 in statement credits toward Saks purchases from January to June, and another credit of up to $50 for Saks purchases from July to December.

With the Uber credit, you get up to $15 each month, and a $20 bonus in December for a total of $35 that month.

While it takes more effort to redeem points or miles compared to cash back, the upside is that you can get much more value for your points compared to simply cashing in your rewards for a statement credit or check at a rate of 1 cent per point.
