As of today, those who hold a United States H-1B specialty occupation visa may be eligible to apply to work and live in Canada.

The measure was announced by Canada’s Immigration Minister, Sean Fraser, on June 27 and aims to improve labour mobility in North America. It may impact thousands of workers in high-tech industries in both Canada and the United States, as well as their immediate family members.

Those who are approved will receive an open work permit valid for up to three years. An open work permit means that they can work for almost any employer in Canada. This also applies to their spouses and dependents who can apply for work or study permits as needed.

Immigration, Refugees and Citizenship Canada (IRCC) says the measure will last for either one year or until the cap of 10,000 applicants has been reached. This cap is on principal applicants and does not include family members.

Eligibility criteria for Canada's H-1B visa holder open work permit

To be eligible for Canada's H-1B visa holder open work permit, you need to:

have a valid H-1B specialty occupation visa, and
currently live in the U.S.

In order to apply for the open work permit, you need:

a copy of your current H-1B visa
Form I-797/I797B, Notice of Action (the letter from the U.S. government confirming your H-1B application was approved)
proof that you live in the U.S. (such as Form I-94, Arrival/Departure Record, a recent utility bill, an income tax report, or any document that proves you live in the U.S.)

IRCC targeting STEM occupations

On June 28, IRCC announced that it would hold the first Express Entry draw for those with work experience in Science, Technology, Mathematics and Engineering (STEM) occupations . The draw is part of the category-based selection criteria announced by the Minister on May 31.

The department followed through on July 5 and invited 500 candidates with work experience in STEM, many of which may also be eligible for the new H-1B open work permit. Those who were invited were already in the Express Entry application pool.

There are five new Express Entry categories for those with work experience in specific occupational fields. The sixth category is for those with strong French language ability. The categories were chosen following research and discussion with IRCC partners and stakeholders as well as provincial and territorial governments who are likely to be more in tune with local labour shortages.

IRCC said inviting candidates through the Express Entry STEM category was a milestone in Canada’s commitment to attracting top global talent and remaining at the forefront of global research, development, and innovation.

For example, in Budget 2023 , Canada’s government announced that would invest $20 billion to support the building of major clean electricity and growth infrastructure projects. Much of this development will require the skills and knowledge of STEM professionals.

Canada’s tech talent attraction strategy

In addition to the 3-year open work permit for H-1B holders, IRCC is also working on developing a new Innovation Stream under the International Mobility Program (IMP). Minister Fraser said the Innovation Stream will be launched by the end of this year.

The options for the stream are being developed and informed by the feedback of stakeholders received through several consultations in recent months.

There are two options under consideration

Employer-specific work permits for up to five years for workers destined to work for a company identified by the Government of Canada as contributing to our industrial innovation goal
Open work permits for up to five years for highly skilled workers in select in-demand occupations

Further, the minister announced a return to the 14-day service standard for work permits under the Global Skills Strategy , the promotion of Canada as a destination for digital nomads and improvements to the Start-up Visa Program such as more spots allocated and extending the length of the work permit from one to three years.

STEM job vacancies in Canada

The latest job vacancy data from Statistics Canada shows that there were 42,900 job vacancies in professional, scientific, and technical services in April, down by 7,700 (-15.2%) from March, and by 30,600 (-41.6%) from its peak of 73,600 in April 2022.

Ontario and Quebec continue to have the highest number of vacancies in the country. To help fill these vacancies, especially in the STEM sector, Ontario recently removed the Canadian work experience requirement for newcomers seeking licensure in engineering.

On June 30, Ontario's Ministry of Labour, Immigration, Training and Skills Development also announced that regulated professions in Ontario will be required to make and communicate registration decisions on applications from internationally trained newcomers within six months. This measure aims to make it easier for skilled newcomers, especially in licensed professions such as some under STEM professions, to fill job vacancies and close the skills gap.

Can I travel to Canada with US h1b visa?

1. Apply for your visitor visa, study permit or work permit

If you want to visit, study or work in Canada, make sure you’re eligible to apply. Use our application guides to help fill out your application properly, then submit your application.

Avoid processing delays by sending us a complete application .

2. Get your fingerprints and photo taken

If you’re between 14 and 79 years old, you probably need to give your fingerprints and photo (biometrics).You only need to give your biometrics once every 10 years to make repeat trips to Canada easier.

You must pay the biometrics fee when you submit your application. Otherwise you may experience delays.
Get this done as soon as you get the letter from us that tells you to give biometrics.
You have 30 days to do this from the date on the letter.

COVID-19: Biometrics deadline

3. We process your application

After we get your biometrics, we start processing your application. See how long it takes to process your application.

If we need more information from you, we’ll contact you.

4. We make a decision on your application

When we finish reviewing your application, we let you know if you’re approved to come to Canada. If you are, we issue your documents.

If your application is refused, we send you a letter that tells you why.

5. You travel to Canada (if you’re approved)

Make sure you travel with the documents we gave you. This includes travel documents like a visitor visa, study or work permits or an eTA (electronically linked to your passport).

Airline staff and border service officers at ports of entry will ask to see your travel documents. If you don’t have them, you may not be able to board your flight to Canada.

Make sure children under 18 travel with the right documents .

6. We check your identity when you arrive in Canada

When you arrive, we check your identity to make sure that you are the same person who was approved to travel to Canada. We may use your biometrics to do this.

If we can’t verify your identity, you may be detained by a border services officer. These officers help protect the health and safety of Canadians.

If the officer determines that you’re not admissible to Canada, you won’t be allowed to enter Canada. If you came by air, you’ll have to take a return flight to where you came from.

7. You’re allowed to enter Canada

If you pass the identity check and meet the entry requirements , the border services officer stamps your passport and lets you know how long you can stay in Canada. You’re normally allowed to stay in Canada for up to six months.

Children under 18 must meet the same entry requirements as adults. The border services officer may ask minor children to show other documents depending on whether the child is travelling alone or with someone.

Basic entry requirements

You must meet some basic requirements to enter Canada. You must:

have a valid travel document, like a passport
be in good health
have no criminal or immigration-related convictions
convince an immigration officer that you have ties—such as a job, home, financial assets or family—that will take you back to your home country
convince an immigration officer that you will leave Canada at the end of your visit
The amount of money you will need depends on how long you will stay and if you will stay in a hotel, or with friends or relatives.

Some people are not admissible to Canada, which means they are not allowed to enter the country. You can be inadmissible for several reasons, including being involved in:

criminal activity
human rights violations
organized crime

You can also be inadmissible for security, health or financial reasons.

Permanent residents of Canada

We do not issue temporary resident visas (TRV) to permanent residents (PR). If you are outside Canada without a valid PR card, you must apply for a permanent resident travel document (PRTD) instead. If you meet the requirements for a PRTD, you can return to Canada as a PR.

If you no longer want to be a PR, or if you know you do not meet the requirements to keep your PR status, you can voluntarily give up (renounce) your PR status to apply for a TRV.

You can’t fill out and save the application form using your Internet browser. To use the form, you need to:

Use your computer (Mac or PC). The form won’t open on mobile devices (iPads, tablets, mobile phones, etc.)
Install Adobe Reader 10 (or higher)
Download the PDF file to your computer . Save the file in a place you can remember.
Make sure you use Adobe Reader to open the form. Sometimes if you try to open the form directly, it will use your Internet browser to try to open it.

Canada Immigration Guide for H1B Visa Holders

If you currently hold an H1B visa, whether residing in the United States or another country, you stand as a robust candidate for Canada’s immigration pathway. This route often proves to be a more efficient and expeditious alternative compared to pursuing a Green Card in the United States.

If you are considering moving to Canada, it’s important to learn about the various immigration options and their specific requirements. Explore the different pathways through which H1B visa holders can establish themselves in Canada as skilled foreign workers.

Immigration Options for H1B Visa Holders

Under the Express Entry Program, if you are a highly skilled worker with experience in sectors such as healthcare, Science, Technology, Engineering, Math, Trade, Transport or Agriculture and agri-food occupations, there are three major federal Canadian economic immigration programs that you can apply to:

Federal Skilled Worker (FSW)
Federal Skilled Trades (FST)

If you meet the eligibility requirements for one of the programs managed by Express Entry, you can submit a profile to the Express Entry pool.

Once in the pool, your profile will receive a Comprehensive Ranking System (CRS) score based on things like your age, level of education, and work experience. The highest-ranking candidates are issued invitations to apply (ITA) for permanent residence in periodic Express Entry draws.

As a skilled worker in the United States, you are most likely to meet the requirements for the Federal Skilled Worker program.

However, most Canadian provinces also offer pathways to permanent residence for skilled workers. While eligibility requirements and application procedures vary between provinces, there may be an option for you. If you are eligible for a Provincial Nominee Program (PNP), you can apply to the province for a provincial nomination.

Always discuss your travel plans with the International Scholars Operations (ISO) team before traveling internationally and before any petition is filed with U.S. Citizenship and Immigration Services (USCIS) on your behalf.

Changes of Status

If you are in the U.S. and attempting to change your status to H-1B, or if your dependents are applying for a change of status to H-4, do not travel outside the U.S. while the petition is pending with USCIS. USCIS may say that you have abandoned the petition and deny your change of status. In this situation, you would have to exit the U.S., apply for a new H-1B visa stamp, and reenter as outlined in Coming to the U.S. page .

Extensions of Status and Changes of Employer

You can travel internationally and reenter the U.S. while your H-1B status is being extended or transferred from one employer to another, provided you have a valid I-797 Approval Notice and a valid H-1B visa (unless visa-exempt or eligible for automatic visa revalidation). If your current H-1B expires before you return, you may have to wait until the H-1B extension is approved to reenter.

Returning to the U.S. after a Temporary Absence

When returning to the U.S. after a temporary absence, be prepared to show the following to the Customs and Border Protection officer:

Original and unexpired Form I-797 Approval Notice.
Passport valid for at least 6 months beyond the end date of your expected stay.
Letter from your UW host department confirming you are returning to continue full-time employment in the job described in the I-129 petition.
These were forwarded to you by your host department. If you cannot locate them, contact ISO .
Note: If the visa has expired, it may be extended by presenting the documents listed above to a U.S. consulate . Anticipate delays due to security reviews. For information about the visa process and to schedule an interview appointment, contact the U.S. consulate in the city where the application will be submitted.

Short Travel to Canada or Mexico under Automatic Visa Revalidation

A valid H-1B visa stamp (or H-4 visa stamp) is not required for reentry to the U.S. following a visit of less than 30 days in Canada or Mexico, as long as you have a valid H-1B approval notice. This is called automatic visa revalidation. However, if you apply for a new visa while in Canada or Mexico, you will not be able to return to the U.S. unless the visa is granted.

Automatic visa revalidation is not available to nationals of countries on the State Sponsors of Terrorism list .

Since the Office of Management and Budget ( OMB) has cleared the rule to run the pilot program for H1B Visa stamping within the US, many of you have been waiting for the official regulation text. Today, the US Department of State has published the regulatory text on the federal register outlining the pilot program details.

This article will review the official regulation and summarize the details, such as the criteria for applying for H1B stamping with the US, how it would work, start dates, and other information, including common FAQs.

Background: Pilot Program for H1B Stamping in the US

In the past, up until mid-2004, the US Department of State was doing US Visa Stampings within the US for several visa types such as H, L, O, C, E, and P. This was discontinued in June 2004 as the US Visa interview requirements changed with the “ Enhanced Border Security and Visa Entry Reform Act of 2002 “, also called Public Law 107- 173 . The main change was capturing biometrics; they had no facilities to do the same back then, hence discontinued.

Since February 2023, there have been discussions around getting the US Visa stamping within the US and resuming the previous program . This was solidified in June 2023, when Whitehouse announced it during the Indian Prime Minister Mr. Narendra Modi’s visit to the US. The initial scope for the pilot was temporary work visa holders already living in the US.

In October 2023, the official rule titled, “ Pilot Program to Resume Renewal of H-1B Nonimmigrant Visas in the United States for Certain Qualified Noncitizens ”, was submitted to the Office of Management and Budget (OMB) for review. It was given clearance by OMB on December 15th, 2023. Today, on December 21st, the US Department of State published the official rule in the Federal Register.

Now, let’s look at the eligibility criteria for participating in the pilot program.

Eligibility Criteria to Apply H1B Stamping in the US as part of Pilot Program

All the applicants planning to apply for domestic H1B Visa renewal as part of the pilot program should meet all the listed 12 criteria below:

Only H1B Applicants : The US Department of State will only accept H1B Visa renewals for the pilot program. No other visas will be processed, including H4 Dependent visas.
H1B Stamped in Canada : From January 1st, 2020 through April 1st, 2023.
H1B Stamped in India : From February 1st, 2021 through September 30, 2021.
Must be eligible for a waiver of in-person interview : The applicant should meet all the general requirements to qualify for the interview waiver or Dropbox stamping option. You can check the H1B Visa Dropbox Guide for complete requirements.
Submitted Fingerprints : The applicant should have submitted the ten fingerprints as part of the previous US Visa application. It means the applicant should have given biometrics at a US Consulate or Visa Application Center(VAC) in the past.
No “Clearance Received” Annotation : The applicant should not have the annotation on the previous US Visa that says Clearance Received. You can read full details at: What is Clearance Received or Department Authorization annotation .
Reciprocity Fee : The applicant should not be subject to the non-immigrant visa issuance fee, also called as “reciprocity fee”.
Unexpired H1B Petition : The applicant must have an approved and unexpired H1B Visa petition from USCIS. Technically, they should have an H1B Visa approval notice that is valid.
Admitted on H1B Status : The applicant should have entered the US on H1B Visa status. When you enter the US and go through the US Port of entry procedures , you should have been given H1B Visa Status by the CBP officer.
Maintaining H1B Status : The applicant must have been maintaining H1B Status in the US. It means that the applicant has to be working on an H1B Visa and not have any status violations. Read US Visa vs. Maintaining Status for more info.
H1B Status has not expired : The issued period of authorized admission on H1B Status has not expired. Technically, they mean the Form I-94 issued for your H1B Visa status should be valid and not expired.
Reenter on H1B Status : The applicant needs to intend to re-enter the US in H1B Status after they travel abroad for a short period. Technically, they want to ensure you will be working on an H1B Visa and entering the US on the same visa after your stamping.
No visa ineligibility: The applicant should not have any other issues requiring a waiver before issuing a US Visa. Some applicants may need to get a special waiver before the US consulate can issue visas. Applicants should not have such issues when applying under this pilot program.

Why is the Pilot Program is scope very narrow with so many requirements?

The regulation says that they have limited the scope of the pilot program and added the criteria so that they can adequately assess the performance and capabilities of contractors managing this.

They also did not include H4 Depedents or other visas as it will add additional technical and operational challenges for them, and they will not be able to address them before the pilot launch date. They plan to develop processes for other visa categories in parallel when the pilot program is in progress based on the real time data and feedback of the program.

H1B Stamping in the US Pilot Start Date, How Does It Work?

Below are the details on the start date of the pilot program and how it would work:

Start Date of Pilot Program: The US Department of State will start accepting applications online for the H1B stamping pilot program from January 29th, 2024 .
Weekly 4,000 Application Slots : To facilitate and control the number of applications received, they will release 2,000 application slots for applicants who had previous H1B stamping done in Canada every week and 2,000 application slots for applicants who had previous H1B stamping done in India.

February 26th, 2024
Locking of Online Portal : They will count every application received against the weekly 2000 or 4000 limit. If the applications submitted reach the limit, they will lock the online portal. The next set of applications can only be submitted when the portal opens up fresh tranche of slots.
End Date for Pilot Program: The pilot program will end when all the 20,000 thousand application slots are filled as per the above dates or on April 1st, 2024, whichever comes first.

Where to apply for Domestic H1B Stamping using the Pilot Program?

To participate in the domestic H1B stamping pilot program, you can complete the application online at the US Department of State web page located at : https://travel.state.gov/content/travel/en/us-visas/employment/domestic-renewal.html

When applicants go the US Department of State Online webpage, they will be given options to select the location of their previous H1B stamping and will be taken through an assessment wizard to check, if they qualify for the pilot program or not.

During the process, qualified applicants will be given instructions on how to pay the Visa Machine-Readable Visa(MRV) fee, where to send the passport, and other documents.

If the applicant qualifies based on the assessment, then they need to complete Form DS-160 and complete the steps as given by the online system for sending documents, paying MRV fee, etc.

As per them, it is possible that system may not screen out all applicants who do not meet criteria and may be asked to pay fee. In such case, the MRV fee will not be refunded.

Below is a screenshot of how the webpage looks at the US Department of State website, where you can apply for domestic visa renewal for H1B Visas as part of this pilot program. They plan to add more details on this page, as we get closer to the date.

How will the H1B Stamping Pilot applications be processed?

The online applications will be considered in the order they are received. The online application submission status will be electronic and automated. Below are the steps of application processing

Step 1 – Self Assessment: Applicant completes the eligibility self-assessment to check if they qualify for leveraging the domestic H1B stamping pilot program.
Step 2 – DS-160, Pay Fee, Send Package: Applicant submits the Form DS-160, pays the non-refundable MRV fee, and gets instructions on how and where to send passport and documents.
Step 3 – Initial Sorting, Return : They will initially screen and sort the received application packages from USPS or other courier services and check if the application falls into the pilot program scope. If the application does not meet the requirements, they will return the application package back to the applicant and no refund will be given.
Step 4 – Sent for Processing: If the application received meets the requirements for pilot program, they will send the package to a location where authorized State Department Employees will adjudicate the applications.
Step 5 – Visa Processing, No expedited process: The application adjudication can take six to eight weeks. They plan to complete all the adjudications by May 1st, 2024. They will not consider any expedited processing requests. The applicant can withdraw if there is a need for urgent travel. If you withdraw the application in the middle, you will be issued a 221g Administrative Processing for your case. No fee will be refunded.
Step 6 – Return of Issued Visa and P assport : After the processing, the issued US visa , along with the passport and other documents submitted by the applicant, will be sent using USPS or any other commercial courier.

Required Documents for Domestic H1B Stamping Pilot Program

Below is the list of documents as given by US Department of State for the pilot program

Fully completed Form DS-160 , Online Nonimmigrant Visa Application.
One passport photo, taken within the last six months meeting these specifications
Original Passport that is valid for at least six months from the date of application and has a blank page.
Original copy of the H1B Approval Notice, Form I-797, Notice of Action
The original copy of Form I-94 is from the CBP website .
Application Fee : The MRV Fee applicants have to pay is $205 USD. It is non-refundable and non-transferable. It is done as part of the online portal process.

Missing Documents, Corrections for Visa issuance

If there are any documents missing, the applicants will be given a refusal under 221g of the INA and given a chance to send the missing documents or do any corrections to the forms. The deadline for such corrections is by April 15th, 2024.

If they receive the documents or updated information by April 15th, 2024, they will reconsider and adjudicate the visa application as part of the pilot program. The pilot will conclude by May 1st, 2024 and applicants have to send their documents requested by April 15th.

Some of the common issues with applications or requested documents can be such as below:

Issues with Form DS-160, not properly completed
The photo sent is not meeting the US Dept of State Standards.
Proof of the applicant’s residence in the US.

What happens, if my H1B Visa is not issued under this Pilot?

If your H1B Visa stamping application as part of this pilot is not successful and you are not issued a visa, you will be issued a form stating that it was refused under 221g Administrative Processing .

If your H1B Visa is not issued under this pilot, the State Department will not transfer your case to any overseas consulate or your home country consulate. The applicant will need to pursue a new application overseas or home country by completing a new DS-160 form, pay the MRV fee again, and go through the standard in-person application process.

Additional Guidance on Participating in the Pilot Program

Applicants using the pilot program do not have to submit evidence of their residence in the US during the submission of the documents for the H1B Visa renewal in the US.
Participation in the H1B visa renewal pilot program is voluntary. There is no mandatory requirement forcing you to use this. You can continue to get stamping done at your home country or overseas.
If the applicant does not meet the requirements and applies for the H1B renewal using the Pilot program, the fee will not be refunded, and the visa will not be issued. The applicant must again submit new application, pay fees and apply for stamping overseas.

Easing the Nonimmigrant Visa Process for U.S. College Graduates

On June 18, 2024, the Biden-Harris Administration announced actions to more efficiently facilitate employment-based nonimmigrant visas for those who have graduated from college in the United States and have a job offer.

This initiative will allow certain individuals to more quickly receive nonimmigrant work visas if they are deemed eligible.

As part of this initiative, the Department will clarify existing guidance to consular officers related to when they should consider recommending that DHS grant a waiver of ineligibility, where applicable.

Q: What will these process clarifications mean for current NIV ineligibility waiver processing steps?

These clarifications will describe when consular officers should consider recommending that the Department of Homeland Security waive ineligibility for these applicants on an expedited basis, in conjunction with visa applications overseas. However, the processing steps will remain the same.

Waiver requests are adjudicated by the Department of Homeland Security, U.S. Customs and Border Protection’s Admissibility Review Office.

Q: How can an individual apply for a petition-based nonimmigrant work visa?

Before an applicant can apply for an H-1B or other temporary worker visa, U.S. Citizenship and Immigration Services (USCIS) must generally first approve a Petition for a Nonimmigrant Worker, Form I-129 . For more information about the petition process, see Working in the U.S. and Temporary (Nonimmigrant) Workers on the USCIS website. Once USCIS approves the petition, it will send the prospective employer a Notice of Action, Form I-797.

Individuals may apply for a nonimmigrant visa after USCIS has approved the petition. There are several steps in the visa application process. The order of these steps and how applicants complete them may vary at the U.S. embassy or consulate where they apply. Please visit the embassy or consulate website for instructions on how to apply.

Individuals will need to complete the Online Nonimmigrant Visa Application, Form DS-160 and schedule an appointment for their visa interview at any U.S. Embassy or Consulate.

Upcoming FAM updates will clarify when consular officers should recommend that DHS grant a waiver of the applicant’s ineligibility, consistent with the waiver process that is already available under existing law to individuals seeking nonimmigrant visas, and consistent with Department regulations that describe the types of cases in which consular officers should consider recommending a waiver of ineligibility. It is not conferring any new benefits and is not limited to DACA recipients.

This will result in certain individuals to potentially more quickly receive work visas if DHS approves a waiver of ineligibility.

While leaving the United States to apply for a visa is not without risks, this policy will clarify when consular officers should consider recommending waivers, so that individuals and employers can make informed decisions and streamline the process so that those who qualify can get to work quickly.

H1B Dropbox at Vancouver - Timeline & Experience

Sharing my timeline and experience in Vancouver for Dropbox. Dates maybe +/- 1 I went through a lot of pages and forums. Read all 160+ pages in the H1b dropbox in canada on this site. Please do your own research and not follow me as things could turn out differently for you. Hope this helps others. 1. To get Dropbox facility you have select when filling out the application for visa when asked If you're traveling from another country to apply for visa? You have to reply with No. If you reply with yes, you won't get dropbox as simple as that. I called the number from US multiple times and they said if you're canadian PR, you can write down as no. Even the help tool on that page says, Canadian permanent residents are considered as living in canada. 2. I completed my DS-160 in US itself and requested for instructions from US itself. 3. Got instructions in 2-3 days. 4. You can use your US license to pick up your passport. Whatever ID and information you put while filling out the application, you need that to pick up the passport. There is no connection at all with what you put in your DS-160. The address and name should match. 4. Flew to Canada on a Tuesday in May. Submitted documents on Wednesday before 12 PM because people said in this and other forum about when the delivery guy picks up your parcel. This didn't make a difference to me. It was only delivered and ready to pick up on Friday. 5. Next Monday, it showed picked up. At this point the visa status checker showed no status. In fact, putting in all correct details showed no profile or something like that. I typed in NA for two fields which was mentioned by someone and it still said no status. There's information below the fields which says if your application is before such and such date put NA. 6. Tuesday Visa status changed to Application received. 7. Wednesday it showed issued. I was surprised as there was nothing like Approved or something. Directly Issued. 8. Got email on friday about tracking information and that passport is picked up by canada post and estimated delivery was the coming Monday. 9. Passport was ready to pick up on Monday around 1 PM. 10. Not gonna say don't stress as all of us will but I feel if you're a canadian PR, might as well do it in Canada as it this point it looks like it is faster than doing it in India. Total business days for me from submitting passport and picking up were 8 days. General remiders: a. When you print in courier in certificate, it again asks for an address. But you can't put a US address there as country is filled as CA already. I used my brother's name and address who lives in vancouver. I thought it could be related to delivery of passport but it wasn't. I am not even sure why they ask for it. Use any Canadian address. b. Address to send for embassy is written on the instructions. No other address. Canada Post people in Surrey knew the entire process and was helpful. c. I paid 19 CAD for premium delivery to track application properly 28 CAD was for home delivery but didn't want to wait. d. Documents I sent was same as documents mentioned in instructions. No additional documentation just for the sake of it. Just make sure all the documents are clearly visible. e. Country of Permanent residence I kept it as USA. Some said to keep it as Canada and some as India. It was very ambiguous but the toolbar next to it when completing the visa application said country you are legally authorized to work. Personally I feel it could be US or Canada.

President Biden’s new immigration policy protects some 500,000 people who are married to U.S. citizens from deportation and gives them a pathway to citizenship.

The election-year move comes just two weeks after Mr. Biden imposed a major crackdown at the U.S.-Mexico border, cutting off access to asylum for people who crossed into the United States illegally.

The policy announced on Tuesday is aimed at people who have been living in the United States for more than a decade and have built their lives and families here.

Here is how it works:

Why do the spouses of American citizens need protection?

Marrying an American citizen generally provides a pathway to U.S. citizenship. But people who crossed the southern border illegally — rather than arriving in the country with a visa — must return to their home countries to complete the process for a green card, something that can take years. The new program allows families to remain in the country while they pursue legal status.

Who is eligible?

There are roughly 1.1 million undocumented immigrants married to U.S. citizens in the United States, according to Fwd.us , an immigration advocacy group, but not all of them are eligible for the program.

The spouses must have lived in the United States for 10 years and have been married to an American citizen as of June 17. They cannot have a criminal record. Officials estimate that the policy will provide legal status and protections for about 500,000 people. The benefits would also extend to the roughly 50,000 children of undocumented spouses who became stepchildren to American citizens.

When will the program take effect?

Biden administration officials said they expected the program to start by the end of the summer. Those eligible will then be able to apply for the benefits.

Why is President Biden doing this now?

Mr. Biden is trying to strike a tricky balance on immigration, which is a serious political vulnerability for him. Polls show Americans want tougher policies. Just two weeks ago, Mr. Biden announced a crackdown on asylum at the southern border.

His new policy, giving hundreds of thousands of immigrants new legal protections, is a way for him to answer the calls from the progressive base of the Democratic Party, which has accused the White House of betraying campaign promises to enact a more humane approach to immigrants.

China Expands Visa-Waiver Program List: More Countries Added

For years, China has been the gift that kept on giving to global tourism, sending millions of its citizens to explore, shop and snap selfies worldwide. Now, it's telling global travelers, "Your turn!" And if visa hassles are a deal-breaker, the country knows that removing them can only sweeten the deal.

China is opening its doors even wider to the world. Australia is now the latest country to join China’s expanding visa waiver program.

Chinese Premier Li Qiang made the announcement on Monday during an official visit to Australia, marking a significant step in strengthening ties between the two nations.

“We agreed to provide each other with reciprocal access to five-year multiple entry visas for tourism, business, and visiting family members to better facilitate personal exchanges. China will also include Australia in its visa waiver program,” stated Premier Qiang.

Australia’s national airline Qantas announced last month it was leaving Mainland China just six months after returning to the market. Speaking to Skift, the carrier’s International CEO said “Getting out of China at that point was the right call from our perspective.”

China has yet to detail the specifics of the new visa waiver arrangement, but the announcement closely follows a similar decision concerning New Zealand passport holders.

Just last Thursday, Premier Qiang declared visa-free entry for New Zealand citizens. “China is ready to discuss with New Zealand to introduce more measures to facilitate two-way travel,” Qiang mentioned, highlighting China’s move to ease travel restrictions.

In the past year, China has incrementally broadened its visa-free access to various countries.

China’s Visa-Free Travel Initiatives

In November, China introduced a one-year trial for visa-free travel for citizens of France, Germany, Italy, the Netherlands, Spain, and Malaysia. In March, China expanded this program to include Ireland, Switzerland, Hungary, Austria, Belgium, and Luxembourg.

China initially announced the visa-free policy for a trial period until November 30 this year, but has now extended it until December 31, 2025.

With the recent additions of Australia and New Zealand, the number of nations enjoying visa-free entry to China now totals 14. Passport holders from these countries can stay in China for up to 15 days for tourism, business, family visits, or transit purposes.

China also signed a 30-day mutual visa exemption agreement with Singapore and a similar arrangement with Thailand, effective March 1, allowing visa-free visits of up to 30 days per entry. It has also eased visa requirements for U.S. citizens visiting the country on tourist visas, removing the need to provide proof of round-trip air tickets, hotel reservations, itineraries, or invitation letters.

The Chinese government has also relaxed entry regulations for tourists arriving via cruise ships. As of May 15, such visitors can stay in China visa-free for up to 15 days.

China’s Inbound Recovery Lags Behind

The initiatives are part of a broader strategy to rejuvenate China’s tourism sector, which has been struggling to regain its pre-pandemic momentum.

China’s inbound recovery has been gradual. In 2023, China welcomed 35.5 million foreign visitors, which is only about 36% of the 97.7 million recorded in 2019.

However, Chinese online travel agency Trip.com Group notes promising signs of resurgence. During the Lunar New Year in February, the group reported a tenfold increase in inbound travel bookings compared to the previous year, with significant interest from Japan, the U.S., South Korea, Malaysia, Australia, the U.K., Canada, Vietnam, Germany and Thailand.

Moreover, Trip.com Group noted that international travelers are extending their stays in China. The average duration during the Spring Festival increased to just over two days, compared to under two days the previous year. The booking window for travel to China had also expanded from six days in 2023 to 39 days in 2024.

More Inbound Boosters

To further enhance the travel experience for international tourists, China has strengthened partnerships with major payment organizations like Ant Group and Mastercard. The International Consumer Friendly Zones program in Shanghai, has been launched in collaboration with 12 overseas payment partners of Alipay+ and other major international card organizations.

It aims to make transactions smoother for global travelers.

Statistics from the first quarter of this year show a threefold increase in foreign travelers to China compared to the same period in 2023. During this time, China issued 466,000 visas and documents to foreigners, marking a 119% year-on-year increase, and nearly 1.99 million foreigners entered China visa-free, a 266% year-on-year rise.

Highlighting the economic potential of inbound tourism, Jane Sun, CEO of Trip.com Group, stated, “China’s inbound tourism has huge potential, and if it is raised to the international median of 1.5% of GDP, it could yield a growth of over RMB 1.3 trillion ($179 billion).”
