MISSISSAUGA — After being charged by TICO in 2021 , Albarkah Travel and Tours Inc. has been convicted on eight counts of failing to deposit consumer money into a trust account, and three counts of failing to issue receipts to consumers.

In addition, Mahmood Bashir was convicted of one count of being an officer or director and failing to take reasonable care to prevent the corporation from committing an offence.

The Court found that Albarkah Travel and Tours Inc. routinely purchased travel services from travel wholesalers on credit instead of paying for those purchases using the funds received from customers.

Instead of depositing consumer payments into a TICO-designated trust account, Albarkah Travel and Tours Inc. used consumer payments to pay down an existing business debt.

This misappropriation of consumer funds resulted in consumer loss after Albarkah Travel and Tours Inc. declared bankruptcy. The Travel Industry Compensation Fund reimbursed 63 consumers of Albarkah Travel and Tours Inc. more than $277,000.

Bashir has been sentenced in Court to a two-year probation and is prohibited from applying for or engaging in activities as a registered Travel Agent, as defined in the Travel Industry Act, 2002. Bashir was also sentenced to 200 hours of community service.

The court ordered Albarkah Travel and Tours Inc. to pay $25,000 in restitution to the Travel Industry Compensation Fund, on top of the $25,000 in restitution that has already been paid.

In addition, TICO has recovered more than $68,000 from wholesalers who extended credit to Albarkah Travel and Tours Inc. for travel services, which was not compliant with trust accounting rules. These funds partially offset payouts to consumers with eligible claims against the Travel Industry Compensation Fund.

Coronavirus: Ontario travel agency shut down, customers still owed thousands

An Ontario travel agency has been shut down by regulators after mounting complaints that the business did not give refunds for airline tickets that were cancelled amid the coronavirus pandemic.

“Agencies have to hold that money in trust,” said Richard Smart, president and CEO of the Travel Industry Council of Ontario (TICO), which licences travel agencies in the province.

TICO suspended Al-Barkah Travel and Tours Inc.‘s registration on Sept. 14.

Global News received several complaints from consumers about Al-Barkah Travel and Tours, alleging that its owner had failed to repay money for trips that could not go ahead as a result of COVID-19.

“He said four-to-six weeks to get a refund; I never got anything,” said Nadia Aamir of Brampton, adding she paid more than $1,500 for a return ticket from Toronto to Lahore, Pakistan.

“I tried calling him, leaving messages, he didn’t reply to anything at all,” Aamir told Global News in an interview.

Al-Barkah, located in Milton, is run by Mahmood Bashir, who could not be reached by telephone because the agency’s phone line is disconnected.

Global News visited his home for comment and spoke to a man who said he was his brother.

“I don’t know where you could track him,” the man told a reporter before acknowledging Bashir resides at the new home with two late-model luxury German automobiles parked on the driveway.

Several customers told Global News they have gone to police to complain, but no charges have been laid.

Thirunalrayan Vijayan bought three tickets from Toronto to India from Bashir’s company on the recommendation of a friend. He expected to receive a promised refund of $4,765 but has not.

Eventually, Vijayan was sent a credit letter from the travel agency, valid for two years. The credit promise is written under the company’s letterhead.

But with the agency prohibited from providing travel services, the credit is worthless.

“It makes me miserable. It’s a lot of money,” Vijayan said.

The travel regulator said consumers have been calling with complaints about Al-Barkah for months.

“We have received numerous complaints, the nature of which you’ve described, consistent of what you’re hearing,” said Smart, who said the company is the subject of an ongoing investigation.

In the meantime, clients who believe they are owed money by the travel agency can contact TICO to file a complaint and attempt to receive repayment from the industry’s compensation fund.

Mississauga, ont. – the travel industry council of ontario (tico) has charged albarkah travel and tours inc. with the following:.

• One count of failing to notify the Registrar of a change of business address
• Two counts of failing to explain to the customer any requirements or limitations relating to the transfer or cancellation of travel services
• 20 counts of failing to promptly provide the customer with a statement, invoice or receipt
• 14 counts of failing to hold all money received from the customer for travel services in trust and depositing all money into the trust account within two banking days of receiving it 

In addition, Mahmood Bashir is charged with being an Officer and Director of a corporation and failing to take reasonable care to prevent the Corporation from committing an offence. 

Mr. Bashir will appear in court at 4085 Palladium Way in Burlington, Ontario on May 7, 2021 at 9 am.

Albarkah Travel and Tours Inc. had its registration revoked resulting from allegations of non-compliance with the Travel Industry Act, 2002 , including requirements for financial reporting, working capital, trust accounting, and alleged non-compliance with conditions and orders on registration resulting from earlier action taken by TICO.

Additionally, consumers have come forward stating that they did not receive the travel services they had paid for from Albarkah Travel and Tours Inc.

We liked that she could pick up on our interests and take us places we might not have thought of to go. When we realized that one of the places we had chosen to see would probably not be that interesting to us, she was able to arrange entry to the Diamond Fund and the Armoury for us. Riding the Metro with Lena was a real adventure and a lot of fun. In Saint Petersburg we found Anna well versed in the history of the Tsars and in the Hermitage collection. Arkady in Veliky Novgorod was a very good guide and answered all of our questions with ease. Novgorod was perhaps a long way to go for a day trip, but we did enjoy it. Vasily was a great driver to have and kept us safe with good humour and skill. We enjoyed ourselves so much, my daughter says she is already planning to return. We would both have no hesistation to recommend ExpresstoRussia to anyone we know.

Just wanted to let you know that My grandson Bruno and I couldn´t have been more pleased with our week in Moscow (6/15 - 6/21). We were absolutely enchanted with the whole experience, including getting lost a couple of times in the Metro during our free time. Although both our guides (both Eleanas) were excellent, I would particularly commend the first one (she took us to the Tatiakov, the KGB tour, and to that beautiful cemetery where so many great Russian artists, authors, composers, musicians, militarists, and politicians are buried). Her knowledge is encyclopedic; and her understanding of today´s Russia as a product of its past was, for us, truly enlightening. I will be taking another tour in Russia, with my wife, within the next two or three years. I will be in touch with you when the time comes. Do they speak English in Moscow?

As Russia’s capital city, tourists are well accommodated in Moscow. There should be English-speaking staff in restaurants, bars, hotels, shops and attractions in tourist hotspots, and there are also English-speaking tourist police. Transport services have English translations on their maps and English announcements via intercom; alternatively, order taxis from the Yandex Taxi app (Russian Uber), though it’s unlikely that your taxi driver will speak English. If you get stuck and cannot communicate, it’s fine to use Google Translate.

Is it safe to travel to Moscow?

It is no less safe to travel to Moscow than to any European city if you exercise common sense and look after your belongings. As with every city some regions can be more unsavoury than others, but no tourist attractions are located there. The traffic in Moscow is notorious, so exercise caution when crossing roads. Do not take unlicensed taxis; book in advance or take public transport, which is widespread and perfectly safe. If you encounter any problems, look for the special tourist police who can help you.
