Medical Exam Instructions

All immigrant visa applicants, regardless of age, require a medical examination prior to the issuance of a visa. Only a physician accredited by the U.S. Embassy can perform this exam. It is your responsibility to schedule a medical exam with an approved physician before your visa interview at the U.S. Embassy. Medical examination results from other physicians will not be accepted. Please click the button below for a list of approved physicians in Pakistan.

COVID 19 VACCINE REQUIREMENT Applicants with medical exams scheduled on or after October 1, 2021, are required to complete the COVID-19 vaccination series before the medical appointment. The administered vaccine should be listed for emergency use by the World Health Organization (WHO) or the US Food and Drug Administration (USFDA) must have licensed or authorized that particular vaccine.

Please be advised that the medical examination will not be processed unless the applicant provides a valid COVID-19 immunization certificate on the day of the medical appointment.

Exemption: Children or young adults who have been advised by National Command Operation Center (NCOC) against receiving the COViD-19 immunization are exempt from this requirement. Applicants for whom the vaccine is contradicted are required to provide all medical reports supporting the contraindication for their condition.

Items to bring to your medical examination

Bring the following items to your medical exam:

  • Your visa interview letter,
  • Your passport,
  • Six (6) recently taken passport-sized color photographs,
  • A copy of your immunization records, and
  • Medical records and test results for any major illnesses or surgeries you have had previously or for which you are currently receiving treatment.
  • DS-260 confirmation page.
  • A valid COVID-19 immunization certificate on the day of the medical examination appointment.

You must pay all medical examination fees, including x-ray and blood test fees, directly to the examining physician.

During the medical exam

The medical examination will include a medical history review, physical examination, and chest X-ray and blood tests (for applicants 15 years of age or older). The United States also requires tuberculosis (TB) testing for all applicants two years of age and older.  Please be prepared to discuss your medical history, medications you are taking, and current treatments you are undergoing. U.S. immigration law requires immigrant visa applicants to obtain certain vaccinations prior to the issuance of a visa. After the medical exam

When your examination is completed, the doctor will either provide you with exam results in a sealed envelope or send them to the U.S. Consulate.  IF GIVEN AN ENVELOPE TO CARRY TO YOUR INTERVIEW, DO NOT OPEN THIS ENVELOPE. Instead, bring it to your visa interview.

Any x-rays taken will be given to you. You DO NOT need to bring the x-rays to your visa interview unless you suffer from tuberculosis (TB). However, you must carry the x-rays with you when you travel to the United States for the first time. The medical report must be less than six months old when you enter the United States as an immigrant.

Pre-Interview Checklist

Please use the list below to determine the items that EVERY applicant must bring tot he immigrant visa interview:

  • A copy of your NVC interview letter (does not apply to Diversity Visa, fiancé(e), adoptive, or asylee/refugee applicants).
  • Unexpired passport valid for six (6) months beyond your intended date of entry to the United States and  a photocopy of the biographic page (where your name and photo are located).
  • Two (2) recently taken photos of each person applying for a visa (5 cm x 5 cm).  Please review our online photo requirements .
  • Your original   birth certificate , English translation,  and  a photocopy.
  • Medical examination results in a sealed envelope (if the physician gives you these results).
  • Original or certified copies of birth certificates for all children of the principal applicant ( even if he or she is not accompanying) .

Applicants who fall into any category listed in italics below should bring these additional documents:

For family based applications:

  • The appropriate  Form I-864 Affidavit of Support  for  each  financial sponsor along with a photocopy of the sponsor’s IRS transcript or most recent U.S. federal income tax return, and any relevant W-2s.  
  • Proof of your U.S. petitioner’s status and domicile in the United States (photocopy of a U.S. passport, Naturalization Certificate, or lawful permanent resident card).
  • Evidence of the relationship between the petitioner and visa applicant (such as family photographs, letters, petitioner birth and/or marriage certificate or emails).

If you are married :   Your  original  marriage certificate, English translation,  and  a photocopy.

If you were previously married:    Your original divorce or spouse’s death certificate, English translation,  and a photocopy. 

If you are older than 16 years of age:  Police certificates are not required from Pakistan . However, an original police certificate is required from any countries where you previously lived.  For more information on obtaining these certificates, visit Reciprocity by Country . If the first three items are all true , or the fourth item is true, you must obtain and bring a more recent police certificate to the interview:

  • You are older than 16 years;
  • Your stay in that country was more than a year; and
  • You obtained a police certificate and submitted it to NVC more than one year ago; or
  • You still live in the country that issued the police certificate and you submitted it to NVC more than one year ago. 

For employment-based visa applications:  Letter from your U.S. employer dated less than one month ago.

If you have ever been convicted of a crime:   Court and criminal records, English translation, and a photocopy.

If you have served in any country’s military:  Military records, English translation,  and a photocopy.

If you are adopted:    Adoption papers or custody documents , English translation,  and  a photocopy.  If you are the petitioner’s stepchild:   The original marriage certificate of the petitioner and your biological parent, English translation,  and a photocopy along with divorce/death records for any previous marriages of either parent.

Interview Guidelines

Arrival at the embassy

The U.S. Embassy is located in the Diplomatic Enclave. All applicants must take a shuttle from the 3rd Avenue, Quaid-e-Azam University Road, Islamabad to the embassy. The fee for the shuttle is approximately 500 Pakistani Rupees for a two-way trip. (The shuttle service is a private company, and the price is subject to change without notice.)

Sending documents to the U.S. Embassy in Islamabad

Following your interview, if you need to send us any documents, please DO NOT mail them to us directly. Instead, follow the instructions the consular officer gives you during your interview.

Rescheduling or cancelling your interview

If you are unable to attend your appointment, please notify us through our online go to US Travel docs to select a new appointment date. There may be a significant wait before the next available appointment, so please attempt to attend the date already assigned.  For some family-based and employment preference visa categories, a visa may become available within the month you are scheduled by NVC. For some of our numerically limited visa categories, there is no guarantee that a visa will still be available on the date of your rescheduled interview. Please carefully consult the Visa Bulletin before you request to reschedule your interview. 

Security screening procedures

All visitors to the U.S. Embassy in Islamabad must follow certain security procedures. Any visitor who declines to be screened by U.S. Embassy security personnel will be unable to enter the embassy. You may not bring cell phones, cameras, or any other electronic equipment into the embassy. All bags will be searched. To avoid delaying your entry and that of those in line behind you, please bring only what is required for your interview.

Accompanying Persons

Attorneys are not permitted to accompany clients into the waiting room or to their interview. Only the following persons may accompany a visa applicant to their interview: 

  • Interpreter:  Applicants may bring ONE interpreter if they do not speak English or Urdu well enough to participate in an interview.
  • Special Needs Visitors:  Applicants may bring ONE person to help if they are elderly, disabled, or a minor child.

Immigrant visa fees

If you have not paid all required fees to the National Visa Center, please be prepared to pay these fees at the U.S Embassy on the day of your appointment before your interview. All fees may be paid in either U.S. dollars or the Pakistani Rupee equivalent. We accept cash and credit cards only. Please note that if you are found ineligible to receive a visa, the application fee cannot be refunded . A complete list of fees can be found on our  Fees for Visa Services webpage .

Do not make travel plans outside of Pakistan prior to visa issuance

If your visa is approved, we will keep your passport at the embassy while we prepare your immigration packet and print a visa for your passport. We will return your passport to you later via courier services only. If you have to travel within Pakistan while your passport is still with us, please make sure you have a valid picture ID other than your passport. 

After Your Interview

A consular officer can make a decision on a visa application only after reviewing the formal application and interviewing the applicant. There is no guarantee that you will receive a visa. Do not sell your house, car or property, resign from your job or make non-refundable flight or other travel arrangements until you have received your immigrant visa.

If more information is needed

Sometimes a consular officer is unable to make a decision on a visa application because he/she needs to review additional documents or the case requires further administrative processing.  When additional documents are requested, the consular officer will give you a refusal letter that asks you to submit additional documents. The letter will include instructions on how to send those documents to the embassy.

Administrative processing takes additional time after the interview. Most administrative processing is resolved within 60 days. However, the timing varies based on the circumstances of each case. Before inquiring about the status of administrative processing, please wait at least 60 days after your interview. 

What happens after visa approval?

Passport, Visa, and Sealed Immigrant Packet – We will place your immigrant visa on a page in your passport. Please review your visa to make sure there are no spelling errors. We will also give you a sealed envelope containing documents that you must give it to the U.S. immigration authorities when you arrive at the port of entry in the United States for the first time.  Do not open this envelope. You must carry it with you; do not put it in your checked luggage. If you receive X-rays during your medical examination, carry those with you and give them to the U.S. immigration authorities. 

USCIS Immigrant Fee – All individuals who are issued immigrant visas overseas must pay an Immigrant Fee to U.S. Citizenship and Immigration Services (USCIS) prior to traveling to the United States. This fee is for processing your residency status and printing your Permanent Resident Card. The only people exempt from paying this fee are:  children entering the United States under the Hague Process, returning residents, and people traveling on a fiancé(e) (K) visa.  

When You Should Travel – You must enter the United States before the expiration date on your issued visa. Your visa cannot be extended and all fees are nonrefundable. The principal applicant must enter before or at the same time as all accompanying family members with visas. Unless they are eligible for benefits under the Child Status Protection Act, children who are issued a visa before turning 21 years of age must enter the United States before their 21 st birthday to avoid losing their immigrant status.

USCIS Immigrant Fee – All individuals who are issued immigrant visas overseas must pay an Immigrant Fee to U.S. Citizenship and Immigration Services (USCIS) prior to traveling to the United States. This fee is for processing your residency status and printing your Permanent Resident Card. The only people exempt from paying this fee are: children entering the United States under the Hague Process, returning residents, and people traveling on a fiancé(fiancé (e) (K) visa. 

Getting a Green Card – Your Form I-551 Permanent Resident Card, also known as a green card, will be automatically mailed to the address in the United States that you write in your visa application form. This is a very important document that proves you have permission to reside in the United States. If you plan to travel outside the U.S. before your green card arrives :  Please consult USCIS’s and CBP’s websites for rules about what documents you need to re-enter the country. We also recommend you check with the airline to ensure you are in compliance with their rules. Once your card is issued, you should not stay outside of the United States for more than one year. If you do, you may lose your status as a Lawful Permanent Resident.

Children’s Issues – Children are required to have certain vaccinations before they can enroll in school in the United States. Therefore, we recommend that you bring your child’s complete vaccination records with you to the United States. Additionally, if your child is adopted, you have full custody as a result of a divorce, or you share custody with the child’s other parent, we recommend that you bring a copy of all applicable adoption or custodial papers from the authoritative court in your home country. You will likely need these papers (translated into English) in the United States for issues such as school enrollment, medical care, and eventual citizenship.

To initiate your application for a US visit visa from Pakistan, you’ll begin by filling out the online form known as D-160 and making the necessary payments. Following this, you’ll schedule an appointment at the embassy for an interview. Drawing from my personal experience with a Pakistani passport, I’ll guide you through each step of the process.

For those seeking a tourist visa, you’ll be required to furnish evidence of your travel arrangements. This includes a comprehensive itinerary outlining your intended journey to the United States, which will be requested when you start the DS-160 form.

Applying for a US visit Visa from Pakistan: A Step-by-Step Guide

Let walk you through the step-by-step process of obtaining a US visa in Pakistan. To kickstart the procedure, head over to a designated website and complete the D-160 form online. Following this, navigate to another website to register yourself.

Once you’ve filled out the D-160 form on the first website, proceed to register for an appointment on the second site. This platform will generate a fee slip for you, which you’ll then take to a nearby Allied Bank branch to settle the necessary visa fee. Following payment, you’ll be able to secure an appointment after a day’s time. On the day of your appointment, you’ll undergo an interview with a visa officer at the embassy or consulate.

USA Visit Visa Requirements for Pakistani Passport Holders

The US embassy in Islamabad and the consulate general in Karachi are the designated centers for receiving non-immigrant visa applications from Pakistani applicants. Residents of Khyber Pakhtunkhwa, Punjab, and FATA should submit their applications to the embassy in Islamabad, while those from Sindh and Balochistan should reach out to the consulate general in Karachi.

Essential Criteria for a US Visa in Pakistan

  • A passport, valid for at least 6 months
  • Appointment letter (Printed)
  • Visa application confirmation (Printed)

The mentioned essential documents should be brought to the embassy or consulate when applying for a US visa in Pakistan. Below, I will provide additional supporting documents for your application.

Supplemental Documents for US Visit Visa Applications from Pakistan

To support your visa application, you may choose to bring along the following additional documents. However, it is not mandatory to do so. The most critical aspect of obtaining a US visa is the interview. If you satisfy the interviewing officer with honest and clear answers, your chances of success are higher. Here is a list of optional additional documents:

  • Bank statement for the last 6 months
  • Marriage Certificate (if applicable)
  • B-form for your children (if they are accompanying you)
  • FRC – Family registration certificate (if the family is accompanying you)
  • Employment Letter (if employed)
  • Leave Certificate (if employed)
  • Company Registration & Relevant Documents (if self-employed)
  • Property papers (if you own property in Pakistan)

Please note, these documents are not mandatory. Only present them if the officer specifically requests them. If the officer has difficulty understanding your statements, providing a document can help clarify your situation. In my case, the officer only asked to see my bank statement. She examined it briefly and returned it to me immediately.

While explaining my purpose for visiting the US, the interviewing officer had some difficulty understanding me, likely due to the glass window separating us. To ensure clarity, I presented the invitation letter I received from the US company I was visiting. This helped her comprehend my reason for traveling to the USA.

Interview Queries for Pakistani Applicants of US Visit Visa

The US visa process consists of two parts . The initial phase involves submitting your application online, while the second phase requires attending an interview at the embassy. In the first part, you provide all the necessary information, including details from your passport and the purpose of your visit visa to the USA. When you face the officer, they already have this information from your form, along with data from various databases. It’s crucial to be truthful in your application; providing false information can lead to visa refusal.

The visa interview typically begins with fundamental questions, many of which you’ve already addressed in the application form. These may include inquiries like why you’re going to the USA and how long you plan to stay.

During the 5 to 6-minute interview, expect follow-up questions and cross-questions. The officials aim to understand your genuine purpose for visiting the USA. They are skilled at discerning honesty from falsehood.

Simply be yourself and respond truthfully. It’s vital to maintain consistency in your statements. Many of the questions will be drawn from the visa application you filled out online in the D-160 form.

Understanding Administrative Processing for US Visit Visa

Currently, it’s quite common for US visa applications to undergo an administrative process. This process involves a security background check, typically conducted within the USA by agencies like the FBI.

If the visa officer takes your passport and provides you with a document indicating administrative processing, it means that, in principle, your US visa is approved. However, the visa officer requires a security check to be carried out by the US government.

The duration of this process can vary significantly, ranging from one week to one year. It’s important to note that this is a case-specific procedure. In my case, the administrative process for my visa application took only one week. However, some individuals have reported it taking more than six months for them.

Importance of Travel History for US Visit Visa Applications

It’s important to note that a robust travel history is not always a prerequisite. If you have strong factors like solid ties to your home and a reputable professional background, an extensive travel history may not be as crucial.

I find it perplexing why some individuals travel solely to accumulate a travel history. Personally, when I applied for a US visa, I had only visited Thailand, Malaysia, UAE, and Sri Lanka. None of these trips were undertaken with the intention of enhancing my US visa application. It’s worth mentioning that my UK visa had been rejected just 15 days before I applied for the US visa.

However, if you’re a single individual under 30, having some travel experience can bolster your case. Generally, those who are married and possess a strong professional background tend to have higher chances of US visa approval.

Visa officers are keen on understanding what ties you to your home country and what you’re leaving behind when you travel. Family (spouse and children) holds paramount importance in this regard. Additionally, a thriving business or a stable, long-term job are considered significant ties for visa purposes.

Consider this scenario: A close associate faced two rejections for a US visa. Despite having compelling merits, being unmarried and lacking international travel experience proved a hurdle. At 24 years of age, the odds were against him. In contrast, another individual, aged 42 with a family, modest income, and limited travel history (Malaysia & Dubai), secured visa approval in a mere five minutes.

The US visa application process, relatively speaking, is notably streamlined. It’s akin to a calculated risk for many Pakistanis. On interview day, it’s either a swift visa acquisition or a loss of the $160 application fee. This underlines the importance of meticulous preparation. Your purpose for visiting the USA must be genuine and presented with utmost clarity when probed by the visa officer.

Financial Requirements: How Much Bank Statement is Needed?

In terms of finances, more is definitely better. While having a substantial amount in your bank account is advantageous, it’s important to be realistic, especially for working-class individuals. Considering the considerable expenses and distance between Pakistan and the USA, it’s crucial to have sufficient funds available when applying for a visit visa.

For instance, if you earn Rs. 100,000 per month in Pakistan, having around 1 million PKR in your account demonstrates sound financial management. This signifies savings from your earnings. It’s also wise to assess your income and expenses. If your spending approaches or exceeds your earnings, it may weaken your application. To be on the safe side, I recommend submitting a bank statement with more than 1 million rupees, considering the high costs associated with the USA.

Concluding Thoughts on the US Visa Process

For unmarried individuals, focusing on establishing strong business or job connections, property ties, and accumulating travel experiences can be particularly beneficial. If you’re an avid traveler, exploring tourism opportunities in the USA is a sensible choice, given the generous 5-year visa duration. Applying for a US visa is a worthwhile endeavor, as it can lead to numerous opportunities. With a valid US visa, you’ll enjoy visa-free access to countries like Turkey, Georgia, Albania, Serbia, Macedonia, and Bosnia & Herzegovina. Additionally, holding a US visa significantly boosts your chances of obtaining a Canadian visa on a Pakistani passport.

US embassy expedites visa appointments for Pakistanis

ISLAMABAD  -  The United States embassy yesterday expedited visa appointments for Pakistanis amid protests by the applicants. The decision came as hundreds of ap­plicants complained that they were not getting visa appointments for long. “Demand for US visas is the highest it has ever been. We are processing more visa applications than ever before and are working hard to bring down visa appointment wait times. To­day, the US Mission to Pakistan is proud to announce three ways we are working to meet unprecedented demand,” said a US embassy announcement.

It added, “First, we have expedited thousands of non-immigrant visa appointments. More than ten thousand Pakistani visa applicants originally sched­uled for 2024 at the US Consulate General in Karachi are receiving notice that their appointments have been rescheduled in 2023, some as early as next week. The US Embassy in Islamabad is already accepting interview waiver applications for qualified applicants, it said.

The embassy said, “Taken together, these steps demonstrate how deeply the United States values the relationship between our two countries. Our goal is to facilitate legitimate travel to the United States as quickly and efficiently as possible – because we know how important it is to stay connected with family, to strengthen business ties, study, and make cultural connections with the United States.”

  • You only need to fill one form which is DS-160 that is web-based, you will need to fill the information online.
  • After submitting an online application you will get a confirmation which you need to print.
  • After that, you will need to visit any branch of United Bank Limited in Pakistan where you need to submit the fee and get the receipt. The Visa fee is $160 which is subject to change in the Dollar rate.
  • You need to wait for 24 hours before your payment is reflected in the online appointment booking area. You can book your appointment date and time as per your convenience.

  • 4 photographs, 34×45 mm (white Background, without glasses/cap).
  • Updated 6 Months Bank Statement duly stamped & signed from the respective bank with Min PKR 1.5 Million Closing Balance.
  • Account Maintenance Certificate from the respective Bank.
  • 2 Covering Letters
  • Polio Certificate
  • NTN Certificate Copy
  • Tax Returns Copy
  • Chamber of Commerce Certificate
  • Family Registration Certificate (for Family Traveling)
  • Marriage Registration Certificate (for Spouse Traveling)
  • 3 Months Salary Slips (For Job Holders)
  • Cover Letter from Company (Describing your job, designation, date of Joining and your salary)
  • Tax Deduction Certificate (if any Tax is deducting)
  • Any other Supporting Documents Which Show your Ties in Pakistan for USA visa
  • Approval Is Subject to United States of America Embassy / Consulate.
  • United States of America visa Fee Is Non-Refundable in All Cases.

The United States Mission to Pakistan on Tuesday said it was taking measures to bring down the visa appointment wait time for Pakistanis while the demand for US visas was the highest it had ever been.

“More than 10,000 Pakistani visa applicants originally scheduled for 2024 at the US Consulate General in Karachi are now receiving notices that their appointments have been rescheduled in 2023, some as early as next week,” the US embassy in Islamabad said in a statement , adding that it was expediting thousands of non-immigrant visa appointments as the first measure to meet “unprecedented demand”.

Jayne Howell, the head of US visa operations in Pakistan, said the move would reduce wait time by three to six months.

The US Mission advised applicants that if they had a visa appointment in the next few months at the US Consulate General in Karachi, they could check their e-mails and log in to their accounts at the embassy’s website to confirm their expedited appointment time.

Moreover, it said to create added flexibility for Pakistani travellers, visa applicants could rebook appointments, at either the Consulate General in Karachi or the US Embassy in Islamabad.

The embassy hoped that this would allow applicants “more freedom and flexibility to find a convenient date, time and location”.

Lastly, it said that beginning from September 25, the Consulate-General would begin accepting new interview waiver applications for some applicants who were previously issued US visas. Applicants could check ustraveldocs.com/pk to determine whether they were eligible, print out a confirmation letter and submit their application materials to a drop box without the need for an appointment, it added.

The mission said the US Embassy was already accepting interview waiver applications for qualified applicants.

“Taken together, these steps demonstrate how deeply the United States values the relationship between our two countries.

“Our goal is to facilitate legitimate travel to the United States as quickly and efficiently as possible — because we know how important it is to stay connected with family, to strengthen business ties, study, and make cultural connections with the United States,” it said.

More than 10,000 Pakistani visa applicants originally scheduled for 2024 at the US Consulate General in Karachi will receive notifications that their appointments have been rescheduled to 2023, with some appointments available as early as next week.

DUBAI – The United Arab Emirates (UAE) issues tourist or visit visa to the foreign nationals, including Pakistan and Indian nationals, for different periods to explore the Gulf country.

The foreigner is granted an entry visa for a single visit for the purpose of tourism for a period of 30 or 60 days and the sponsor / host in UAE should be one of the establishments working in the field of tourism, after paying the prescribed fee and financial security deposit.

FACT SHEET: President   Biden Announces New Actions to Keep Families   Together

Since his first day in office, President Biden has called on Congress to secure our border and address our broken immigration system. As Congressional Republicans have continued to put partisan politics ahead of national security – twice voting against the toughest and fairest set of reforms in decades – the President and his Administration have taken actions to secure the border, including:

  • Implementing executive actions to bar migrants who cross our Southern border unlawfully from receiving asylum when encounters are high;
  • Deploying record numbers of law enforcement personnel, infrastructure, and technology to the Southern border;
  • Seizing record amounts of fentanyl at our ports of entry;
  • Revoking the visas of CEOs and government officials outside the U.S. who profit from migrants coming to the U.S. unlawfully; and
  • Expanding efforts to dismantle human smuggling networks and prosecuting individuals who violate immigration laws.

President Biden believes that securing the border is essential. He also believes in expanding lawful pathways and keeping families together, and that immigrants who have been in the United States for decades, paying taxes and contributing to their communities, are part of the social fabric of our country. The Day One immigration reform plan that the President sent to Congress reflects both the need for a secure border and protections for the long-term undocumented. While Congress has failed to act on these reforms, the Biden-Harris Administration has worked to strengthen our lawful immigration system. In addition to vigorously defending the DACA (Deferred Action for Childhood arrivals) policy, the Administration has extended Affordable Care Act coverage to DACA recipients and streamlined, expanded, and instituted new reunification programs so that families can stay together while they complete the immigration process.  Still, there is more that we can do to bring peace of mind and stability to Americans living in mixed-status families as well as young people educated in this country, including Dreamers. That is why today, President Biden announced new actions for people who have been here many years to keep American families together and allow more young people to contribute to our economy.   Keeping American Families Together

  • Today, President Biden is announcing that the Department of Homeland Security will take action to ensure that U.S. citizens with noncitizen spouses and children can keep their families together.
  • This new process will help certain noncitizen spouses and children apply for lawful permanent residence – status that they are already eligible for – without leaving the country.
  • These actions will promote family unity and strengthen our economy, providing a significant benefit to the country and helping U.S. citizens and their noncitizen family members stay together.
  • In order to be eligible, noncitizens must – as of June 17, 2024 – have resided in the United States for 10 or more years and be legally married to a U.S. citizen, while satisfying all applicable legal requirements. On average, those who are eligible for this process have resided in the U.S. for 23 years.
  • Those who are approved after DHS’s case-by-case assessment of their application will be afforded a three-year period to apply for permanent residency. They will be allowed to remain with their families in the United States and be eligible for work authorization for up to three years. This will apply to all married couples who are eligible.  
  • This action will protect approximately half a million spouses of U.S. citizens, and approximately 50,000 noncitizen children under the age of 21 whose parent is married to a U.S. citizen.

Easing the Visa Process for U.S. College Graduates, Including Dreamers

  • President Obama and then-Vice President Biden established the DACA policy to allow young people who were brought here as children to come out of the shadows and contribute to our country in significant ways. Twelve years later, DACA recipients who started as high school and college students are now building successful careers and establishing families of their own.
  • Today’s announcement will allow individuals, including DACA recipients and other Dreamers, who have earned a degree at an accredited U.S. institution of higher education in the United States, and who have received an offer of employment from a U.S. employer in a field related to their degree, to more quickly receive work visas.
  • Recognizing that it is in our national interest to ensure that individuals who are educated in the U.S. are able to use their skills and education to benefit our country, the Administration is taking action to facilitate the employment visa process for those who have graduated from college and have a high-skilled job offer, including DACA recipients and other Dreamers.

Biden Announces New Protections for Undocumented Immigrants

President biden announced an executive action to protect about 500,000 undocumented spouses of u.s. citizens from being deported and provide them with a pathway to citizenship..

A few days ago, we marked the 12th anniversary taking care of dreamers that President Obama and I put in place. There were a few of these immigrant — these immigration areas that have had most positive impact and gotten more support from the American people across the board. These young people known as Dreamers, Hispanics, South Asians and more who came to America as children only know America as their home have been able to live and learn out of the shadows. So today I’m announcing new measures to clarify and speed up work visas to help people, including Dreamers, who have graduated from U.S. colleges and universities, landed jobs in high-demand, high-skilled professions that we need to have grow — to see our economy grow. It’s the right thing to do. I’m announcing a common-sense fix to streamline the process for obtaining legal status for immigrants, married, excuse me, to American citizens who live, lived here and lived here for a long time. Let’s be clear. This action still requires undocumented spouses to file all required legal paperwork to remain in the United States. It requires them to pass a criminal background check. And it doesn’t apply to anyone trying to come here today.

The reporters have covered immigration policy and politics during both the Trump and Biden administrations.

President Biden on Tuesday granted far-reaching new protections for hundreds of thousands of immigrants who have been living in the United States illegally for years but are married to American citizens.

Under the new policy, some 500,000 undocumented spouses will be shielded from deportation and given a pathway to citizenship and the ability to work legally in the United States. It is one of the most expansive actions to protect immigrants since Deferred Action for Childhood Arrivals, or DACA, was enacted 12 years ago to protect those who came to the United States as children.

“These couples have been raising families, sending their kids to church and school, paying taxes, contributing to our country,” Mr. Biden said at the White House, where he was joined by members of Congress and DACA recipients, known as Dreamers. “They’re living in the United States all this time with fear and uncertainty. We can fix that.”

Mr. Biden also said he would make it easier for young immigrants, including Dreamers, to gain access to work visas, a significant move that could help them eventually get a green card. That would protect their legal status even if DACA, which is already tied up in litigation, disappears.

“We’re a much better and stronger nation because of Dreamers,” Mr. Biden said, as he marked the anniversary of the Obama-era DACA program.

The new policy allows Mr. Biden to balance his recent crackdown on asylum with a sweeping pro-immigrant measure at a moment of political peril. With five months until the presidential election, Mr. Biden has been trying to curtail record numbers of illegal border crossings without alienating longtime supporters who have called for a more humane immigration system after the Trump years.

The policy aims to help people who have been living in the United States for more than a decade, building lives and families here. Even though marrying an American citizen generally provides a pathway to U.S. citizenship, people who crossed the southern border illegally — rather than arriving in the country with a visa — are required to return to their home countries to complete the process for a green card.

The new program allows them to remain in the country while they pursue legal status.

There are roughly 1.1 million undocumented immigrants married to American citizens in the United States, according to FWD.us, an immigration advocacy group, but not all of them are eligible for the program.

To be eligible, the spouses must have lived in the United States for 10 years and been married to an American citizen as of June 17. They cannot have a criminal record. The benefits would also extend to the roughly 50,000 children of undocumented spouses who became stepchildren to American citizens.

The new benefits for undocumented spouses will not take effect right away; senior Biden administration officials said they expected the program to begin by the end of the summer. Those eligible will then be able to apply for the benefits.

“The president is sending a message that immigration is not just about the border,” said Marielena Hincapié, an immigration fellow at the Cornell Immigration Law and Policy Program. “He’s focusing on long-term immigrants, not recent arrivals.”

Immediately after the announcement, however, allies of former President Donald J. Trump accused Mr. Biden of being weak on the border. Speaker Mike Johnson said the president was “granting amnesty to hundreds of thousands of illegal aliens.”

America First Legal, a conservative organization run by Stephen Miller, the architect of Mr. Trump’s anti-immigration policies, indicated on social media that the group would challenge the program.

Mr. Biden has said he has had to use executive action to address immigration because Republicans in Congress refuse to act. Republicans blocked a bipartisan immigration bill in February , saying it was not strong enough even though it included some of the most significant restrictions Congress had contemplated in years.

Many of the Republicans, encouraged by Mr. Trump, were not inclined to give Mr. Biden a legislative victory in an election year.

“So much for Republicans caring about the border,” Mr. Biden said on Tuesday.

Two weeks ago, Mr. Biden bypassed Congress and issued an executive order that prevents migrants from seeking asylum at the U.S.-Mexico border when crossings surge. It was the most restrictive border policy instituted by Mr. Biden, or any other modern Democrat.

Almost immediately after the president issued that order, White House officials began privately reassuring progressives that he would also help undocumented immigrants who had been in the nation for years, according to people familiar with the conversations. On Tuesday, Mr. Biden did just that.

The new policy could help Mr. Biden in battleground swing states like Nevada, Arizona and Georgia, which each have more than 100,000 voters who live in “mixed status” households, according to the American Business Immigration Coalition, a group that supports the proposed policy change.

“The road to the White House runs through Nevada, and people in my state are paying attention,” Senator Catherine Cortez Masto, Democrat of Nevada, wrote in an opinion essay for Univision this week. She said protecting undocumented spouses would bolster the economy in her state.

Mr. Biden is relying on a program known as “parole in place,” which has been used for other populations like families of military members. The status gives noncitizens the ability to temporarily live and work in the United States without fear of deportation.

One of the people who could be directly affected by the change is Ashley DeAzevedo, the president of American Families United, whose husband is undocumented. Her group supports mixed-status families like hers . The couple has been married for more than a decade and has an 11-year-old child.

“It would be an absolute game changer to not have to worry about being separated, because right now he could technically be removed,” Ms. DeAzevedo said. “There’s always a concern if he gets pulled over or anything like that. It could be, you know, just catastrophic for our family.”

While some Democrats applauded Mr. Biden’s new policy for undocumented spouses, many immigration advocates remained concerned about the life span of the original program the White House celebrated on Tuesday.

In the years since President Barack Obama created DACA in 2012, it has allowed hundreds of thousands of young adults to get jobs and live without fear of deportation.

But DACA has been closed to new applicants since 2017, when Mr. Trump tried to end the program. It remains ensnared in litigation, and its long-term survival remains in question, even though it was revived for existing beneficiaries. Participants are now, on average, in their mid-30s.

Recipients who were once children fearful of having their parents deported “are now the parents afraid of getting deported,” said Bruna Bouhid-Sollod, a senior political director at United We Dream Action, an advocacy group for DACA recipients.

Mr. Biden appeared intent on addressing those fears with his announcement on Tuesday that the administration would make it easier for Dreamers to be sponsored for a work visa by their employer.

“It’s been a big fear for me that DACA could end,” said Monica Sandoval, 32, an emergency room nurse in Columbus, Ind., who enrolled in the program immediately after it was unveiled.

Ms. Sandoval has renewed every two years, enabling her to keep her job and her nursing license.

She hoped the new process would allow her employer, a regional hospital, to sponsor her for a work visa and then a green card.

“This would be life-changing for me,” said Ms. Sandoval, who was brought to the United States when she was 12 and is the mother of two young children. “It would bring security to me and my kids, and I’d know for sure that I could keep doing the work I love to do.”
